Dear Officers,We would like to disagree with the complaint and can provide additional information.[redacted] (and her Executive Assistant [redacted]) purchased the following services from [redacted] on 2015-12-**:Template [redacted]  -$75...

[redacted] 1 year package at InMotion hosting - $47Ready to use web site service - $299Add [redacted] feeds - $49Add [redacted] feeds - $49Add [redacted] feeds - $49Move social Icons to the top of the header - $19Total with a discount - $565On the same day 2015-12-** at 10:46:18 EST we contacted the Customer and requested to provide content and details for project completion. Ready-to-Use website service implies that premium template of customer’s choice is customized with his logo, colors, content (up to 6 pages without additional programming), set contact form and, finally, is installed on customer’s domain.The Customer contacted us with the details and instructions only on March, **, though previously uploaded the files through her personal account with us on March, **. The project was sent to production. Please, see the screenshot. [redacted] The content was not provided in full volume (not for all website pages) – the Customer  provided gallery images on March, ** and answered our question regarding the social media feeds integration ([redacted], [redacted], Twitter) only on March, **.  Changing content is a time-consuming work, as we care a lot about quality and full functionality of the result. We also have a queue of projects, so submitting content does not mean getting the result the same day. These are strict rules and internal procedures that we are instructed and obliged to follow. The project was delivered on Friday, March ** and the Customer was notified by email: please, see the screenshot [redacted]  Customer contacted us back the same day and requested the updates that concerned:  logo size and adding absolutely different images to Gallery page, even though at that moment there were added the images that had been provided by Customer along with initial instructions. So, Customer changed her mind about the design after the project delivery. Customer requested the updates to be completed the same day, though these were extra modifications different from initial instructions provided to us.  The website [redacted] was live on Friday, March **, as promised and agreed. The request for updates concerned the changes which were not initially discussed (make logo bigger and etc) - the design changes were approved by Customer on the design stage, including certain pictures that had to be added to Gallery. So that request for updates could be considered as a change of mind after the project delivery, despite that fact, we did our best to speed up the process of finishing updates. Our programmer completed the task for extra updates on [redacted]03.2016 around 14:27 EST [redacted] After the project completion Customer decided to cancel the whole order, and informed us about filing the complaint to the Attorney General’s office in NY and Florida and with the Revdex.com. Customer was introduced to our policies and terms of use. We duplicate paragraphs from the email:“Please let me clarify our terms of use. We are selling intangible products and services protected by copyright and product license covers original and customized design, licensed content and proprietary scripts used in a template or its derivatives and upon cancelling an order, product license is revoked automatically according to agreements with copyright holders. In other words you need to have a valid order and license for the customized template and services in order to be able to use it.Receiving full chargeback means that you are not authorized to use original or modified template files, you should realize that violation of the above mentioned is a subject to a legal prosecution and investigation.Currently, the website is live at [redacted] If you claim your money back, you'll automatically lose the right to use the product.” The customer was offered to find an amicable solution: accepting the result and staying with the template license, and getting partial refund as compensation from our company for moral damage, as Customer was unsatisfied with the communication level that she experienced. We offered issuing partial refund, even though having delivered the result, we bore reputational loss because of the actions taken against us.Customer rejected our offer in her email dated March, ** – she decided not to use the result of our work, and just stay with original template license (not customized template) and InMotion hosting. Customer signed the Waiver of Copyright on March, ** and agreed to comply with the terms of waiver in the shortest possible terms. Please, see the screenshot of a signed Waiver document: [redacted] On March, ** at 12:16 EST we issued the refund for customization services:  $443. Since that day we have not heard from Customer, though she was sent 2 emails as a reminders to comply with Waiver terms and delete the result, as the refund was issued per mutual agreement. As you can see, the result of our work is still live at [redacted], that violates our copyright policy and agreements reached in communication. The Customer is aware of the fact this violation is a subject to a legal prosecution and investigation. But our emails dated April * and * were left unanswered and the customized result of our work has not been deleted and is currently being used on Customer’s server. We would really appreciate if you could check this information and make a fair decision in regards to the case. Review: I purchased a website template and installation from [redacted] on 01/**/2015 and the sales representative told me that it would take 12 business days to complete the install. They provided me a user portal on their website where I can upload files (such as our logo, banner, etc) and the portal will show updates of the progress on the install. I went ahead and uploaded all of the required graphics and a hand drawn template to show how we'd like the icons to be placed. The [redacted], emails me back on 01/**/2015 and asks for all the information that was previously already provided. I sent the information over to [redacted] and requested that we set up a time to chat to discuss the modifications. [redacted] responded with the following:

"Dear [redacted]!

unfortunately we are not providing phone management at all.

