Took my 2012 BMW X6 in for replacement of gaskets. Prior to taking my car to Taylor's I had no engine issues, now being told I have engine knocking
On or around the week of June 12 2018 I brought my vehicle to Taylor's to have a oil leak fixed. A few days later I received call from Christina who is the shop manager, she said I needed to replace the upper oil pan gasket and the valve cover gaskets. I said ok let me know when she will be ready. A couple of days later Christina called and said it's a large job, she's never asked me before because she trust me but she needs 50% of the bill upfront. She said the total bill is $3340 for all the work. Said that the shop isn't doing so well, the owner is an *** etc. I laughed and I obliged to pay half the bill upfront. That was on the 28th of June. On the 8th of August I reach out via text after calling the office numerous times we have a discussion. Christina says we got the car put back together and the technician took it for a test drive and heard some rattling and engine knocking. I said my vehicle never had an engine problem. She said it happend on our watch I will fix it she send me a text stating that the believe that it was the turbos, that they will absorb the costs of replacing both in terms of labor and the cost of 1 turbo she will charge me for the part only ($546) to replace the second turbo, I agreed. Nonetheless turbos were replaced still no vehicle and a knocking engine. On the 17th I have a discussion with Christina and Taylor's about outsourcing at their cost to bmw to diagnose and repair. On the 20th I get a call from Keith T and he complained about the concessions that were made that he couldn't afford to be in the hole in the job etc, they refused to send it unless I paid them for work that was done to the vehicle. I said absolutely not you want me to pay for a vehicle that cannot be driven a vehicle that you have now made mechanically unsafe. Give me the info for you insurance company and we can settle it, they refused. So I filed a complaint with the department of justice. One the 20th after 2 months I finally get a repair bill almost 2x higher then what Christina mentioned. The bill was for $7000. I met with deputy *** of the Iredell county sheriffs department at Taylor's shop to retrieve my vehicle. Kieth T then told the sheriff that the balance of the bill was $3020 +/- . So seems that Kieth feels that it's ok to lie to a sheriffs deputy. Kieth will lie and attempt to say that it was a maintenance issue or the engine has numerous recalls for this issue. The fact is I didn't have this issue until you mechanic / technician took the engine apart , put it back together drove the vehicle. Wether is a timing chain that is lose or a bent rod or bad bearings the vehicle is now unsafe to drive

Desired Outcome

I want to be refunded what was paid and for Taylor's to outsource and have my vehicle fixed by the local BMW dealership at Taylor's expense. This should be covered under their general liability insurance

To Whom it May Concern,

Mr. states that prior to bringing his vehicle in for repairs the engine did not have any issues. This is clearly a false statement as the upper and lower oil pan gaskets and both left and right valve cover gaskets were leaking engine oil. Mr. called prior to bringing his vehicle in requesting an estimate for the above said issues. Mr. was aware of the issues before bringing the vehicle in for repair. We looked at the vehicle and simply verified that in fact the above said gaskets were in fact leaking. Christina called and advised Mr. that he was correct and in fact those gaskets were the source of concern. He agreed to have them replaced per the estimate he was given over the telephone prior to dropping vehicle off and after we verified the leaks. Christina advised customer that our policy on large repairs is to put down a 50% deposit down. He agreed and paid with a credit card over the telephone. My shop policy is that any repair exceeding $1000.00 requires a 50% deposit. Mr. dropped his vehicle off june19, 2018 not on the 12th of June. Mr. states that upon first test drive vehicle started rattling and knocking, it was not until the 3rd test drive that noises began. Being that this repair is over 30 labor hours our policy is to drive the vehicle at least that many times to verify repair. Christina advised customer of concern and let him know we would perform diagnostics to determine sources of noise. During diagnostics found left side turbo waste gate bracket worn and rattling and right side worn also. Christina advised customer of findings and in good faith offered to absorb the labor cost to replace both turbo chargers and she would absorb the cost of one turbo charger and Mr. agreed to pay for the other turbo charger. We replaced the turbo chargers and the tapping noise is gone, the knocking sound remains. We researched the concern further and found that BMW has a number of recalls present on the N63 engine. We also spoke with a BMW representative only to find out that they are in the process of issuing more recalls due to excessive oil consumption along with a multitude of other issues. It's very unfortunate for the owners of these vehicles however it appears that BMW is trying to correct the issues and make things right for their customers. We were in no way dishonest, we rechecked and verified that all the work we performed was done correctly. I spoke with Mr. and explained to him that we would be willing to bring the vehicle to the BMW dealership for him however we must be paid for the work we performed before the vehicle can leave our property. I also explained that if it was determined that we were at fault we would then take responsibility. He declined my offer. At that time he asked for a copy of the repairs made to the vehicle. I emailed him a complete itemized bill including the items Christina absorbed cost on so he could see exactly what was done.

Mr. then arrived at my facility that afternoon demanding that Christina give him his vehicle at no charge to him. Christina felt threatened and contacted the police dept for litigation. I arrived shortly after and advised the Patrol Deputy of the situation and that Mr. has threatened my employees demanding that they give him his vehicle without payment. He was in my waiting room yelling so fiercely that Christina's 12 year old daughter was so frightened she texted her father to come and protect her mother. The Police Deputy advised Mr. that he was not allowed back onto the property unless it was to pay his remaining balance and pick his vehicle up. Two days later Mr. returned onto my property in the morning demanding his personal effects out of his vehicle. Christina again contacted the Police Dept and they escorted her to retrieve his items. I did not lie to the Police officer as I only asked for what was originally owed after all the concessions was reinstated.

