The product in question he is referring to is our 5% Cashback program The way the program works is if a customer uses a 5% back card at participating retailers, they will be credited with 5% of the transaction amount The program was initiated at the beginning of the 4th quarter in
The list of participating merchants is available at simon.com/giftcards and is also included with this letter.We worked with this customer during the month of December We had offered to refund the Giftcard he had purchased, but the Guest had already spent the full amount at Brooks Brothers We explained to him that if returned the items he had purchases at Brooks Brothers he could, instead, use the card at one of our participating retailers and get the 5% back that he had been wanting which would have equated to $ However, he refused to return the products he had purchased Instead he wanted us to give him back the $he had put onto the card But he had already spent the full amount.Mr*** claimed that he had no way of knowing that the program only worked at certain stores We attempted to explain to Mr*** that on the physical Giftcard he had purchased, the Giftcard carrier included with the Giftcard, and all marketing materials pertaining to the 5% cashback promotion indicated "visit simon.com/giftcards for the fulllist of participating merchants".Sincerely,Keela W***Product Manager

Simon Giftcard - Simon Gift Bag - Columbia Sportswear Acrylic Water Bottle & Coupon Offer - Elizabeth Arden Hour Cream - Lotion Sample from Crabtree and Evelyn Although the website information was deleted when the packages sold out, I am sending you a screen shot of the information that was posted on the website Please see Exhibit AYou will need to scroll all the way down to the right -hand lower corner to view the contents regarding what was posted on the website Additionally, I have attached a copy of the creative that was used to produce 22Xsigns that were dispersed throughout the property as well as a counter card that was on display at Guest ServicesWe did not claim the customer would receive a beach ball or sand pail Every customer that purchased our gift package received exactly what was listed as an item on all signage at the center promoting this package Please let me know if you need any additional information to help resolve this issue

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that the response would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
The information provided to the Revdex.com was not accurate regarding the offer to return my items and then refund the gift card.  I have an email string where they mention nothing about returning the card to get a refund.  They have not "worked with me" at all, other than to tell me I was out of luck and should have read the website rather than listening to what their employee said.  In addition, some of the "promotional materials" referenced that I supposedly received did not actually happen.  They refuse to take responsibility for the deceptive advertising by their employees and they refuse to accept that the person who sold this card was either not trained properly or is falsely advertising the benefits of this card, as I was directly told by the employee I would receive the 5% cash back at any merchant in the outlets.

We have contacted the customer to obtain the Simon Rewardcard numbers so we could review the cards and respond to the customer.  Mr. [redacted] provided us with the card numbers and we determined that the cards had remaining balances.  The customer is eligible for replacements card as the funds...

I am not rejecting this out of hand. In the log online, and to my knowledge, the last communication I had received was 4/7 not 4/29. That is what the Revdex.com site shows, and I am know we did not communicate otherwise so perhaps you are thinking of another similar case? If youwill post your contact information I will email my card # and other info you need. I have not been able to contact you. And when I was trying prior to my Revdex.com complaint, everything was unreliable which is why I had to escalate it. I believe this needs to be in email/writing so that we can be aware of what we have offered as a solution and stick to it.
