Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below [Provide details of why you are not satisfied with this resolution.] I will not spar with [redacted] and TbarThe work was not completed and weeks pass after work was startedI made phone calls to [redacted] and told him if he had issue coming out to call me and let me knowNo calls were ever made stating there were issue unless the calls were made by meOn April *** [redacted] called me at work time while I was in meetings wanting to speak to meOur contract was signed on Feb***and no work was started for week because [redacted] mother got sick and he had to leave out of town to take care of herNot until 3***/was any work startedWhen the work was started nobody let us know they were comingWe were woken with hammering on the sides of our houseBy the time we stepped outside the guttering around our garage had been removed and the fascia& trim had also been removedThis was not on our contract and I told the men working it needed to be put back and the said they did do that workI call [redacted] to inform him of the error and he said I'll be right over to talk to the workersI also told him about the gutters and he said I'll take care of thatMy wife and I left and [redacted] never showed up to talk to the workersThe gutter were put back up and more wood and trim and fascia was needed to be use to correct what the worker had already removed in errorThe next day (3***/14) [redacted] came by and got on top of the roof to replace the damaged shingle he had bought a pack of shingles for.( from the ground level it does not look like shingles were replaced.) [redacted] did not return to finish the shingle trim and paint the new wood and trim to the house again [redacted] can say what he wants the work was complete by my wife and I after our HOA sent us a letter stating it need to be completedIf I had not made the attempt to call [redacted] we would have never know he had had a stroke because he never attempted to call usEven after I explained to him communication was very important and if there were any issue he needed to call us he still did not call [redacted] *** stated that worth of painting was all that was left to do at my house then why does he want me to pay him and for product use due to his worker errorI never agreed to the extra work and it is not on my contractThe items added to my contract were added on 2***/and it was agreed to and covered on the original contractI am not a contractor, I am not a painter and I am very scared of heights but the painting had to be done and my wife who is only 4'8' got it done in 6hrs( only of work in hrs? that we needed additional fascia board on top of the original estimate due to the fact that the gutters where hiding some additional damageI told *** *** I would help him by charging him for the cost of materials alone and a minimum of labor for an additional $I should first point out that *** *** did not have all the funds to do the workBeing the "crook" I am, I offered to allow *** *** additional time to pay the $and the additional $in additional materials and labor for a total of $owedTo summarize there was a total of no more than $dollars worth of work to be completed and total owed of to TBAR is $When I returned from the hospital the first time *** *** stated that I should take my time and get betterTwo weeks later I called *** *** and he never returned any of my callsYesterday after receiving no response I drove to *** ***'s home RANG the door bellI never at anytime beat or kicked his doorThere was a neighbor directly across the street watching me at the front door so he too knows the truth about thatI also did not scream at *** *** as he claims and in my years owning TBAR I never have! I made very attempt to finish the job once my health allowed me to just as *** *** himself suggestedI tried to finish the job but after visiting the home yesterday I saw that the painting was accomplished I'm assuming by *** *** or by another painterWhat I did discuss with *** *** yesterday was a resolution on the balance versus the uncompleted paintingI offered to remove $from the balance of $owedIt was then that *** *** began telling me he and no intention on paying anything> I then made one final offer to go ahead and deduct the additional $material and labor just leaving a balance of $He refused to pay even thatHow much more fair could I have been? It was at that time informed him that in my years I have never had to file a lien for non-payment and did not want to nowI begged him to be fair but it is clear judging from this complaint that is full of flat out lies and inaccuraciesFurthermore I take the comment about me being a crook very seriouslyI did not steal from him or walk away from this jobIt is my belief he new exactly what he was going to do when I called from the hospitalIt is my firm belief that *** *** knew exactly what he was going to do when I called from the hospitalHe wanted a way to not pay what was owed and was willing to keep from paying what is rightfully owed to TBARI helped this man where no one else wouldMy price was very low and no matched that according to himIn addition I further helped him out by allowing a payment plan because he said he would not be able to pay the full balance on completionI did not complete the work because *** *** purposely finished the little bit of painting that was left while telling me to get better and call when I'm okayNot one time did he call or talk to me again after that and when I was able physically to finish he avoided me calls the plague
This man is less than honest and I will go far as to say he is the crook here! He owes money and refuses to pay even though I was more than fair, once again, by removing the cost of the paint touch up work and then some

I have records proving I called the day I got out of the hospital and had a conversation lasting for minutesThat catches him in a lie right there I can prove at least more lies he is telling from phone records, witnesses and paperworkI will be speaking to counsel about *** *** statement about being a crook to see if it qualifies for slanderlibel and defamationThat is a very serious allegation with no merit that could seriously harm my family and business This is a civil dispute and nothing moreHe has no right to call me a criminalWho tries to harm a man's reputation be calling him a criminal with no proof and real proof to the contrary? Anyone home service provider bewareHe will bait and switch you making you think he is a really nice guy (too nice), telling you to get better in your time of serious illness, stating "it's just touch up painting do worry about itGet well and call when your better" He took that opportunity to finish the work himself so he could make this claim and get out of paying meThat is the truth and I can prove it

[redacted] stated that 100.00 worth of painting was all that was left to do at my house then why does he want me to pay him 200.00 and 160.00 for product use due to his worker error. I am not a contractor, I am not a painter and I am very scared of heights but the painting had to be done and my wife who is only 4'8' got it done in 6hrs. ( only 100.00 of work in 6 hrs?
