It is truly unfortunate that this situation came to thisTech Savvy has a strict policy that states that a customer is required to pay or pick up their computer within days of completion or we reserve the right to keep the computer in lieu of said paymentPlease see attached document showing
your signature on the line below the policy.You were contacted on numerous occasions via phone and email-here are the dates: • July 25th, 2016: Computers dropped off at Tech Savvy (see attached: "*** *** Signed") • July 25th, 2016: Quote sent and agreed (see attached: "*** *** Signed") • July 28th, 2016: Data Retrieval work completed by Technician (see attached:"*** *** Signed") • August 2nd, 2016: Emailed Invoice & Called (see attached: "*** *** Signed") • August 5th,2016: Emailed Reminder Invoice requesting payment (see attached: "*** *** Communication 3") • August 5th,2016: Received email response acknowledging receipt of aforementioned reminder invoice email which stated "I will be back Sunday and will pick it up Monday" (see attached: "*** *** Communication 3") • August 20th, Emailed 2nd Reminder Invoice stating it had been over weeks since the work had been done, requesting immediate payment in order to compensate our technicians•please note- all invoices can be paid online• (see attached: "*** *** Communication 2") • August 22nd, 2016: Received email response from *** *** stating "I am so sorry, I forwarded this to my receptionist and she must have forgotten! I will get them by tomorrow to pay the invoiceAgain, my sincerest apologies!" (see attached: "*** *** Communication 2") • August 26th, 2016: Emailed Ms*** after still not receiving payment asking whether the payment was coming in check form or able to be paid online (see attached: "*** *** Communication 2") • August 30th 2016:Emailed Ms *** after still not receiving payment letting her know that the business structure had changed but her invoice had still not been paid but reminded her that I still had her computersI explained that I would have them in storage but they could not be picked up until payment receivedI also reminded her about the policy stating "Unfortunately we're nearing the day mark where if it's not paid or picked up- we keep it. I really don't want to keep them! Please let me know what you're planning to do- or what has been done.'' (see attached: "*** *** Communication 6") • September 8th, 2016: Emailed 3rd Reminder Invoice to Ms *** after still not receiving payment or communication- which stated "I'm not sure if you guys have sent a check or not, orif this just hasn't been paidI've closed the office where you dropped off the computers, so I'll need to deliver them when the invoice gets paidPlease let me know what's going onThanks" **please note at the time of this email it had been over the legal time limit of our policy** (see attached: "*** *** communication 5") • November 3rd, 2016: after months of zero communication from Ms *** we received an email stating she had tried multiple times to get a hold of us and that she'd had checks returned from our addressThis is physically impossible because our Change of Address from the post office went through immediately and we received every single other piece of mail sent to the old address and had no other customer or vendor tell us their mail was returnedHer email stated that she'd tried to text, Facebook message and call- but email was not part of this list even though that had been the primary mode of communication up until that point(see attached: "*** *** Communication 7") • November 8th, 2016: Emailed response to previous email stating that "this has been a frustrating situation as I had emailed you a couple of times without any reply and never received payment after a few months of the computers being on our shelf ready to be picked upI've had to temporarily close the business due to some family emergencies which have taken me out of town for weeksThe business address has forwarding on it so I'm not sure how the checks would have been returned to you? Can you please verify where you sent it? We do have a policy that customers sign when dropping off their computer that states if the computer has not been paid for or picked up within days it is kept in lieu of the feeAt this point I'm not sure if the computers are in storage or in my home officeI believe what we did for you guys was a clean wipe of two computers with just a new install of windowsI do know that I have comparable computers that we can swap for, I just need payment immediatelyI'm happy to drop them off and pick up a check or run a credit card as early as Thursday because I am still traveling" (see attached: "*** *** Communication 7") ***PLEASE NOTE THAT IN THIS RESPONSE I OFFERED TO PROVIDE HER WITH COMPARABLE COMPUTERS**• • November l5th- 21st, :Received numerous texts from Ms *** stating she was frustrated and threatened to file a police report• November 21st, 2016: emailed response to Ms *** stating that I had been in Chicago for my father's funeral and I hadn't been able to deal with her computer situation. I attached her intake sheet to show that she had signed our legal disclaimer about the day policyI responded to her concerns (from text) about her data being compromised and assured her we do not operate that way and have never had a problem with thatI then explained that I would send her external hard drive at no cost and then reminded her again about the day policy (see attached: "*** *** Communication 7") On November 21st, 2016 I sent my last communication to Ms *** (see attached: "*** *** Communication 8") which was very assertive in natureAfter going back and forth on text messaging it was dear there was not going to be amicable resolution to the situationI apologize profusely if this email came across as somehow aggressive as that was certainly not my intentionIn response to the items in your complaint that refer to my personal life I will say this: losing a parent to some may seem like a person's life is a "mess" as you called it but I certainly never spoke those words to youI'm also unsure as to what the death of my father has to do with this business situationIn regards to the conversation you allegedly had with a former partner in a non-profit I was involved with- their words have no bearing on anything to do with this complaint, nor do they reflect the truth in any wayIt's extremely disappointing that you would use these types of things in a business complaint- neither of those things happened in even the same month that your computers were fixed and ready for youIn regards to the external hard drive being delivered to you - please see attached proof of delivery form sent from USPS- showing that I did, indeed send (which you personally signed for) said hard drive on December 5th, I will also note that I did not charge you any money for that work or the parts involved, which would have cost over $something I had to pay my technician for out of pocketI've attached the write-off invoice for your attentionFinally I would like to address the issue of whether or not I was "aggressive" towards youI have never in my life been aggressive with anyone, especially a customerAfter all of the difficulties in my life I've learned to never take life for granted and always treat people with absolute respectThat being said, I was definitely very assertive with you in explaining about our legal policy and I am terribly sorry if that came across to you as aggressiveI'm sure it was difficult for you to hear that the policy was in effect for youIn closing, I will still be willing to provide Ms *** with comparable computers with payment up front, otherwise the day policy will go into effect permanently
