Tails of Gold entered into a Stud Dog Contract with complainant, *** *** in November, Service was provided with our experienced, capable and proven stud dog, VegaThe dogs mated several times, however, no pregnancy

While there is no guarantee of a live birth, the terms of the contract provide for a return service in the female's next two consecutive heat cycles if there is no live birthIn discussing this with Ms***, she opted not to return for service in the next cycle which technically ended our contractual obligation to herHowever, in January, 2015, while I was on vacation Ms*** showed up at our business with her dog in seasonWhile we were no longer obligated to do so, I agreed to give her a return serviceShe left the dog and picked it up again after the matingI hadn't even gotten back from vacationMy staff handled the mating
Our contract and common industry standards do not require a live birth for collection of the stud feeOur service is to make our stud dog available for matingOur contact allows for two return services in consecutive heat cycles if there is no live birthWe went above and beyond the call of duty by allowing a return service after the next consecutive heat cycle
Ms*** subsequently chose to spay her dog making her unable to breed and impossible to produce any live birthsShe cannot expect us to pay her for her choices
The fact that her dog was unable to conceive in the first mating and only produced one still born pup in the second, leads me to believe there was a problem with Ms***'s dog that made her unable to have a healthy litter of puppiesIt is very unfortunate for Ms*** but, Tails of Gold provided the services it contracted for and no refund is due the customer

first of all, I never signed a contractsecond I never I returned with my dog on the first cycle after the original breeding, my dog did not go into heat until that timehad she bothered to return my calls or emails she would have found this out
A third, the second time my dog went there the stud I paid for was not used, a female employee told me she was artificially inseminated, which I was never asked about or agreed toand, had I not spayed my dog, she Gould have had further problems in the breeding process
had I have given a contract I may have known about these 'certain rules' but I do not have oneI would like her to provide one with my signature
if this breeder was at all reputable, she would have dealt with this situation instead of avoiding contact and resolutionI left my fog with her employees because she refused to contact meeven her employees agreed that the situation could be amiacably resolved if she communicated with meShe never even knew my dog didn't get bred the first time had I not called her umpteen times to get ahold of her
I contacted several Minnesota dog breeders about this situation and they first of all said they would have asked for half of the fee and the rest when the job was complete, and that they would work with the owner until the dog was bredthe asked about what the contract said, and I told them I wouldn't know, I never got oneI would be glad to give the names of these breeders as they are Also AKC and members of the MN breeders Assn
She could easily resolve this by providing the contract between us
