This vehicle was sold without any warranty All of the vehicle's defects were disclosed ahead of time including cosmetic defects We sold this vehicle for a fair market price based on condition and miles Client had told us about the engine under shield and we shipped one to him The vehicle was nice and it drove well If the client does not want the vehicle anymore he can contact us about trading it in or selling it back Sincerely, TDI Motors

Complaint: ***I am rejecting this response because:
This business has responded to a customer complaining about their product with a threat to sue them for slanderIt does not surprise from what I know of this companyThey obviously do not care what happens to a customer's car after it leaves their lotAs for the dealer inspection, it was the dealer the company suggested and I place little faith in their examination as they missed the misalignment, tire wear (they said the tires looked great), and front suspension issuesI really doubt they even took it for a test driveAs for the timing belt breaking, timing belts do not break due to flukesThey break due to not being replaced when they should or being improperly installedTDI motors never told us the timing belt had been replaced or offered documentation for that
I would also like to point out that TDI motors continues to sell many EPA recalled TDI modelsWhile not illegal, I believe this is highly unethical

To whom it may concern,
We have sent copies of all records including timing chain replacement to the [redacted]. We did not have the receipt for transmission replacement but we did confirm that the job was done with Ed's Transmission in Seattle and we gave that info and his phone # to the...

[redacted].  Unfortunately, warranties are not transferrable when someone buys a car from the old owner to the new owner. We offered to inspect the vehicle and diagnose the issue, but the client refused. It was very difficult to have a logical discussion with the client as they were very emotional and confrontational. We were accused of lying about the work that had been done. We never heard anything more from the customer after we sent the records so hopefully everything is fine. We would be happy to help the customer with wholesale repairs if needed.

Complaint: ***I am rejecting this response because: TDI Motors (dba Beater Busters Auto Broker, LLC) claims that they disclosed all issues with the car and that it was sold at fair market value. They also seem to believe that an "As-Is" document relieves them of the obligation to sell a car in merchantable condition. A car that has no emergency brake is not merchantable because it is unsafe to drive. They claim that they disclosed all "cosmetic" issues with body paint, saying that there were "a few feather scratches on the hood." Unfortunately, the damage is far greater than that -- there are deep scratches from the front to the back of the car. These were identified by the car transport driver at the time he picked up the car in Bellevue. They claim that they provided a replacement for the missing undershield. They sent a used item without all the parts for installation.  So far, we've paid $1000.00 to replace the handbrake (which was completely corroded and non-operational) and the undershield.
We were operating on the basis of trust in TDI because we had purchased a 2005 Passat (the same one we traded in for the 2011 Jetta). It didn't occur to us that they vastly understate the body damage, much less fail to mention that the handbrake was broken and that the undercarriage was seriously corroded. The damage from road salt (the car came from upstate New York) is very serious. In other words, we took TDI at their word that the car was in excellent condition and safe to drive. We signed the "As-Is" document based on their representations to us. Misleading a buyer and then saying that the "As-Is" document gets them off the hook is a remarkable position to take. In addition, the extended warranty provided by TDI voids the "As-Is" document according to Washington state law.

At minimum, TDI must reimburse us for the costs incurred in correcting the serious problems we've had with the car. We'll be happy to work with them to make it happen. I'm sure they'd like to avoid damaging their reputation with current and possible future customers.

Sincerely,

This is a vehicle that was purchased over 2 years ago.  Any photos of this vehicle would have been archived and deleted by now, if there were ever photos taken.

The vehicle that was purchased was a 2002 VW Golf GLS TDI.  The GLS model in 2002 did not come...

standard with sunroofs or alloy wheels.  Newer GLS models did.  Maybe that was where the confusion was.

I double checked the mileage reading on the buyers order and compared it to the Carfax mileage listing a week after customer received vehicle.  It appears to be correct.

Even though it has been more than 2 years, we would gladly talk with customer and see if there is anything we can do to make sure that she is happy.

To Whom it May Concern:

In response to Mr. [redacted] complaint, Regardless, the only work that Mr. [redacted] paid TDI Motors to perform is listed below.
Eurovan Lift Kit - $2599.00
Fiamma Awning - $1139.00
Tow Package w/wiring - $475
4 way alignment - $181.80
Replace lower ball joints -...

$ 288.00
Of the work above, the only item that Mr. [redacted] is disputing is the replacement of the ball joints. Mr. [redacted] is mistaken however, since his shop replaced the UPPER ball joint, part # 701407187B. We replaced the LOWER ball joints, part # 701407361B. So, we did replace what we indicated and his shop replaced an entirely different part!  As for the other items that Mr. [redacted] is claiming were not done  - the resealing of the oil pan, coolant flush, ac check, battery check, etc. – he did not pay for these items – these were billed out internally to our sales department as part of the reconditioning process. Mr. [redacted] has no claim or warranty on these items. He could however, have contacted us with questions regarding these items and we would have happily re-inspected the vehicle for him at no charge. We were never given that chance.
The fact that another shop claims we did not perform repairs does not in fact prove that we did not perform repairs. There is a clear conflict of interest since Trafton made $2700 on this deal.  We should have been contacted and given a chance to refute such claims.  Our shop did indeed perform all of the repairs on both work orders.
Now this confusion could have been avoided, had Mr. [redacted] simply called us and asked us for clarification before authorizing a different shop to do work on his van.  In fact, we never were contacted by Mr. [redacted] until AFTER he had this shop do the work and then only by a threatening and factually incorrect email.
As far as titling and registration, the fees we charged had nothing to with Oregon DMV fees.  We charged for out of state trip permit and our dealer documentary service fee.  This was discussed at time of sale and he was very thorough with EVERYTHING involving paperwork and charges.

This is a vehicle that was purchased by the customer 1 year and 8 months ago. He insisted on having a 3rd party inspection done on the vehicle before he purchased it. He paid to have the VW dealer inspect it. They gave it a good report. It had also been to a different shop (to have a clutch start...

switch replaced because we were backed up in our shop) . That shop is a highly rated TDI repair shop and they also did an inspection at the time. That was 2 weeks before customer purchase. Timing belt had been replaced in 2013. If it indeed had broken it would have had to be a fluke. Definitely nothing we saw , or the Dealer etc... So, if that really happened it is a mystery. We sold the car at a good price and did everything we could do to make the purchasing process a pleasant one. The Dealer said it was in very good condition, The other Diesel specialty shop said it was in good condition and our service department signed off on the condition as ready for sale. We have referred this over to our attorney (Brian P[redacted]) because this person has slandered us for no reason and at this point we will seek damages in SUPERIOR COURT.