In conclusion we are more than willing to help this customer with BMW to resolve his concern as they are aware of the issues these engines are having. We cannot nor will we let the vehicle be removed from our property without being paid for the agreed amount that is due. As of this date $3050.00 plus $ 25.00 per day storage fees beginning August 24th which is 72 hours after notification of completion. At this time we have filed a Mechanic's Lien against said vehicle. It's unfortunate that the customer does not or is unwilling to admit that he is aware of the issues BMW is having with these engines. He admittedly has Class Action Lawsuit paperwork filed with BMW because of these concerns. We have requested maintenance records from Mr. so that we may present the case to BMW for him and he has not been able to produce any maintenance history on the vehicle.

Lie #1 Keith, I have never threatened Christina or any of your work staff, you have cameras check them. Secondly I am the one that called Deputy Hall ( I have the phone records to prove it ) to meet me at your shop in order to retrieve my vehicle. I got there before the officer arrived.

we had a conversation, about the untimely repairs and an explanation of what is actually going on with the vehicle. Christina yelled and screamed at me when I told her I will not sympathize with her after all the delays on the repair work. She said Joey at BMW said they are replacing the engines etc, I asked her get Joey on the phone , Christina refused. I've called left 2 voicemails for Joey never received a call back. I have called and spoke to BMW NA once again my vehicle had no knocking, no rattling. no performance issues. you have also admitted on this forum that upon the 3rd test drive, rattling and knocking occurred that wasn't there when the car was initially brought in.

Lie #2 you claim to have a policy that any work over $1000 that 50% needs to be paid upfront? that is a lie, I have proof that you have worked on my cars and never charged me upfront for anything.

LIE # 3... There is no open recall for the N63 engine. I have the lawsuit paperwork for the most recent issue which is excess oil consumption. there is nothing stating that BMW is replacing any Engines etc.

Fact... your technician took my vehicle apart to replace gaskets. Fact... upon putting the vehicle back together it has developed a knocking sound. so what went wrong, did he drop a tool, reassemble the engine incorrectly. something happened and we will eventually get to the bottom of it. I am not paying you for damaging my vehicle. I asked Christina at least times during numerous conversations for the repair estimate. Which I never received until 08/20/2018

Fact. the damage that makes the vehicle un-drivable / unsafe happened in your shop under your technicians hands. you should have a garage policy to cover these issues. I am still awaiting the correct bill, since you have also just admitted that the bill is $3050.00 and not $7,000. which is still not what Christina Mentioned. Once again Repair what you have broken.

Lie #4 if I paid $1670 on the 28th of June and that was 50% of the so-called bill then the outstanding balance would be 1670 leaving the total bill to be 3340. what you are saying is that your bill is not $4700 which is still different from the estimate you sent me. at some point you have to stop lying you are only deceiving yourself

In response to Mr. rebuttal he did in fact come to my place of business and demand that his vehicle be returned to him without agreeing to make a payment. I did review my video recording and clearly can see Mr. raising his hands and yelling enough that my service adviser had to back away from him. My service adviser felt threatened enough that she did in fact call the police department whether he called them first or not they were not on the property when Mr. arrived.

Since Mr. response his vehicle was towed to the *** dealership. He in fact did speak with *** the Service manager at our local *** dealership. Mr. advised Mr. that they performed diagnostics on the vehicle and thoroughly inspected the work performed at our shop and concluded that it was not in our error but a normal wear item on this particular engine. Also to be noted as before the bottom oil pan must be removed to remove and replace the upper oil pan gasket. Mr. was very aware of this. There is no extra charge for labor just the lower oil pan gasket itself as a part.

We do in fact have a shop policy that anything over $1000 requires a 50% deposit, that policy can only be waived by I myself as the owner.

There is in fact open recalls on the vehicle - Manufacturer Safety Recall *** Electric Auxiliary Water Pump For Turbo Charger that has not yet been completed. Also Recall *** Air Bags Passenger Side Frontal. So the vehicle does in fact have recalls that have not been addressed.

Mr. did not ask for a repair estimate in writing prior to August the 20th as he stated everything was done verbally. If in fact he requested a written estimate be sent to him I feel quite certain he would have done so prior to putting a deposit down on the repair. A deposit which he disputed with his credit card company on August the 29th, 2018.

As stated in the submitted messages Mr. did in fact agree to pay for a turbocharger which would obviously raise the cost of his total balance owed.

I did not raise Mr. bill in an attempt to make up for the concessions that my service adviser allotted him in and attempt to make up for his rental car costs. I explained to him how much money he had saved due to my service advisers good will.

As of September the 10th, 2018 Mr. has agreed to pay a total of $4000 Cash. His vehicle remains at the local *** dealership. Should anything change we will update accordingly. Also to be noted we now have another $200.00 in towing bills bringing the vehicle to the *** dealership for them to conclude that it was not our error.
