In our previous response to Mr. [redacted] we provided a copy of the signed contract as well as a copy of the options and upgrades document, nowhere in either of those documents does it state that a microwave is provided. Our standard appliances are a stove, dishwasher and hood vent, we offer our buyers the ability to upgrade the appliances to a stainless finish as well as the ability to upgrade the hood vent to a microwave hood vent, Mr. [redacted] declined both of those options as detailed in the contract documents. As stated in our previous response the lot Mr. [redacted] was interested in had been assigned a lot premium of $10,000, to facilitate the sale the lot premium was reduced to $7,500. Mr. [redacted] statement regarding a $10,000 charge for solar panels is false as solar panels were not an option offered in this development. Any credits offered by Tarina Homes, Inc to Mr. [redacted] are clearly stated in the closing statement which was attached to our previous response. Mr. [redacted] realtor, “Berta Sanches” who represented Mr. [redacted] in the sale had the responsibility to ensure that Mr. [redacted] read and understood the contract documents. We are not able to speak for Sherry Knapp, she does work for Tarina Homes, Inc. Our warranty does not include insects. Revdex.com's Translation I have to say that the personnel at Tarina Homes are not honest. The reason being is that I signed an electronic contract and was helped by Korina Gutierrez. It specified that the house came with a microwave, stove and dishwashing machine. There was a cost only if they were stainless steel. We told them that we didn’t want stainless steel that we wanted normal ones black or white and we chose a white microwave, white stove and white dishwashing machine because there wouldn’t be a cost. We had a white refrigerator so everything was going to be the same color. When we went to go see the house its price was $216 850 but they sent us to prequalify when we went in to prequalify Korina said that the solar was premium and its cost was $10,000 dollars more. I said no. They told me to wait and that they would speak with the owner and he said tell the buyer that we can discount $2000.00 and also give him credit for $2500.00 on the closing costs he can write a check for $5500.00, my wife and I did. They sent me the contract electronically to my cell but I did not know how to sign it. I called Berta Sanches to help me sign the contract and she sent me to Korina. Berta Sanches is who helped us buy the house, the real-estate agent.  Well, we went with Korina the seller at Tarina Homes opened the page and she told us where to sign or initial.  Once we signed I never saw the contract. Sometime after Korina called for us to go sing the papers. With Sherry Knapp the loan officer what happened was that my wife and I arrived, Korina Gutierrez had not sent the paperwork and we had to start everything all over again and everything went up like the house payment. We asked what happened and Cherry Knapp said that there had been a human error and I told her that that was costing me more on the monthly payments by $200 or $400 dollars more. I told her that I didn’t want the house anymore that there were so many issues. I asked for my money back that I did not want anything to do with them they said that if I did that that they would keep $5500.00 that I had paid in advanced. My wife and I decided to keep the house after so many problems with Korina Gutierrez, she was very rude, yelling at us, threatening with taking our money away when we came to see the house and inspect that there was nothing wrong with it. She rushed us , when we finally moved to live in the house, we noticed the granite in the kitchen was not the same there was 3 different styles and it looks really bad with the colors being different. My conclusion is that there was left over pieces from other houses and they put them in mine. The difference is so big. The difference is that I paid $224,000 for the house and it is not fair. Everyone who comes to my house notices the difference. They offered me a 1 year warranty for everything in the house and I just want them to honor what they promised. The house is full on insects, ants, mosquitoes… The front yard got flooded because they did not even out the terrain … The bathroom granite and the kitchen granite have to be the same and they are not. I have a one year warranty and all I’m trying to do is to use it. If the granite is not put in correctly it is only reasonable to change it under warranty. If there are ants and mosquitoes they have to fumigate to resolve the issue. They have to fix everything under warranty. They know that what am saying is the truth and they expect me to get tired of complaining but I’m not. I will not get tired of complaining until they give me what they promised. Thank you. Mr. [redacted] began the process of purchasing a home in the Barcelona tract in Wasco, California in October 2016, the lot he was interested in had been assigned a $10,000 lot premium, a cost added to the sales price for our most sought after lots. During the negotiation process it was decided, to...

facilitate the sale, that the lot premium would be reduced to $7,500. The $5,500 received from Mr. [redacted] was an earnest money deposit (EMD) not to cover the cost of any fixtures in the home, as documented on the attached NEW CONSTRUCTION RESIDENTIAL PURCHASE AGREEMENT. The “decorative stone” that Mr. [redacted] mentioned are the granite countertops that were installed the home. Granite is a natural stone product, natural products may vary in gauging, coloration, shading, markings and textures there is no way to guarantee a uniform finish Mr. [redacted] was made aware of this on several occasions. As of May 26, 2017 no issues with regards to paint have been brought to our attention. The fact is that Mr. [redacted] simply did not pay to have a microwave installed, Mr. [redacted] spoke to Mr. Chris Johnston who offered to install the microwave for the price of $500 which Mr. [redacted] declined, at this point in the conversation Mr. [redacted] threatened litigation which prompted Mr. Johnson to direct all Tarina Homes, Inc employees and subcontractors not to speak off the record with Mr. [redacted]. In the attached documents, it is abundantly clear that Mr. [redacted] has received the warranty information. As of May 26, 2017, he has submitted six (6) warranty claims through our Buildertrend online database all of which have been addressed and corrected.       Thanks,
