On December 8 2017 I bought a coat for my wife in the Toronto Eaton Centre Ted Baker store. I told the sales clerk I was buying the coat as a Christmas present for my wife. My wife found the size to be too small and did not like the colour, so on January 6 2018, the first day we were back in Toronto after Christmas, I returned the coat to request a refund. I then discovered the very inflexible and ridiculous return policy - you have to bring items back within 14 days to obtain a refund. I pointed out that I would have had to return the coat BEFORE Christmas to be eligible for a refund, but the sales clerk and Assistant Manager kept repeating their 'you can have a credit note? policy. I agree that stores can set whatever return policy they want to, but I believe they need to advise clients what that is. When I told the clerk I was buying a gift for Christmas more than 14 days before Christmas, he should have told me I would not be able to return it for a refund after Christmas. The store manager advised me that the policy is shown on the sales receipt (it is, but you don't get this until AFTER you buy the merchandise), and also under the cash registers (I had to ask them to show this to me. The sign and the print font are so small that you really can't see it unless someone points it out to you. And the sign is partially obscured by merchandise on the counter.) I believe this may qualify as deceptive sales practices when these policies are not displayed prominently and made clear to purchasers.

Desired Outcome

No settlement requested - for The vendor should be required to make their return policy much clearer when it is non-standard. Most stores will refund purchases made in December as Christmas gifts until the end of January. The sales clerks should advise purchasers they have only 2 weeks to return purchases for refunds. And ridiculously small messages on sales receipts (that you don't get until after you make a purchase) and a tiny card under the cash register that is obscured with merchandise do not constitute disclosure.

After reviewing the complaint we do not agree with the customer's statement as the policies are posted at the registers as well as having additional signage around the store on tables and on our fixtures. The policy was also listed in full detail on the receipt that was given to the client and the employees are also aware of our policies.
Please see attached an image of the additional signage that we had displayed throughout the store in addition to the one at the register. It clearly states in the second paragraph that refunds will be allowed within 14 days of Original Purchase which for that customer was on December 8th. Our extended holiday policy allowed for additional time to exchange or store credit up until January 31st instead of our usual
The signage in green is the one we have year round and we never cover it up with product that would obstruct it's view. It also states that full details of the policy may be found on the website and that our policy that does not affect their legal rights. I hope that answers your concerns.

The images sent by the store do not open. The employees may be aware of the policy, but did not explain it to me - and I said I was buying the coat for my wife for Christmas, so the employee should have told me that by then, it would not be returnable for cash refund. The store claims that their policy sign would never be obscured, yet my picture shows that it was partially covered, is very small, and is well below eye level. And printing the policy on the sales receipt AFTER you buy the product is an attempt to hide behind legal disclosure, but does not ensure the client is aware of the return policy. A weak response to a shady policy, and I presume employees do not make clients aware as this would hurt their sales. All good reasons to shun this vendor when making buying decisions. If you really want Ted Baker products, buy them from Nordstrom, their return policy is far more client-friendly than Ted Baker's.
