Taqueria Jalisco

Review: At 1:37 pm on September 3, 2014, I ordered a Vegetarian Taco Salad and Chips and Salsa to go at Taqueria Jalisco for my daughter, [redacted]. I have ordered these two items numerous times. I handed the server a $10 bill as I have done in the past. She indicated the total was $11.38. I gave her the $10.00 and went to my car and retrieved the additional $1.38. I was shocked that he price went up but paid anyway. She gave me the attached receipt that did not include the dollar amount just the order and my call number.

While waiting for my order, I looked at the menu located to the right of the order window on the counter (see attached copy) which indicated the Vegetarian Taco Salad was $6.99 and the Chips and Salsa was $1.99 and after including 8.5% tax the total would have been $9.74. So my original $10 would have been sufficient. I asked her about the difference in price and she indicated that there is a disclaimer on the menu in small print at the bottom that indicates the price is subject to change without prior notice. Obviously the price changed but they didn't feel it was necessary to change the prices in the menu or let me know in advance. Did all the price change or only my Vegetarian Taco Salad and Chips and Salsa? Did I look like I could afford a few extra dollars to increase his income? A simple white removable Multi Use Avery Label 5/8" X 7/8" that comes in a package of 1000 would have saved the time and trouble of this complaint. To make matters even worse, the menu on their own website has different prices -- Vegetarian Taco Salad $5.99 (see attached).

The owner then got involved and wanted to know what the problem was all about. I tried to explain but he dismissed me and said he wasn't talking to me, he wanted to talk to his server. He did ask me if I wanted a detailed receipt and I said no I just wanted my food. I stood back and waited for my order to be called. My number (92) was called and the owner put my salad through the pick up window along with the bag of chips and salsa. I picked them up took a step back and indicated that they just lost a customer. At that point, he "physically grabbed" the salad and chips out of my hand after I paid for them and put them behind the window and would not give them back to me. I repeatedly asked for the food and he said no. He went to the cash register and put a $10 bill on the counter. He obviously thought $10.00 should have covered the cost of the salad and chips. I again asked for my food indicating I did not want the money I wanted to food. He said no and finally threw the salad in the trash. He then went to the cash register and got two one dollar bills and put it on top of the ten dollars. I told him I just wanted the food and he said no so I took the money and left.

The owner of this establishment was rude, inconsiderate and could have been charged with a crime of theft or battery since he grabbed the food out of my hands after I paid for it.Desired Settlement: At the very least, I would like an apology and assurance that the prices on the menu are what you are expected to pay not what the owner thinks you might be able to pay.

My daughter, [redacted], went and talked with the owner since she frequently eats at his establishment. he indicated to her that I was rude, that I complained to all his customers and I was either having a bad day, was under the influence or homeless. He then went on to say that the additional cost should mean nothing to me since I was driving a Lexus. What does the type of car I drive have to to do with anything.
