The artist service representative assigned to *** of *** is currently working with our production staff and the artist to fix any issues that have occurred with the printing of materials for this artistTate Music Group will replace
any incorrect or damaged product received by the artist
Regarding the artist's complaint of the breach of contract regarding the television advertisement, the contract allows for the artist to choose a replacement multimedia option of a social networking site (Myspace or Facebook) or a five-page website IF the television ad is unable to run in time to promote an event of the artist's choosingThe contract does not guarantee or allow for the artist to choose television stations, channels or networks for the advertisement to run onThe artist had been contacted by our Director of Marketing regarding the airing of the commercial and the additional advertising provided to the artist due to the lack of campaign reporting made available to Tate Music Group by Dish NetworkThe guaranteed advertising was doubled in the processTate Music Group has contractually upheld the contract in this issue
Tate Music Group will continue to send newsletters and special offers to all artists that are in contract with Tate Music GroupArtists are provided with two points of contact, the marketing consultant and the artist service representative, for communication and can be reached by phone or email
The retainer fee (artist investment fee) is only refundable upon the sale of 2,copies of the CD as stated in the contract
Initial Consumer Rebuttal /* (3000, 7, 2015/11/23) */
(The consumer indicated he/she DID NOT accept the response from the business.)
The sad part is I have been contacting Tate all this long time and no one responded to me until I contacted Revdex.com (Revdex.com)Customer service is very poorI did receive a response finally (after contacted Revdex.com); however, this is the response I received..."Hi ***
I have forwarded this to your project manager to have this check and fix asapWe'll process a replacement for you once it's done
We really do apologized about the error, this don't usually happen."
This still doesn't tell me an estimate of the turn around timeWe have gotten the short end of the stick timesThe 1st time (Error on Tate's behalf) I was about to sell some product at an event that we had just ordered from Tate to our customers but the disc jockey just happened to play one of the CDs and someone else's music was on the CDThis was sooo embarrassing! We thought we were about to hear our music on the CD but someone else's music was playing and this was at an event that we were contracted to sing atSo, I contacted them and told them what happened and they were supposed to be sending a replacement ASAP but that didn't happenNeedless to say, we sold no product due to this Tate errorError on Tate's behalf: We were out of town waiting for Tate to send a replacement order for the CDs that they just messed up but they never sent it to the hotel that we were at and I gave them all of the information needed to where they should send the CDsWe had absolutely NO PRODUCT because of a Tate mess up and lost lots of dollars that entire week because I had NO PRODUCT for my fansThe 3rd time (Error on Tate's behalf) they sent me a product with an error on itThe song didn't even finish playing before it was cut off and rushed into another song playing)This makes my group looks unprofessional and tacky because we are selling product of poor qualityWe pay good money for good products from TateHowever, that is not what we have been gettingTate has not compensated us for any of the money that we have lost due to their errorsAll we keep getting is apologies but apologies are not paying our bills or increasing our fundsWe are losing out of funds because of Tate but they act as if they can care less about our losses
Tate has produced absolutely no proof of running any types of ads on our behalfThe only reason they responded is because I told them that it was a breach of contract because we never got a chance to speak with the marketing director to talk about our commercialWhen I contacted them, they said that they had already run our ads on other sites which I haven't even heard of because they no longer had their contract with Dish NetworkSo I asked them when were they going to contact us to tell us that we were not going to be able to air our commercial on TV but no legit answer was givenHow do you deter from contract without contacting the Artist and having a conversation with them?
I see the response that they listed above saying that we have a marketing consultant and the artist service representativeMy question is what's the use of having these people if they do not respond to voicemails and emails?
