Dear MrPollock:
I am in receipt of the complaint in your letter dated February 16, I would like to address issues disputed in the complaint I will address in the order they were put into the complaint: “We were told there weren’t any covenants When we closed on the house, we were given a packet of covenants.” Nearly every subdivision in Campbell County has covenants, which is not to be construed to mean there are restrictive covenants The closing title agent prints out anything of record, and includes this for your information. “We haven’t received any disclosures on the house.” I am not sure what disclosures your are referring to, as in the Contract to Buy and Sell Real Estate dated October 20, 2014, you initialed Page 4, Line 180 item B“A Property Disclosure is not available” The Agent clearly told you there was not a Property Disclosure, and you initialed indicating you were informed. “When we had the home inspection, there were issues brought up about the roof, the downspouts, and the vents on the roof We had concerns about leaking from the roof due to cracking & hail damaged We asked for those things to be repaired We were told that their inspector would look at it Later we were told that they had been ‘taken care of’ She said she would get downspouts, to this day we still don’t have downspouts.” During a conference call between the Broker and Selling Agent, regarding the inspection in which Mrs*** admitted she didn’t even read, it was her husband who reviewed it, it stated clearly there was light hail damage and that the area remained strong The inspection also stated there was an area near the chimney that had been sealed with a weather proof sealant The inspector stated there was no evidence of an active leak and there were no leaks or moisture intrusion present at time of inspection He recommended annual monitoring of the area, and sealing again if necessary. The items listing for repair on Addendum to Contract to Buy and Sell Real Estate signed by the Buyers on October 24, 2014, the buyers requested a roof inspection to check for leakage around the chimney, if damage was found seller would make a claim to her insurance company, and make a claim The roof inspector went out there and said the roof appeared strong, and there was no evidence of leaks There was no mention of downspouts on this Addendum I would also like to note that the Licensed Real Estate Appraiser, which was hired by your lender, also passed the roof in the appraisal. “The roof leaks around the chimney, and has damaged our TV stand” The roof inspected by a home inspector, and a professional roofer Both professionals stated the roof was strong There was no evidence of water leakage at time of inspection. “Our insurance company will not insure the roof”, Your insurance issued a binder of insurance to cover this home You were advised the insurance company changed their policy in regards to T-lock shingles December 1, When asked why they just didn’t change insurance companies, the buyer said “Why should we have to change insurance companies?” Well Mrs***, because your insurance company changed their policy right before you closed This has nothing to do with Team Properties Group, LLC We gave you other options , and you were unwilling to explore them. …”*** steered us away from because of T-Lock shingles…” Steering is a very serious accusation Mrs. *** did not show you properties, it was her licensed assistant This is the only house both buyers agreed on Her claim that the selling agent made double commission is completely bogus. The home buyers were a part of the “Homes for Heros” program - which we were happy to participate in Because he was a veteran, we lowered our commission from the cus***ary 6% an $11,commission on both ends of the transaction In order to help them, we lowered commissions to $4163, which is less than 2.5% We wanted to help them get into a home they could afford, since there is a very limited amount of inventory in Gillette in their price range So, their claim that the selling agent was making a double commission is completely false She was doing it for less than half. “*** at Team Properties Group, LLC told us to just buy some flex seal and cover the area that is causing the problem”…This simply did not happen I never told Mrs*** to use flex seal at any time This is a ridiculous claim. In a document you signed before this transaction occurred, you were advised of the following: “Please be advised that our experience is in marketing real estate We are not attorneys, accountants, surveyors, engineers, builders, electricians, plumbers, termite inspectors, radon inspectors, etc Questions and concerns will arise that are outside of our expertise, for example legal advice, tax questions, lot line locations, structural condition of the property, mechanical condition of the property, soil conditions of the property, presence of termites, water wells (quality, quantity, and condition of well), septic systems, water and mineral rights, etc. QUALIFIED PROFESSIONALS may need to be retained to obtain answers to your concerns Oftentimes, knowledge in these areas exceeds the buyers’ We highly recommend if you have concerns or questions regarding this property, or any other property you might be considering, a qualified professional should be retained. We are most willing to coordinate such inspections, as well as provide you a list of qualified professionals in those areas We will be happy to obtain fee schedules for you and arrange those appointments at the property for these inspections When considering the purchase of a property, you should anticipate fees of other professionals you may need to close the transaction We will do everything we can to help you anticipate the types of inspections which you may need, and we know it is important for you to have assurance from a professional regarding your concerns “ Team Properties Group, LLC, did exactly what you hired us for We found you a home you wanted in your price range We did everything in our power to ensure a smooth transaction for you We rely on the opinion of Qualified Professionals to assist in the home buying process If we are assured by these professionals all is well, that is what we have to rely on. You signed a Final Property Walk through form at the time of closing In that walk through, you attest you have had an opportunity to inspect the property and you find that everything was in order and you are unconditionally accepting the property in its present condition. While it is unfortunate that you are having issues, Team Properties Group, LLC is not responsible for any roof damages you are claiming We did everything we need to do in good faith.
