Good Afternoon,
Here is our response to the complaint:
TR Smith Construction Incentered into a contract with *** *** to build his home in Joplin MO Mr*** decided to go with a cost plus 10% contract Mr*** was
supplied receipts of goods and services that were provided on his job on a weekly basis of which he verified and paid We made it very clear to Mr*** that all communications must be filtered thru TR Smith Construction and that his point of contact would be *** Several times during the construction process Mr*** or his Secretary called our sub-contractors even though they had been informed of our policy on communication This created many issues in the communication of the job We explained our policy again with continued disregard from Mr*** and his Secretary Many items were purchased for their home that they did not supply to TR Smith either by invoices or receipt in order to obtain our cost plus percentage agreement When Mr*** stated he would no longer communicate with *** we should have ended our contract then, as communication with our customer is ***'s primary responsibility In reviewing phone records Mr*** or his Secretary's calls were returned in a hour period TR Smith Construction attempted at that point to try and handle the situation thru the owner's wife *** does in fact have another job, however Mr*** and his Secretary were told her availability would be limited to Wednesdays and evenings and they were agreeable to this at that time This was our final attempt to salvage the relationship The end result was an email to us stating that he was consulting with an attorney Upon receiving the email, TR Smith Construction made the decision to end all work and the relationship based on this communication since it created a legal and hostile work environment for all concerned Mr*** did not overpay for any items or services as he was provided receipts and invoices for each item and he paid them Therefore by our policy, no refund will be submitted We have had several Contractors state that they have received phone calls from Mr*** and his Secretary in order for them to take over their job as they were told TR Smith Construction had been fired I believe we can say it was a mutual agreement at this point as they have continuously slandered our name

I cannot accept their response because many of the comments are fictional One such response is how I would not allow them to finish building the house In fact, we had to beg them to dry in the house because stacks of shingles were sitting on the roof and windows which had been ordered were not put in
Therefore, there was no mutual agreement in them terminating the contractI have an email stating that they were terminating the contract and the following email from us asking them to continue building the house I have kept all of the emails, texts, and phone records that were between us and can display them Having kept these will show that another untruth in their response is how they communicated with us within hours There were several days, even weeks, that went by before we would hear from them Another, lie that is mentioned is how we called other builders and said that we "fired them" We have had to find another builder to finish the house, and we were very truthful to each builder we talked to about how our contract was terminated by TR Smith We talked to several builders who were very helpful and felt bad that we had been mistreated by TR Smith In fact, it was at this time that we learned that *** *** had supposedly lost his first home building company for several wrong doings We did send an email to them stating that we could no longer work with *** because he was very inexperienced and not knowledgeable about the building process We were especially concerned after we learned that *** was "let go" from his previous job as high school principal for some "shady" activities We tried to work with *** directly, but after asking specific questions in which he had no knowledge about, we did start asking to speak to the subcontractors directly Several of them told us that they were happy to help us and answer any questions we had They said that by us talking to them directly it would help them in knowing exactly what we wanted *** was always very secretive about who the subcontractors were and even led us to believe that they would not be using a professional tile person but would just have one of their crew guys lay the tile This worried us because we were having two large showers built in the house and needed a professional to do the jobTherefore, we did contact some professionals to ask them questions This outraged *** and he called me and was very rude and unprofessional on the phone That is when I decided that I could not work with him I sent what I thought was a nice email stating that since I lived in Texas and could not be present there but once a month, I needed to be able to communicate with someone that was more knowledgeable TR Smith never acknowledged my email or ever tried to contact me to discuss this issue One last comment they made that I want to respond to is the fact that yes, I did buy several items for the house but those items were never installed by them so no, I did not give them the receipts They only did the foundation and framing before terminating the contract so thank goodness I did not give them the receipts or they would have taken more money from me With all of this said, I am very surprised that TR Smith even replied to the complaint because they have this holier than thou attitude toward everyone and everythingAfter speaking to several people that have dealt with TR Smith, I am actually grateful that they terminated the contract I have been told that especially after you give them the last check, you will never hear from them again Several of the people that have used them to build their homes have tried to contact them about some issues and they never respondTherefore, there is a very good chance that there will be more complaints made against themMy main goal in this complaint is to keep others from going through this same bad experience