With the poor quality and customer service that we have been getting, we should be compensated at least for the $2,that we paid for a service that we are not getting with qualityI thought at least having Tate for production would not be hard for them since they did not assist with the studio recording or photoshootWe chose to do that on our ownThey also are supposed to be assisting with finding gigs but I have never been contacted regarding that eitherThey said we had access to a PR but I have never been contacted about that eitherThe marketing director was supposed to be working with us regarding marketing strategies for our artistry; however, that has never happenedThere are so many things that was promised that we have not receivedIt's like they were so nice until the CD was producedOnce that was complete, they dropped the ball
I need to know if the barcode that's connected to our CDs are ours or is it strictly through TateI have emailed asking this question but I still haven't gotten a response about that and it's been weeks now
I have also asked if we can get the masters of our artwork and that is a simple question too but we still haven't received a response on that either
I remember that when I wasn't getting responses in the past to these CD error issues, I even emailed all the way to *** *** and still haven't received any responsesI would have thought that at least those who are in higher level management would have responded or made sure that I received a response in a timely fashion but that didn't happen
This is a nightmare!
Sincerely,
***
Final Business Response /* (4000, 9, 2015/12/04) */
The assigned Project Manager is working with the artist to make the corrections needed, just as ***'s Artist Service Rep mentioned in the email provided by the artistThere is not a turn-around time available until the proofs are corrected and approved by the artistShipping takes 2-weeks for CDs from the time the album has been corrected and approvedThere was no error with the first shipment of CDs to the artist, so we working to fix the printing error and ensure that the product is correct before shipping the productTate Music Group replaces all damaged or incorrect product that an artist receives
The issue with the TV Commercial reporting was explained to the artist as Dish Network no longer provided detailed reports per artist commercial that we could report back to the artist, this is not an issue of contract between Tate Music Group and Dish NetworkThere is no breach of contract regarding advertising as the advertising was created and performedWhile we report everything we can to the artist regarding advertising, it is not a contractual obligationTate Music Group scheduled the artist for additional advertising to double the advertising that was guaranteed in the contract, as well as the recent scheduling of mobile app advertising purchased by the artist and compensated by Tate Music Group
The retainer fee of $is for marketing and distribution for the life of the albumThis fee is non-refundable until the artist has made a minimum number of sales as stipulated in the contractOur contract allows artists to use local studios for their recording at the expense of the artist, this does not change the retainer fee for marketing and distribution as Tate Music Group agrees to cover all recording expenses for our artists with the use of Tate Music Group studiosIt is not a requirement for artists to use this serviceThe artist still has access to the photo shoot in their contract, if they choose to schedule it with Tate Music Group
The artist has been provided with marketing reports of where our publicist contacted media outlets with a press release during their release week, where our booking staff has made venue contacts for CD Signing events, and where our promoter has made radio contacts on behalf of the artistThese can be resent to the artistIf the artist wishes for their team to make additional contacts and assist them further, requests can be sent to the artist service representative or the marketing consultantMarketing Tips, Ideas and Strategies are provided to artists through a marketing blog, as well as monthly newsletters and special offersArtists with specific questions can direct them to their consultant for additional helpThere has not been an event posted by the artist for Tate Music Group to promote or contact media outlets for publicity since June 22, There is not a marketing director assigned to the artist
Barcodes specific to the distributor, which in this case is Tate Music Group as the UPC is assigned by Tate Music Group for manufacturing and distributionThis question should be directed to the artist's marketing teamThe artist provided their music to Tate Music Group for production, thus the artist already owns and has the masters to their project

Artist signed contract in 08/Artist signed written approval of final proof of album on June 23, and did not request
changes to be made to music or packagingArtist ordered CDs, Business Cards, Posters on June 25, TMG also ordered at no cost to the artist, for free promotional use: CDs, posters, & Push CardsArtist never reported damaged product to Tate Music GroupTate Music Group replaces all damaged product that our artists receive, when it is reported
Artist had even mentioned the quality of his product in a followup email to Tate Music Group on October 22, 2009:
(Oct 12:pm)***,
Thanks for your time this morningI have been impressed with my dealings at Tate from the startI feel like I have received a great deal of recognition and a worthy final product for the little investment I made! Yes, I have been somewhat frustrated this month, after telling people where they can find my album, and it not show upTo top it off, there are a few very negative blogs online about Tate that pop up in a searchI have not had those bad experiences with TMG, so I can only assume they were created out of jealousy or spiteBut the CDBaby fallout had thrown me for a loop in my confidenceI believe it will be resolved soon, and don't hold Tate responsible for the min any way! Take care, and thanks again***
