There is a general Warranty book given at the time of closingwhich had a concrete section, however this issue was brought up before closing and shortly after closing again and we were told this is not normal for the concrete to do/look like this and that "they" meaning Tempest and Ely Concrete would... make this right for us. This has never happened and we continue to get avoided phone calls and no responses from them. They have also pushed the complaint onto 2 nd and 3rd parties which are the contractors that THEY (Tempest) hired to do the work.

In response to Claim# *** I have Provided all materials on this issueI have included the entire concrete section of the warranty book also included the letters from both the contractor that did the work and the concrete company that supplied the material they have both been there and done a physical inspection and sent a responseHomeowners were given a copy of the warranty book at closing and signed the warranty agreementthere is also a digital copy available online at our websiteWe have never Nor will ever shrug away from our responsibility to handle warrantable claims for this or any home ownerThank you for the opportunity to clear up any questions or concerns in this matterWe have gone above and beyond the warranty coverage by contacting the contractor and supplier for an inspection of the driveway in question and provided all correspondence form their findings

We reviewed the attached lettersHowever, the footprints are not in the area of delamination and *** *** , ** *** (IMI) as well as Shane from Tempest have all three seen this and agreed after that letter was writtenWe were told by their (Tempests') subcontractors that they would "make this right." We are still waiting and in the mean time have a year old drive way that was obviously installed wrong and needed to be fixed from day one and continues to deteriorateIt has nothing to do with the warranty book when the original installation was wrongThere shouldn't have been saturated concrete left uncovered when the elements were as cold and as wet (snow) as they were that night the drive was poured.

I have spoken to the complainant and the contractors will be there tomorrow to reseed straw and mesh the appropriate areas he said thank you on our Phone conversation at 4:08pm 11-7-17

in response to complaint [redacted]. The smoke alarm that is not in series it was reported that during the walkthrough that the wire was cut by accident by the father when he was installing a ceiling fixture roof supports are trusses made in a truss manufacturing plant the lumber used is pine...

which will have knots in the standard building material, We have been contacted by the homeowner and have set an appointment to go over any outstanding items from the 11-month walk through. We will completely honor the warranty and repair anything that is necessary on this inquiry that may need attention.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that the response would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.Our salesman did not tell us what a standard shingle was and did not mention a shingle upgrade when we were going through the buying process, nor has anyone who I've contacted with Tempest in the past three to four years when we started having problems with our roof. Our realtor has sold quite a few Tempest homes with the salesman that we used. She has never heard of a shingle upgrade either. We did contact Tempest within our roof warranty period, and they asked us to file a claim with IKO. Our claim was denied. When we notified Tempest of the denial from IKO, Tempest told us to wait to do anything else. They implied that they were going to help us. We wanted to be polite and handle this without doing anything legal or formal. So we waited assuming that they were actually doing something as Tempest has historically been a reputable company. When we contacted them for an update about issues this year, we realized that no one was actually doing anything, and they were going to let us have a 6 year old home with a bad roof. If your response doesn't change, we will assume you are OK with your homes roofs falling apart within two years and needing to be replaced by 6 years.I find it incredibly disappointing

Id# [redacted]Tempest Homes has always gone above and beyond the warranty guidelines for our customers. we offer a shingle up grade on all sales the standard shingle is a 25 year 60mph rated three tab shingle. The shingles used on this home were IKO shingles. we have a 4 year installation warranty on...

the product but the manufacturer carries the 25 year materials and craftsmanship warranty on their product. I have helped every customer file a claim with the Manufacturer as outlined by their warranty the issue that this customer is experiencing is a seal failure that is due to the adheisive not performing as it should. I have sent our distributor out on claims and even pulled the sales agent to our distributor to look at this issue at the end of the day it is IKO's responsibility to uphold the material warranty. Please feel free to contact me with any questions or concerns.

The warranty book doesn't say if the the drive was improperly installed and/or not cared for properly after instulation. We were told by both of the representatives that you sent out that the driveway wasn't correct and that they would "make it right" We have yet to see this 2 years later, while our drive way continues to crumble away and be an eye sore. If Tempest sees nothing wrong with our driveway then maybe they should show potential new clients our driveway??
