opportunity to respond to the above referenced complaint ID numberThe complainant purchased an Assigned Risk policy from the State of Tennessee Assigned Risk PoolBy doing this, the insured signed an application indicating he would follow the terms and conditions of the policy and provided an estimate of his payrollThe insurance policy is purchased for the year starting on or about the date of the application so the actual payroll is not known at the time the policy is issuedThe payroll is important since the premium is determined by the rate assigned to the work performed x the payrollThe complainant is also an included officer on our policy and as such, there is a minimum and/or maximum payroll that would be charged for himThe complainant reported $17,for himself yet the minimum charge for an officer is $44,600, a difference in exposure of $27,This difference is the largest portion of the additional premium. The coverage forms in the policy Part Five- Premium, EFinal Premium states "The premium shown on the information page schedules and endorsements is an estimateThe final premium will be determined after this policy ends by using the actual, not the estimated, premium basis and the proper classifications and rates that lawfully apply to the business and work covered by this policyIf the final premium is more than the premium you paid to us, you must pay us the balance." As this is part of the policy the insured had prior knowledge that there could be an additional premium due or there might be a return premium based on actual payroll and work exposure. The complainant indicated that he was a small family owned business and as such it is not uncommon for an individual to have more than one job duty as shown by the complainant's description of his job at the time of auditThe complainant indicated his job duties were "overseas operations, office administration, estimating, scheduling, packing and loading trucks, driver, and jobsite supervisionThe records provided did not support a separation of payroll and therefore, the payroll was placed in the highest classification of any work performed. We provided the complainant a dispute letter outlining what to do to dispute the auditif the complainant provided any additional information, we would certainly review it and make any supported revisionWe believe that we have followed the guidelines set forth in the policy and the complainant owes the additional money that he has been billedWe would consider setting up a payment plan should the complainant need this as well. confirm the handling has been appropriateWhile we do provide workers' compensation coverage for *** *** *** ***., it may be difficult to understand that not all injuries/conditions are covered under the Workers' Compensation Act Below is a summary of pertinent aspects of the claim.An investigation into the circumstances of the claim was completed after AmTrust was made aware there was lost time involved *** *** was contacted for his history of the injury, and to explain potential benefits.Medical benefits were paid and an initial estimated Temporary Total Disability (TTD) benefit was paid for 3/3/ *** *** was released with restrictions, and modified work was made availableOn 3/*** *** contacted the adjuster to advise he had not worked since 3/6/when he left work early due to painThe adjuster explained benefits were only due if restricted by a physician, and *** *** was advised to send us the notes confirming disability.While waiting confirmation of work disability *** *** was evaluated on 3/18115, by orthopedic specialist, *** *** At that appointment *** *** confirmed *** *** was unable to work, but also indicated he suspected the pain *** *** reported did not stem from a work-related problem As the causal relationship of the condition to the work injury was in question indemnity benefits remained pending until further clarificationOn 3/23/*** *** indicated the prevailing factor of ongoing hip pain was transient osteoporosis of the hip and not a workplace injury Based on the prevailing factor opinion from *** *** no further benefits were authorized.*** *** sought additional care with a different physicianOn 4/*** ***'s attorney advised defense counsel there was a recommendation for an MRI with contrast, and would provide a copy of the orderOn 4/we advised our counsel we would authorize the recommended MRI The MRI results and follow up evaluation with *** *** were only received 5/8/ The adjuster will be reviewing the results with defense counsel and advising *** ***'s counsel of our position.*** ***'s attorney has filed a Claim for Compensation under the *** Workers' Compensation Act Our defense counsel will be following up with *** ***'s attorney in this regard.Please feel free to forward any additional questions or inquiries to the address listed below.Sincerely,*** ***Regional Assistant Vice President Workers' Compensation
