made an agreement to purchase aDirect Mail Campaign with a Voice afrom TagQuestThe invoice signed by the client clearly stateswhat services are promised, implied, and expected by the client to be received by TagQuestThere wasno contract implied, expressed, or agreed upon for a magic mailer marketing systemAs part of ouragreement *** *** *** signed the invoice stating they have “read and understand theTagQuest Terms and Conditions set forth on our website at www.tagquest.com”*** *** also sign a payment form stating they have “read and agree to TagQuest terms andconditions”A copy of our terms and conditions has also been attachedWe have these terms andconditions because we use the funds received by the client in order acquire the resources needed tofulfill their order.The terms conditions clearly state in the first paragraph “TagQuest makes no warranty, express orimplied, whether oral or written, of the outcome of any marketing campaign”No misrepresentationwas made as to the “converted” calls or the number of calls that would be generatedDirect mail is aneffort to engage a prospective client and close new businessNo one can force a consumer to respondto a solicitationAs detailed in the attached mail delivery report TagQuest did in fact mail out mailpieces including data, data merge, print, production, first class postage, paper, HRW envelope, on July11th as agreed upon in detail on the invoiceTagQuest also delivered (two) Voice campaigns as shownin the attached voice reports that these were delivered one week apart as agreed to on the invoice.Even under these circumstances, and knowing that we are not at fault; TagQuest understands that theclient may not receive the outcome they were hoping forFor this reason our sales representativecontinued to follow up with the client to offer alternative solutions even after the client expressed theirdisappointment in the campaignAs detailed in his log notes below:8/6/10:55am - ***: Does not want a deal, he wants something at no cost to make up for themail bust.7/31/9:01am - ***: Needs a "deal" today.7/27/12:24pm - ***: Not happy thinks I sold him a bill of goods, says we would have to dosomething for him for free before he would think about working with us again
The client wasn’t offered something to make it up to himThe client specifically asked for somethingelse for freeOur sales representative explained that this was not possible because we had fulfilled ouragreement as contractedAs noted in the log notes above by the dates of outbound call attempts toclient TagQuest was and will continue to be willing to work with client at a discounted rate in an effortto satisfy their concerns and retain their business

TagQuest has worked diligently to respond to and resolve concerns raised by Mr. [redacted]. The attached documentation gives a detailed depiction of what went on during the course of our involvement with Moneyline Merchant Services. TagQuest not only fulfilled the contract being disputed but also...

over-delivered the Internet Lead order by over 30%. Mr. [redacted] was given a custom return policy in writing in an effort to resolve his concerns. Leads that didn't meet the agreed upon criteria were returned in accordance with that policy and he was given more leads above and beyond what was promised. The agreement between TagQuest and Moneyline Merchant Services was honored. Over a month was spent working with Mr. [redacted] delivering the Internet Leads he ordered and resolving concerns that he raised. Internet Leads are generated online requiring the use of third party resources such as search engines. This was not a data order. Mr. [redacted] was not lied to. TagQuest addressed Mr. [redacted]'s concerns, provided great service, and over delivered Internet Leads to Moneyline Merchant Services.
