In response to Ms***’s buyer rebuttal, let me point out that our company was hired to represent the seller’s of the property in question, and that we did everything we could to be responsible and courteous to all parties involved, including the buyer, Ms*** and her representatives. She had her point of view, and that is fine

I noted that you forwarded the first part of my response already. Thank you. Would you please also add the following to it as the realtor is destorting the facts claiming that some of the kitchen appliances were personal items and not included in the sale. That is incorrect! We purchased the home with all new kitchen appliances as advertised and the sales price included the brand new double oven, refrigerator, microwave, dishwasher and 5 burner range advertised in MLS and their sales brochure. We had already pointed out that the venting is not adequate and asked to have that taken are off. As previously stated it is a bathroom vent that is already all yellow in color and at times even with only two burners used the fire alarm ingites! The independant appliance center that we asked to inspect our kitchen will confirm that the c.f.m for the burner/vent is wrong. The right size of vent with hood (or similar needs to be installed). The dishwasher needs to be replaced and installed properly. The current one is not new as scratched and dented and installed wrong. (It would not close right as pointed out during the inspection and all that was done was scrapping off the cabinet - still showing as never refinished or painted). He further noted that the gasket size for the garbage disposal/plumbing attachedment is wrong and not installed properly - the reason why it was leaking just days after we me moved in. (since corrected as reported). The owners (and we are sure Mr. [redacted]) were aware the refrigerator was not new at all. The rust and the still not working ice maker along with the other missing broken or missing parts are not acceptable and we are entitled to a new like refrigerator as was sold. As indicated on my original submission MEDCO, the appliance person I was referred to, confirmed that the appliance were not new (some refurbished). The micro wave was missing parts and is certainly not new either. We understand that finally Mr. [redacted] is agreeing to pay for a new like stainless double oven. Again NONE OF THE KITCHEN APPLIANCES HAVE A SERIAL NUMBER OR MODEL NUMBER TO AUTHENTICATE.We have been asking the realtor to do the right thing and pay us the amount requested so we can finally put this to rest! We hope that nobody else has to endure this type of treatment.

Review: Realtor [redacted] fraudulently advertised that the home on [redacted] in [redacted] has (amongst others) an "Exquisite Kitchen ...NEW APPLIANCES AND GAS RANGE ...etc". The same listing promise of all new kitchen appliances was also stated on the realtor site MLS, the home's official flyer by team [redacted], broker lic.#01009073 and on several "home for sale" websites. Upon purchase and moving in on 8/29/2014 we noted that the refrigerator and freezer and the double ovens had visual and mechanical defects (ice maker not working at all, ovens temperature code not changing and burn marks in the interior). Furthermore microwave was missing the turntable mechanism and plate; the dishwasher had (minor)scrapes and was not installed properly. In addition several of the range's gas burners are not engaging properly and the requested vent repair appears inadequate for 5 burners. None of the kitchen appliances described seem to have a Serial/Model number. There is no warranty paperwork. I was referred to a METCO, owner of M&A Appliance who admitted that none of the appliances are new but rather REFURBISHED (or what the prior owner described later on as RESOLD cheaper due to known defects). [redacted] failed to respond to any of my e-mail request to rectify this situation (via our realtor from First Team)for several weeks. He is in receipt of pictures and descriptions of additional problems as well. After 5 weeks - and only since FIRST TEAMS managing broker got involved - [redacted]'s response received suggests we "misunderstood" and that maybe we could discuss the difference in discounted versus full price for TWO of the appliances!Desired Settlement: Check in the amount of $9,500 is the only acceptable settlement. We will replace the kitchen appliances with new ones that will have the proper warranty and will come from a reputable source.I have submitted the brake-down of the replacement cost of each Kitchen appliance that was presented as new and part of the home purchase to the realtor.