The artist provided the information we included on the business cards in this email sent on June 29, 2009:
The important information for my business card includes: phone (XXX)-XXX-XXXX , web address www.myspace.com/gabXXXroseband , and any titles you find appropriate - such as singer/guitarist/songwriterAny other standard official Tate info is welcome! If it is necessary to include an e-mail address, I currently use ***@msn.com Thanks, ***
The artist has been contacted regularly by Tate Music Group over the years with updates on his project and tips on how to create better salesTate Music Group does not promise sales not does our contract reflect any such promiseTate Music Group has remained in contacts contract with this artist and has fulfilled all contractual obligationsThe contract signed by this artist states in section I, item 1: "Tate Music Group will do the following for the Artist: Provide their resources to produce, market, and distribute the WorkSuch investment in resources, cash, or services shall be ESTIMATED at the equivalent of $22, 540.00." Tate Music Group in no way promises this amount of money to an artist, nor is this entire amount allocated strictly for the marketing of the CD projectAs clearly defined above, this amount is an estimated amount of cash, resources, and services provided by TMG throughout the production, distribution, and marketing of a CD project
Initial Consumer Rebuttal /* (3000, 7, 2015/10/01) */
(The consumer indicated he/she DID NOT accept the response from the business.)
Tate Music Group completely failed to show any proof of spending any of the $22,funds promised in the contractInstead, they displayed one overly polite and optimistic email I sent from six years agoThis was in order to stay on good terms with the company that might still help market my product, as promisedTotal deception has been discovered, starting from the very first message I received from themIt stated that my music was exceptional and chosen to succeed, only one in submissions being given a contract opportunityIf you were to go on their home page, you would quickly see how many hundreds of artists are now part of the elite chosenI strongly suspect that every submission is given this same fraudulent offer and promise of $22,to help with successThey did not mention the bounced check issue, which I have digital copies of, nor why amounts of $or $has been common for a yearly "royalty" amountI know friends and family who have bought the entire album on iTunes, but I've never seen this moneyIf I am at fault in any way, it is because I have wIted so long to pursue any compensation for all of these wrong doings! I was enticed by this original offer by Tate claiming to be a devout Christian corporation that upheld its integrity for each artistThis appealed to my religious upbringing, as I am certain it did for many others, and set me at ease of any possible legal misdealingHowever, from the beginning, with the poor preliminary audio drafts of my work, I was constantly told that everything will be crystal clear and professional once mastered correctlyLittle ever changed on the recordingsI had to fight hard to get it as good as it isI once asked if a guitar track could be replaced by me, since most electric guitars, all bass, and all drums and piano were done without meI was told that everything recorded could not be replaced, due to time restraintsHowever, I was scheduled three days of recording time, of which I only used twoI kept asking if there were any touch ups I could do the third day, only to be told, "no, everything is perfect, and the mastered mixes will show me." They did not! At that point, I could only wait and see how they turned out, having already made the $1,investment, and having paid the air fair, hotel, rental car, etcwhen the tracks came back, they sounded like a home demo, although the sound tech assured me all mixes were done to ensure much radio airplay timeAnother issue, in all the marketing promises, I recall radio AirPlay being a major part of it allThe only AirPlay I am aware of of "Reinvention" is social media sites that I have contactedBut again, the product has to sound professional in order to be considered for radioAnd the damaged product issue? They probably used the cheapest equipment possible to mass produce my CDs that I paid for, not themThey arrived at my house in many different boxesThe several smaller boxes were opened first, intendedlyThese had the fewest flaws on the side sleeveI was okay with a few flaws in such a low percentage (maybe %)However, as time went on, the larger boxes were opened with closer to half the CDs sleeves being bent and looking badThere are honestly very few sleeves that are straight, like you would see CDs at a music store beingAt this point, I knew I had been taken completely by a marketing scam, and just did the best I could to sell these sub par CDs locallyI have, over the course of the last six years, developed more assertiveness and courage to stand up for myselfSo what is this disputed coming down to, that I waited too long to complain? Otherwise Tate would make right on the contract promise if $22,support and also replace any damaged product? The "main" conflict and issue is that Tate has no way to prove this spending! If you at Revdex.com were to observe the product (CD and business cards), you would know that it was all produced by my initial $1,985.00, and probably cheaper than that! No, I am in no way satisfied with Tate's reply, and feel they should be held accountable for these scams! I would it this point demand even more compensation, as a result of these vague replies by Tate, in an attempt to cover up the truth! Maybe the Revdex.com should be the judgeor the public media?!