Just an e-mail or a live chat at templatetuning.com/chat

I am available for chat at 6am-2pm EST

at the moment our developers are working on the website already.

Your document is enough for now. We have no any further questions for the moment.

Work shift 6 am - 2 pm EST "

I've attempted to contact [redacted] or any staff at [redacted] using their online chat and have not been able to respond. So on 01/**/2015 I emailed [redacted] and requested a status update and this was his response:

"due to our [redacted]`s note the updated results should be uploaded to your server within 1-2 business days.

I will e-mail you as soon as it is finished.

Have a nice day!"

Today is 02/** and I have not heard back from Template Tuning. In addition, I sent emails to 3 of their email accounts ('[redacted]', [redacted]) and have yet to hear back from them. I now want a full refund for non-delivery.Desired Settlement: I want a full refund for non-delivery. However, I am willing to accept a partial refund if they can complete the job immediately.

Review: I paid for a website and web design from Template Tuning in July. After several attempts to find out why, as of this date, I still do not have an active website. After several emails, texts and messages, I received an email on Friday stating that my website would be uploaded and LIVE within 24 hours. I still do not have an active website. This morning I sent an email to every email address listed including customer service BEGGING to get my site up. I received the stock auto-response as usual except for the customer care. That one was returned as undeliverable. They have ONE phone number listed on their site, but it has never been answered. I get a recording stating "The person at this extension is not available, etc." and I leave a number. I have yet to get a call back. I have lost money and one of my clients due to the time it has taken to get this completed. I expressed my concern of this numerous times and the answer I received repeatedly was "I got you". They in face did not "have me" at all, and have chosen to ignore my pleas. I am at a loss as to what I can do to remedy this situation and get my website on the web.Desired Settlement: I really just need the site up. I have paid for everything in full and only expected the same prompt attention. I should not have to beg for the work they have been paid for to be completed, nor do I need the answer "I got you". If I can't get the site up by Monday afternoon, I would like a full refund of all monies paid to Template Tuning and Template Monster.

Review: I purchased a custom website from the company which also included 24/7 technical service. For many months I have been complaining to them that my website does not work correctly but they seldom respond and have never fixed the problem. The technical service they advertise takes weeks to respond by email and they will not talk to me over the phone or by chat. I have still been unable to use my website after purchasing it nearly a year ago.Desired Settlement: I would like them to fix my website and give me a refund of at least half of what I have paid to get my custom website because of the many troubles I have experienced with their almost non-existent service.

Review: Contacted Templatemonster. Purchased template for website. Purchased site tuning from Template Tuning. Spoke with cole sanderson, and toldhim after a review of the product not to go throught with it. Requested a refund. made it very clear not to touch our site. they replaced our site with the template even after being told not to.Desired Settlement: For them to refund our money.

Review: The agreed upon purchase price for content installation into a webpage ([redacted]) is not being honored. 5 pages of content were supposed to be included in price. All content sent to [redacted] on multiple occasions. As of today, the content for the Membership and Our Programs page is still not loaded. I have received numerous reassurances that the content will be loaded "shortly" and its been months without resolution.Desired Settlement: I want the Membership page and Our Programs Page's content loaded without further delay.

Review: I have paid for the Template Tuning service of a 24 hr web-site Template installation via [redacted] on Sept **. The web-site Template was in English language. The Template was installed on Sept ** BUT in Russian. My whole site was changed to Russian. I contacted the technical support, actually, the technician who installed that. At 2 am on Sept ** he responded back saying that I should change the language in the drop-down meny on the page. I have checked and even the selection of English language was missing. I had: Russian (twice), Spanish & German. I wrote back to the technician. The next time I received an email from him was on Sept **. On Sept **, I spent the whol day reading the manual on how to do this installation, finally, I re-installed the Template myself & English language now was present in the drop-down menu, I also changed my site's configuration in order to go back to English. This thing took me a whole day. I have paid in order to avoid this. The tech wrote me back on Sept ** saying that he cannot login to my site in order to do changes - I have already reset all the passwords as I fixed it all myself. Now the same tech doesn't want to honor the refund - he says that I should've waited for them to fix it.Desired Settlement: I would like to receive my refund. Also, I want the tech to apologize for not delivering what was promised and for writing me back so many nasty emails.
