Dear Revdex.com of Metro Washington DC & Eastern Pennsylvania;
I am responding to the letter from Tallarico’s Lawn &
Landscape Management dated May 6, 2014. There are several issues with their response,
which I will detail below
The first is the issue of trespassing on our property to cut
the tree. As their ladder was against
the tree and the tree is on our property, they were on our side of the property
line. The ladder was not on the driveway
when the cutting occurred, but was in the grass[our property]
Second was the statement that the employee was never rude to
my spouse. I believe yelling at your
client’s neighbor would be considered rude to most reasonable people. I’m not sure what else I can say
Concerning the law that you “cannot have trees on your
property hanging and dropping leaves over someone else’s property”, I contacted
Lower ***’s building code official, and he informed
me that there is no township ordinance concerning tree trimming[other than as
not to interfere with the unimpeded use of the street and sidewalk, which does
not apply in this case] I would be
interested in seeing the copy of the law that Tallarico’s are quoting. In addition, we all live in wooded lots with
trees hanging over each other’s property lines.
I believe everyone’s trees on all our borders would be in violation if
this were the case
Addressing the comment that we need to maintain the trees on
our property, we certainly do take this seriously. In 2012, there were trees along this same
property line that were starting to, or already had died and were posing a
potential threat to our neighbor’s house.
We worked closely with the neighbor and our arborist to safely take
these trees down. We certainly could
have waited until they fell over, but we wanted to do the right thing for our
neighbor
The tree in question that was “trimmed” by Tallarico’s was
actually topped. Ironically, the way the
tree was cut, it will invite more growth to establish near the cut, pushing
more and smaller growth over the driveway of their client. And I would like to know what arborist certification
Tallarico’s are purporting to hold. A
business that has a certification and doesn’t disclose this certification on
their website probably doesn’t hold any certification. Our company, who has a certified arborist,
came to look at the tree. He recommended
that I do additional cutting to minimize the damage done, which I have to do at
my expense. And if the tree dies, why should
they not be held liable?!? This tree, including
the top that was cut, was in full bloom; it was not diseased. But as they cut off over half of the crown,
we have concern that the tree will not survive
But perhaps the most disturbing part of this entire
experience, and that was completely absent from Tallarico’s response, was the
fact that after my spouse talked to the crew and expressed her concerns, the
employee said he would not do any cutting until we and the neighbor spoke. She then returned to the house only to hear a
short time later that a saw was running and the tree was cut. Obviously this employee understood that there
was a potential issue and he decided to wait.
Why Tallarico’s then decided to go ahead and cut without coming to our
house first [right next door] I have no idea.
But this certainly does not sound like a reputable company if this is
how they conduct business.Regards,

Dear ***,I am writing to you because I received a complaint letter from the Revdex.com that a person filed on usI want to make it clear that we never trespassed on ***' property to cut the part of the tree that was hanging into my clients' yardWe were never
rude in any way to herMy worker simply told her that it is a law that you cannot have trees on your property hanging and dropping leaves over someone else's propertyWe were hired by Attorney *** *** to cut part of the tree that was on his propertyWe do not feel we have to give anyone notice of that since it isn't in her propertyWe are certified to trim and remove trees but no one ever displays the certificates anywhere while on the jobWhenever we do our services on that property, we are very careful not to push any debris or grass clippings over to the neighbors' yard because it isn't right and because they have expressed their concern over some grass clippings beforeThis neighbor just complains about everything when we are there trying to do our jobIf she has any complaints or concerns, she should take it up with the person who hired us to do the job, not usIt isn't fair for her to put in a complaint against us for doing our job and abiding by the lawWe never stepped foot on her property and therefore the issues she stated on the complaint are falseWe should not be held accountable if the tree does not surviveThe *** family needs to respect the property of their neighbors as well and maintain the tree on their property so no one else has to do it for themPlease do not hold this complaint against usWe are an A rated company and if you look on ***'s ***, we have an A rating and were recently awarded a Super Service Award.Thank you,
