Each of the unit owner's pays $a month towards all the common expenses, including landscaping. The fees are set pursuant to the operative legal documents that were established by the original developer prior to the first unit being sold to an owner. There is an elected board of
directors comprised of homeowners that governs, directs and sets policy for the management and operation of the subdivisionHeywood Community Management is hired by the Board of Directors to oversee the day to day functions and administrative duties on behalf of the Board. The Board sets policy and directs and Heywood carries out the wishes of the board. Unfortunately, *** Condominiums has always been tight on money and, therefore, has replaced plants and trees over the years as funds allowLandscaping services are performed done weekly, typically each Monday Pursuant to the landscaping agreement with the landscaping vendor, some areas are blown only or x per month and some people think the entire property should be cleaned 100% weekly and that is not the contract the Board approvedThe Board approved to have the property cleaned in cycles and the entire property is worked there every 4-weeksThe grass is mowed on a weekly basisThe grass is currently green even though there are some burned patches that are the result of irrigation issues that are being addressed, which is common during our harsh Arizona summers. This past winter the HOA Board elected to forgo winter grass to save money on water and seed cost Essentially the issue boils down to this: The property is serviced weekly based on the approved contact from the Board and if homeowners would like to have the contracted increased to increase service level they can write a letter to their Board requesting the same and be prepared to increase the monthly fees to fund the services they would like to see increased

There is obviously some miscommunication in this situationAt the end of the day it is our responsibility to be clear on the cost with our clientsA $refund will be issued today with our thanks for bringing this to my attentionThis will be reviewed with all service advisors with the
aim to improve client communications
Byron R***, Owner

If the complainant has a pre-paid balance and wishes for the HOA to refund the pre-paid balance, they may submit a request for the same and Heywood office can processThe payment they submit should be adjusted to match what the monthly HOA fees are, unless they are not intentionally pre-payingThe trees and plants died after the warranty periodThe HOA did not have the budget at the time to replace right awayThe landscapers cannot replace without approval or direction as it would be an additional cost due to warranty expiring Every effort will be made to add additional funds into the budget for for plant material

Evidently we are paying more than any of the other condo owners, because we have been paying $185 for quite some time.  We aren’t asking for anything out of the ordinary…just that the grounds of the condo don’t look like neighborhood blight.  The Board of Directors can’t want that either.  The property values are much affected by how the grounds are kept or not kept. Money was spent, and wasted on a few shrubs and trees in 2014. Wasted because the plants were left to die.   One would think that the landscapers’ employees would have noticed that they weren’t getting water. We have emails of promises that plants were going to be planted and irrigation repaired. No follow through has happened.  Also, the email stated that the funds were there, so the lack of funds is not a valid excuse.  See below:     On Dec 7, 2015, at 9:45 AM, Marcus K[redacted] <marcus@[redacted]> wrote: > > It is a valid question and concern. The best answer I can give is the budget is very tight each year. There are funds now available for some re-planting and fixing that portion of the irrigation system. I agree the tree should have been removed and I know at one point they were waiting to see if it bounced back. At this time the tree is clearly dead and will not be coming back so needs to be removed. System fixed, then replaced. I've been told re-planting has to wait until mid February. >

This client has asserted that the check is lost. We will respond appropriately as we should. We will wait seven (7) days to allow that the check may be found, after which we will stop payment on the original check and deliver the net proceeds after expenses to the client. Fair is fair. We will...

always defer to our clients best interests.
