The business owner has taken pictures of my property and is using it in a listing of a neighboring house. The business owner never asked permission to take a photo of my home and is falsely advertising her services or home renovation with my own home. She is using my work/home/property/image to sell a property she has ownership in. She is using my renovation work and masquerading it as her own. *** is falsely advertising the property listing and confusing buyers. I want nothing to do with the sale or profit of the sale of the home. I want my home transformation story removed off the property listing immediately. The business owner has nothing to do with my property and I'd like to keep it that way. The business owner plans to profit from my home renovation transformation story. If she makes money from my designs I am entitled to some of the profit of the sale. I do not want or asked to be involved in any way shape or form. The business owner claims to be a friend. She also claims to be a renovation specialist. She is using my work in her listing and is claiming to be her own. We are only neighbors. I've asked that the images of my home be taken off the listing. She is selling a poor quality product and is using my high quality product to her advantage. She knows better and can do better. She is committing fraud. I live at 1
Modification/discontinuance of Payment of $100 a day until the images of my home are removed from the listing site.
Mr. seems to enjoy complaining about everyone on his street. However, I was merely a friendly former neighbor who moved yet stayed friendly with other neighbors.
The home for sale and all advertising of such home takes no ownership of Mr. renovation work. Merely shows what others in the neighborhood have done with similar style homes. Images we used are public domain. Mr. would need to take his complaint up with the Wake county government tax records or with *** maps street view, as these images are available on those websites for public viewing as well.
Pictures of a home from the public street are not owned by the homeowner. Anyone can take a picture of a property's exterior from public street.
My firm would expect that Mr. should take it as a compliment to his work, that this is an example of growth in the neighborhood. He would benefit when the home for sale is sold and fixed up and the neighborhood continues to improve.
The home for sale by my firm is accurately and clearly represented.
The agent is illustrating what *** has done with his home. The agent did not ask permission to share his renovation story for another property's listing. There is no need for this agent to post his story publicly for a property listing that is not his own that he will not receive any proceeds from. Educated buyers will do research themselves if they are interested in public records. The "after" image is not available on *** Maps. I am simply asking that my story be excluded from her property listing.
No further action needed from myself or my firm. Images of homes from public street are that public. No story or credit of any kind about Mr. home are provided to anyone simply images of a before and after, as the home style if similar to the one for sale. Both the broker in charge of my agency and the NC real estate commission have reviewed Mr. complaint and deemed it unfounded. Images for the listing are accurate and within the law and rules of NC.
Mr. has been informed that he has no legal standing and that if he continues to interfere with potential buyers he will be held liable for tortious interference.
