To Whom it May Concern:
I intend to do my best to outline why I feel that this claim is completely unreasonable and unwarranted. Additionally, it appears to me that it is just an attempt to get money out of our companyThe
first fallacy begins in the second sentence of the complaint. We have a contract for a week job, not 2, nor was it ever to be weeks. The scope of work was altered multiple times throughout the project, and a number of large ticket items were added including tiling the entire basement floor, installing a home theatre surround system, and increasing the scope of the initial amount of flooring installed. The flooring install question leads quickly back to the conditions of her home. I have a certified flooring inspector who indicates that lack of humidity in the home created issues with shrinking of the wood product (which the customer supplied). We made multiple attempts to go back and fix the problem as a courtesy to our customer.
The cap trims on the railings did have some imperfections, which we went back to correct. While the customer was showing me the issues of some being crooked, her year old son started pulling on them, and climbing on the railing. This is the point where is said to make sure that they are allowed to try, as they are installed by an epoxy that needs hours to set.
The issues of the egress window cap flying off is something that had honestly never been mentioned to me until the week prior to her making this claim, however, being a emergency escape route for her basement, it is not secured into place. The kit that she approved did not include a fastening system, and the systems lids are made to be easily removable in case of the need of use for emergency escapeThe backsplash work that has been complained about was added to the contract over a year after the initial work was complete. At this point, the customer also asked for me to provide estimates for remodeling bathrooms, which is indication to me that the customer must have been happy to continually ask for additional work. The complaint made about the backsplash was minor caulk cracking that was adjusted, and a small section of tile that was removed and replaced. This repair was done in January of 2015. The bill was never paid from this and I never heard anything from the customer until March of when the customer and I met and she asked if I would work with her and on her behalf to sue Lumber Liquidator$. At that point I told her that I would gladly pass on any information that I knew about the flooring issues, and additionally told her to let me know if she needed anything else done. From that point, I did not hear from the customer until August 30, 2015. In this transmission, the customer asked for me to give her back money on the flooring install, that yes, had happened nearly years ago at this point. I thought that this was fishy, so I did some research and found that the customer had put her house on the market and had just gotten a contract on the sale of her home days prior. I even looked through the listing and noticed that she was advertising the quality of the flooring that she is requesting to be repaid for... The house had a contract on it on August and settle on September 30. I have attached the listing. This is the very reason she doesn't want us back to fix anything is that she sold the house. Not because we were not willing or able to warrant our work in any way, but because she doesn't even own the house anymore.
