To whom it may concern in response to claim# ***: *** *** and her party of total did in fact call us Sunday May 17th to book a skydive for Monday May 18th at 11:00am We typically require a $non refundable deposit per person to be made in order to actually make a
reservation Because they were coming from Madison and were coming the next day, I did not take their money ahead of time and just asked that they called the morning of the jump should any of their plans change *** ***, one of ***'s party members and I spoke Monday 5/morning at 9:01am where he asked if they could add an additional member, at which time I said that would be fine and we could accommodate the additional member of their party When they arrived to the facility they filled out waivers as normal, paid for their jumps, etc They were the second group to arrive that day and therefore going to be the second group in the air The wind was forecast to be out of the due west which is a clean wind line (no buildings, trees, or other turbulence for us to land) and while it was forecast to be strong, the FORECAST numerically on paper was within our safety limits We sent the first load up, and while yes, they landed safely without injury, the wind had not only picked up but had started to shift out of the N/NW which caused turbulence from the hangars, which are located on the north side of our landing area We have a clean safety record at Great Lakes Skydiving and we adhere to strict safety protocol to insure this continues In an industry where you get paid by the jump, believe me, no one wants to jump more than we do However we felt, after seeing the first landings and how the wind shift had affected them, that we would call it for the day for everyone's safety as the wind was not forecast to die down all day *** *** demanded refunds and a free video because they had driven from Madison to Beloit and been inconvenienced by the cancellation; I informed him that our company policy (as it is clearly posted throughout the hangar as well as in the confirmation email, of which I will touch on later) is to issue a rain check instead of a refund We then discussed the possibility of them coming out the following day 5/19, which was forecast to be overcast all day Because the weather forecast for the following day was not good I told them to call in the morning and we can see what the weather is doing before they drive all of the way out again I spoke to *** times the morning of Tuesday 5/in regards to them trying to come out to jump again, once at 9:26am and one at 10:34am Please note that it was *** and not *** the complainant that I spoke to, so I'm not sure how she would know what was actually said between *** and I Both times I spoke with him the cloud ceiling was at 1000-2000ft which is well below our legal FAA limitations and I informed his as such He asked what the likelihood of jumping for 5/looked like and based on the hourly forecasts that I use (Weatherbug, Accuweather, USAirnet, and Windalert) I told him that the chances of us jumping were slim to none They were more than welcome to drive out and wait with us, but a 2000ft overcast or broken ceiling is not legal nor safe to jump in Our confirmation email which was sent to BOTH *** and *** clearly states that we are not weather experts and in the event of a weather situation we do not give refunds It is also posted throughout the hangar In addition to this all of our phone conversations are recorded and I'll be more than happy to provide them to you should you want to hear them Never was *** (not even *** who is the complainant) told that it was "too cold" to jump; rather he was informed of what the forecast and current cloud ceiling was at I also have the phone conversation where I told him that we typically require a $non refundable deposit but because they were driving from so close I would just wait and take the money the next day While I wish I were a weather expert, I am not, and with a sport like skydiving that is so weather dependent, we do our best to first and foremost be safe I do not have any magical weather app I have access to the same radars and satellites that every customer has, and if it is a questionable day, we do inform students of that as I did the morning they tried to come out the second time The wind forecast on the day of their original booking 5/was not supposed to be over our limits; if it had been, they would have been informed Please feel free to contact me with any other questions or clarifications you might have regarding this matter, or if you'd like a recording of any of the phone conversations I've included a copy of the confirmation email that every student receives; you can clearly see where it states there are no refunds under "What if there is bad weather" Thank you,*** ***###-###-####Upcoming Group Skydive at Great Lakes SkydivingIn total there are people in this group.Date of bookingDate: 2015-05-26Time: 00:00Duration: 2-hours (weekdays), 6+ hours (weekends)Invite more friends for better pricesInvite your friends to come skydive with you for even better pricesIt is secure and easyJust share the following link via email, Facebook or Twitter. I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  They actually did not offer any resolution - they are still keeping my payment despite having not provided me the service.  For your reference, details of the offer I reviewed appear below.
First off, my brother I am upset and feel violated that the company, without our knowledge or consent, recorded the voice conversations between us and them. That is an unacceptable violation of our privacy and is also probably not even legal. After reviewing the company’s reply to my initial complaint, I find it important to again emphasize the key, simple fact of the matter: I paid for a service, and that service was not rendered to me or my siblings. We asked for a refund and the company refused. This absurd situation would be comparable to a scenario in which someone paid for a meal at a restaurant while on vacation and the oven stopped working, but the company rather than return their money instead said they would keep it but that I could come back at a later date and dine via a printed voucher. The company's policy here is punitive and arbitrary and my siblings and I should accordingly be given our money back.The company's policy might be seen as more reasonable had we paid in advance or purchased a Groupon, etc., but the fact of the matter is that we were told to pay up-front, immediately, and then less than an hour later were turned away and not refunded. We only paid because we were led to believe we would be able to skydive, and the company offered no verbal indication we might be turned away and our money kept. The company representative dismissed our concerns about the wasted time, vacation days, and gas money. When my brother expressed his concerns that the management should have at least apprised us of the potential for a weather cancellation, the management representative condescendingly noted that he had a smart phone and should have been capable of looking that up himself—as if he was supposed to possess the sort of expert knowledge of which wind patterns dictate the cancellation of a flight. By accepting our money and putting us through the training demo, the company led us to believe we would be served that day. We accept that we could not be served due to weather, but all we ask is a refund for our money.Additionally, it is important to add the following: the company representative misrepresents the truth in her explanation of why my group was sent up second. A group of two customers was in line prior to our arrival; a third customer showed up late after us yet was still allowed to jump before us. Also, [redacted] certainly did not "demand" a free video; in fact, he simply suggested that perhaps a free video would be a gesture of good faith given that we sacrificed time and money to make the trip all the way south to Beloit. These individually are certainly minor issues which is not at the heart of the issue--their ridiculous refusal to refund our money--but I feel it is a telling indication that the company here is conveying a very biased version of the facts in an attempt to justify their cheating us out of our refunds. The company representative attempted to save face by saying “In an industry where you get paid by the jump, believe me, no one wants to jump more than we do.” That is a remarkable statement to make given that they apparently still get paid even if they decide to cancel a jump.This is a very simple issue. We paid for a service which was not rendered, pure and simple, and should be afforded the most reasonable right to a refund.
