I am familiar with this situation I advised my Director to contact the previous student back to let her know that we will not be releasing her hours This student dropped out of our school back in At that point she owed us a big balance to pay for her education she received In our contract we state that we do not release "hours" earned by the student until they have been paid for If a student declares bankruptcy we will not pursue them for the balance owed at that point However if the student comes back and tried to collect on the service (education) provided by us we will not release anything After years of business we have never released hours to someone who has declared bankruptcyWe are happy to write up a NON-OFFICIAL transcript dating her time in school but we will not release her hours that she never paid for Her request is completely unacceptable You would never get a car loan and put it in a bankruptcy and expect to get to keep the car for free It doesn't work like that See the verbage below that we have on student loans and bankruptcy FYI: The legal finding on Bankruptcy and Student Loans:In 2005, Congress passed the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005, which made it so that no student loan — federal or private — could be discharged in bankruptcy unless the borrower can prove repaying the loan would cause “undue hardship,” a condition that is incredibly difficult to demonstrate unless the person has a severe disabilityThat essentially lumps student loan debt in with child support and criminal fines — other types of debt that can’t be dischargedBasically, the only option with private loans is to repay them — and to repay them on the lender’s timetableThey do not allow deferment or income-based repayment.Please let me know if you have any questions regarding this or need something further from me

I am rejecting this response because: the school have made no attempts to resolve the complaintThey are being argumentative, 47:and threateningMost importantly they are not complying with the law, whatever policy the school is trying to quote; it is illegalI have provided all the legal information regarding this caseAgain, You are currently in violation of USC 524(a)(2) - which states "the college may not withhold official academic transcripts." Whatever threats the school is trying to make regarding a lawyer contact is not going to affect my standings, as I have familiarized myself with the lawI will not be intimated I have another cosmetology school that was listed in my bankruptcy, who simply and quickly sent me my hours, as they are complying with the lawThe school listed in this complaint, Taylor Andrews, is not in complianceBy making comparisons to a vehicle, it is very obvious that this school does not understand the bankruptcy law and the way that applies to education.

 In our contract we state that we do not release "hours" earned by the student until they have been paid for.  If a student declares bankruptcy we will not pursue them for the balance owed at that point.  However if the student comes back and tried to collect on the service (education) provided by us we will not release anything.  After 13 years of business we have never released hours to someone who has declared bankruptcy. As stated before we will not be releasing any official verification of hours that the student is requesting.  If she would like a statement from the school with the dates she attended she is welcome to request in to the school in writing.  But again we will not release any hours because they have not been paid for.  We are accredited through NACCAS and the Department of Education.  We have a very strict withdrawal and refund policy that has to be administered equally to all of our students.  Regardless of the bankruptcy we don't get to forgive someone of their debt owed by releasing hours that were never paid for.  Our collections agency was notified on 6/3/2010 that this student put her student loan into bankruptcy.  As of that date the collection agency closed her account and Taylor Andrews has not pursued to collect the debt.  That is where we stand.  We aren't going after her for the money but we will not release what was never paid for.  Again if you buy a car and put the loan in the bankruptcy you don't get to keep the car.  They will close your loan for you but if you don't get to keep what was never paid for.  I will state again we are not going after this student for her money.  We understand he was a part of her bankruptcy.  Per our contract we do not have to release her hours that were never paid for.  If any further action needs to be taken we will be handling it through our lawyer.  The school stands firm on this policy.
