On December 29, 2015, Mr. [redacted] submitted an online application to Talavera Apartments. On December 30, 2015, [redacted] Simmons, the leasing agent, called Mr. [redacted] to inform him she had received his online application and he would need to come into the office to fill out other addendums so...

we can continue to process the rental application. [redacted] called Mrs. [redacted] to remind her they need to come in the office to go over the application and sign other addendums. Mr. and Mrs. [redacted] came in on January 2, 2016 and spoke with another leasing agent [redacted] as [redacted] was not available. During that time, they were given all the required addendums to review and sign. They both signed all the addendums (see attached) and then before they left they told [redacted] they would like some time to research more in the carpet standards/replacement policy and would let us know. No contact was made until we received a certified letter on January 10, 2016 demanding all of his money to be refunded as he claims the application was not approved within a certain time frame or applicants notified. The fact remains he and his wife informed my leasing agent, while in our office on January 2nd they needed time to review and would let us know how to proceed. Per our policy and the addendums he and his wife signed, once an application has been submitted and all appropriate fees have been paid, once an applicant cancels the administration fee is refunded and security deposit and application fees are non refundable. I did get an approval from my corporate office to refund the deposit back as well as the administration fee already refunded as this is a learning experience. We have not experienced anyone who applies and disapproves of our policy. We are making sure all of the addendums are on the website for applicants to review before submitting an application. I am rejecting this response because:The responce from the apartment complex is in correct. We concelled our offer when the apartment complex requested our bank records. At the time we canceled we were told we would not get our deposit back in a sarcastic manner. We decided to buy . It was easier to buy than rent apartment. We were aware that we would not get back our admistration deposit . But why in the world can the apartments justify keeping a dog deposit security, and other deposit's when no contract was signed or occuprance toke place.This proves my point that the apartment comlplex handles their buisness in a very slamdunk manner..

the application on April 24, 2015 due to purchasing a home instead. Per the rental application they signed at time of applying, it states in paragraph 7, "You and any co-applicants may not withdraw your application or the application deposit. If before signing the Lease Contract, you or any co-applicant withdraws an application or notifies us that you've changed your mind about renting the dwelling unit, we'll be entitled to retain all application deposits as liquidated damages, and the parties will then have no further obligation to each other. In reviewing the account after receiving the compliant, I found out they did not get the administration fee refunded and all monies were retained. Our company policy is to refund the administration fee only if an applicant cancels. All other monies paid are non-refundable. Due to a staff change this was never processed correctly.