Final Business Response /* (4000, 9, 2015/10/15) */
TMG is not contractually obligated to show how these funds were allocated as the contract clearly states that this is an estimated cost of funds, RESOURCES, and SERVICES provided by TMG for TMG's exclusive use in the production, marketing and distribution of the projectFurthermore, Section IV, Item of the contract signed by the artist states, "TMG has the right to determine, without cause, the use and expenditure of the Artist participation investment and is not required to show cause or record as to the expenditure of those funds." TMG has been in business for nearly a decade and in that time our business has grown exponentiallyIt is naïve of any artist to assume that a business would not grow since their coming on board in to the current end of This artist was given a written copy of the contract and was not mislead as to their decision to sign the contract and move forward with the project on their own volitionFurthermore, TMG is more than willing to provide sales records as reported by our distributor to the Revdex.com or the artist directly if there is any questions about sales that have not been reported or royalties unpaidIf there is a check for royalties that needs to be reissued, we encourage the artist to contact our accounting department directly and a check will be reissued immediately
The album in question was released in AFTER the artist signed an approval form for the final mixes of the music as well as a separate approval for the photos, packaging, and artworkIf the artist was unhappy with the audio quality at that time, it should have been addressed six years ago at the time of album releaseFinally, if the artist did in fact receive damaged product at the time of their order in 2009, they were welcome at that time to return any damaged product and TMG would have happily resent undamaged merchandise in returnHowever, it is impossible at this time for TMG to even verify that claim as again that order was shipped six years agoTMG remains willing and able to continue work with this artistWe are happy to explain the marketing process again and work with the artist to increase exposure on their project and sales of their albumIn regards to allegation about the "cheapness" of our product and services, the volume of artists we currently work with would directly refute these allegationsClearly we have grown as a company because of our outstanding service and product

I received the refund today, thank you very much. I wasn't expecting to get the CD as well, but thank you for that also. Perhaps if you fix your customer inquiry system so that someone actually reads the inquiries and responds to the customers, no refunds would ever be needed. Thank you again. I wish you success.

We are working on scheduling Ms. [redacted]'s project and have been communicating with her regularly regarding the process, including collecting her selection of beats for her music as well as her lyrics and song information. We have contacted her 9...

times since June 4 and we are active on the project. In the most recent exchange (pasted below) Ms. [redacted] sent in her beat choices and our representative [redacted] requested lyrics. We are here and happy to communicate.
Here are the beats I've found interest in [redacted] I'm sending the links because I didn't see a name listed for each specific beats. Thanks for your patience. Also when the songs are completed and published I would like my stage name [redacted] listed since I have already built a fan base with that name the past few years. I will be sending the rest of my previous songs Tuesday morning so that the Sound Engineers and Producers can get a feel for my vocal abilities and style in music. Look forward to working with you all. Thank You [redacted] Jade

Hi [redacted] Good Day! I hope all is well. I would like to request on the lyrics on all tracks for these beats that you have submitted. Hope to hear from you soon. Thanks!

The Project manager has notified me of specifics this time stating that she need the lyrics for the 8 tracks that I have selected through their beat bank so now it makes complete sense just wish it was thorough from the beginning to avoid all of the inconveniences. I will continue to pursue the album with Tmg and hopefully produce an amazing one.
