Initial Business Response /* (1000, 11, 2015/08/31) */
Hi [redacted]
Good Day.
I was trying to post our reply on the link provided in your email but it was not showing me any form or field. Screenshot attached with the email. Hence I am posting my reply here. If you need to schedule a call then I...

am available till 9.30 am PST every day so you can schedule a call between 8.00 am PST - 9.00 am PST.
We had a Horrible Experience with [redacted].
You can read here about our engagement & our agreement with [redacted] & judge accordingly. The client came to us with a project statement that he wants to develop a survey website & that was all that we got in requirements! We engaged with this client to come up with complete requirements for the front-end & the admin interface & even helped the client to develop a business model. From this, one can gauge that the client didnt have any vision & what we know from further conversations is that he wanted a project to show to some investors for funding. We developed wireframes for this project using best UX design pattern libraries & developed the UI designs for the website. The client was extremely happy with the results & always seemed very satisfied with all the work that we had put in.
We did the PSD 2 responsive HTML5. We integrated the design & functionality 2 give the client a website with great looking front-end that had the functionality 2 register new users, enable them to take surveys etc. Apart from this it had complete admin panel to manage users, create Custom surveys with dynamic controls and their answer options (this was very complex part) as well as able to view survey results submitted by the users. Users could also login through facebook / linkedin & also had the provision to invite their friends to take surveys & earn points.
All the functionality was delivered in 1 month & during this time we had weekly releases & every time the client was extremely happy and paid each invoice most willingly. The project started on a good note & ended even on a better one with further talks on quote for ongoing SEO & maintenance. So the question arises, what happened after the project delivery that the client files a dispute asking for a refund & gives us such a nasty feedback as well on elance where we engaged with each other and that did hurt our reputation which we have built over the years hence this person and his business should be penalized for hurting someone reputation for no reason? Well he had his meeting with the investors and the investors said that they do not wish to fund it. Now our client did not expect this and with no funds granted he comes back to us and asks for a refund. Now is this ethical? We are sure; if the client's investors would have given the funding he would not have done this. He was always aware what is being delivered to him and he was happy to pay for it. A dispute makes sense when you are not satisfied with the deliverable and you refuse to pay. But here, not once but client paid our invoices many times. Even as per our latest conversation with client which is after his meeting with investors, he agrees that he does not find anything wrong in what has been delivered under this project but his investors feel so and this is the reason he wants a refund.
Another reason for this behavior is probably, he does not understand, what actually goes into developing a Web Project which looks good, functions as per expectations. We have been really fortunate to work with clients where our relationship has been of mutual respect & admiration coz of client's knowledge & ethics & our commitment, hard work & always wanting to do more for our clients. Our experience with this client is a lesson for us, where we should be wary of clients who do not have a vision & have no knowledge of IT projects. Because for such clients, no matter how much effort you put to make their project successful, they would always blame you for their own frustration and lack of knowledge regarding IT project implementation.
I will request you to please take some sort of action against such buyers who wants to sabotage the reputation of the providers and wants to always blame it on someone else for their failures.
Thanks and I will be glad to help you if you require my assistance.
Ansh.
Initial Consumer Rebuttal /* (3000, 13, 2015/09/06) */
(The consumer indicated he/she DID NOT accept the response from the business.)
The aforementioned is not factual and falls in line with the ongoing refusal of Technousa. It starts with the fact that I paid a different company to draw a statement of work that was delivered to Ansh Virmani prior to the project as it was part of the process to select a suitable company for the work that needed to get done. Additionally, when sub-par results were delivered, I engaged a 3rd party contractor to evaluate the work. This company confirmed my suspicions about the now apparent lack of work and knowledge.
Furthermore, his speculations about conversations and interactions with my clients are just that. Speculations. Intended solely to diffuse the matter on hand. Funds are not the question here, obviously payments were made on time every time. The work itself is at question and now subsequent the company's, better said Ansh Virmani's intent to wiggle itself out of the situation. I have files, records, hour sheets, discrepancies in hour sheets, online conversations available for review substantiating my claims and make those available to the appropriate parties.
I am disappointed not only about Mr. Virmani's ethical behaviour in this matter, but in his obvious willingness to forfeit any integrity on his behalf in raising insults.
I will make all efforts to prevent this from happening to someone else again. It has happened to others on elance before, and shame on me for not believing the testimonies available.
Fortunately I will have the opportunity to visit both locations with offices in question in the near future, India and the US to get a better understanding of Ansh Virmani's and Technousa's true nature.
I refuse any refunds at this time, even if offered. This is no longer a matter of refunding work that was not properly done, but a matter of what is just and right.
