This is in reference to the complaint that was filed on 4/4/2014 by [redacted].
Ms. [redacted] made a purchase for a pair of shoes on March 18, 2014.  The sales representative who assisted her states she tried on several styles of shoes and was made aware of the fit of each shoe.  The Grey’s Anatomy Softwalk shoe being a memory foam insole is correct. However, she tried on a Dansko as well which will conform to your feet after wearing.  I believe she is getting the two styles mixed up as their performance. 
In reply to the display being sold to her, this not the case.  We had two pair of her size shoes at the time of her purchase. We display our smaller sizes.  We would not have snuck as stated by Ms. [redacted] the display in the box. 
I would also like to address the purchasing from TC’s Uniforms due to her attending the ADN program with Hinds Community College is not a requirement for anything other than the uniforms/tops & jackets required by Hinds as we contract at a set price and supply them with the needed colors/logos for the different programs. 
Ms. [redacted] contacted TC’s Uniforms via phone on March 28th and spoke with several sales representatives prior to speaking with me ([redacted]).  I did explain to her that if the shoes show any signs of being worn I would not be able to take them back…immediately after her phone call I called the vendor to inquire if there had been issues with the shoes, it was stated that this shoe has been a great seller and no problems at all has been reported.  They also do not except returns unless there appear to be a manufacture defect with the shoes. 
The following week after speaking with Ms. [redacted] on the phone she did bring the shoes back, at that time I explained to Ms. [redacted] we could not take back as the shoes had been worn considerably, they were dirty on top and bottom and also had an odor.  She stated where she came from if the customer was not happy with a product they could be returned.  I explained to her that we could not allow people to purchase on a trial bases that returning worn garments or shoes to resale is not how we do business.  If she had taken the shoes home and worn inside on carpet and decided that the shoes would not work for her perhaps we could have made an exchange, but these shoes had definitely shown signs of wear and tear and could not been returned for resale.   
All sale receipts for TC’s Uniforms read “No Refunds given, Exchange only within 14 days (worn, washed or clearance items cannot be returned at all)
Ms. [redacted]’s desired settlement to return the shoes for exchange or to receive her money back as stated above, goes against our company policy.

We are coming up on our 25th year anniversary, with many years of business experience we find it necessary to put in place and to follow store policies and procedures.
We are honest people and take pride in our business.  Customer service is very important to us that is why we ask Ms. [redacted] to bring in the shoes even though she stated she had been wearing them.  We make it a point to see any items before making a judgment call.  But, clearly after seeing the shoes we knew the wearing of the shoes had been for more than a few hours and outside of a carpet area and no manufacture defect. If at any way possible we could have exchanged the shoes we would have, however because of our many years of experience we find it to be only fair to all our customers to follow our company policies.
We really hate that Ms. [redacted] feels the way she does regarding our decision, but again due to the wearing shown on the shoes we are not able to exchange for another pair or refund her money back.

I am rejecting this response because:
Just about everything Ms. [redacted] has stated isn't the truth. I tried on several different pairs of shoes because I needed a half size. My mother was present at the time of the purchase. The sales rep consistently told the both of us how much of a better shoe the Grey's Anatomy was compared to Dansko. When I tried on the Grey's Anatomy, it was the display shoe that I tried on. When I went to the store to have Ms. [redacted] look at the shoe she never stated anything about an odor, how can there be an odor in a shoe that was only worn three times? Again, as I stated, I will not purchase anything from them. They have showed me what kind of people they are. Not only do their sales reps lie to get a sale, but the manager lies to cover up why she denied a return. She's absolutely right, I'm my required to buy anything other than my uniforms from their place of business, but who would complain about getting extra business especially when you know that your products are overpriced? You should be grateful. But they have lost my business and I'm the the only one who refuses to shop with them again.

I am rejecting this response because:
 It's easy to stay in business for 25 years when you're the only uniform store in a small town such as Jackson, MS. I never challenged the fact that I had worn the shoes. I stated to [redacted] on the phone, as well as in my complaint that the shoes were worn for the three days that the sales rep told me it would take to conform to my feet for a more relaxing fit. Three days of clinicals and I'm in clinicals from 7am til 1pm. It doesn't matter when I would've brought the shoes back because she would have still said they had signs of wear when I explained to her that I was sold the display shoe. She said "we do sell our display shoes here", but when she responded to this complaint she has an excuse that they only have smaller shoes on display. But never disputed it inside the store. TC's has cameras available and I'm pretty sure the cameras will show exactly what I'm talkn about. Either way, I will not purchase ANYTHING else from TC's other than my required uniforms and hopefully I purchased enough to last me my remaining time in nursing school.

We feel this situation can not be resoved to Ms. [redacted]'s satisfaction, because it goes against our company policy to refund or exchange on any items that have been worn, which this policy was implemented over 24 years ago.
