*** purchased the wedding package for my clients, *** * *** as a wedding gift

Another portion of $was received March 18 -- weeks late, breaking the contract of having FULL payment before March 13,
I did not received the final payment of $until weeks after the wedding date of April 27, 2013-- another breach of contract
I was not required to show up to the event due to the unpaid account
The clients who signed the contract, saw my work, agreed to the terms of which I operated They signed the contract stating that ALL balances should be paid days prior to the event They also signed the waiver clause that states all work performed the day of are considered artwork and a true reflection of their day, there will be no refunds given to the basis that they do not "like" the images The work they received is indicative to their day I know they have referenced other weddings that they saw posted I will be honest in saying NO weddings are ALIKE! it's like comparing apples and bananas
I arrived to the event April 13, 2013, it was extremely unorganized the entire day.
The wedding party was rude, with snide remarks and did not want to part-take in the suggestive poses I had mentioned I worked with what I had at my disposal
As for images, the bride and groom were not specific to the details they wanted captured, rather they repeatedly said they would leave it up to me as I'm the professional They wanted primarily candid images We did set aside time for traditional shots The origional agreement was to have the shots outside, so I planned on this -- there was a spur of the moment change of plans due to weather, and we had to use the inside of the church Had I known the church would be dark I would have brought a light kit- (additional cost apply) this was not even mentioned since they wanted outdoor shots
The images were edited and returned to the client in a mannerly fashion I allow weeks of lead time They received their proof book and flash drive March 13, I walked them thru the next phase to complete the album design portion It is up to the bride and groom to select which images they want to include into the album before I design the rough draft
July 7 was when ***
brought to my attention that she was not happy with the church images (traditional shots) she expected more I mentioned I would take a look and rework the images to see if I could improve the lighting and coloring of the faces
It was at this time, I was experiencing an extremely personal matter, and was filing for divorce I had to file a restraining order against my husband, move out of my house with my kidsThings became extremely tense on my home front and day to day living was difficult I had to shut off my cell phone service due to harassing phone calls and threats against my life I still had contact with *** via *** As I was entering into my 'busy' season -- I had all I could do to keep my head straight I had weddings during the summer This transition not only affected *** and *** but everyone in my season! My other brides/grooms have been very understanding to the adjusted lead times, and items have all been delivered near the completion dates After years of shooting roughly 6-weddings per season -- This is my FIRST unhappy client I was listening to Jackies' concerns and also taking them into full considerationI have not heard back from her on how she wanted to proceed until I was receiving threats from *** and *** and taking me to court in Illinois, these phone calls started in December
October 16 I had received the album design form On this form it states designs can take up to weeks to be completed September I had to move my computer out of my primary work/residence to a safe spot to protect my work from a disgruntle husband-- this move caused a massive computer crash where I lost all my files, I explained this to *** on Oct 30 that my lead times will be delayed due to the life changes and the holidays - I remember joking with them during our first consultation that my goal is to get everything to them by their first anniversary! truth-- some brides take longer to get the albums designed The Gadache album proof was posted on January I haven't heard back from *** since the album proof has been posted
I understand *** *** and *** *** are both disgruntle with the whole instance The clients that signed the waivers and the contract is *** * *** I will continue to work with the clients Working with *** is like adding a 3rd wheel
I have held up my end of all the contracts signed As for the images produced -- each wedding is different and the outcomes can be differentMost weddings I attend with photographers, *** *** *** did not want to pay for a 2nd even though I suggested it
Shooting in the candid/documentary form -- there is no precise clear cut return on images Hence I have the waiver in there stating if they are not happy with their images, NO REFUNDS-- I will be happy to work with both *** *** *** so we can both move forward in a positive direction
