Upon signing the contract, we should have been advised As far as an awning, I have no idea what they are talking about I don't feel that I have to settle for substandard work Why would I want to walk in a room and have one side significantly lower then the other? This is the second response to *** *** *** *** complaint # ***Please see Calendars detail of events surrounding the Pagano project which was completed in October 2015, after the issuance of a CO by the town of HempsteadIt should be noted that final inspection took place on 9/*/and it took the town of Hempstead weeks to issue the CO.In an attempt to further address *** *** second complaint Calendar will attempt to dissect *** *** view of events and answer based on the facts regarding the project outlined in our initial response.First, Sy advised in October that work would should be able to start in AprilThis is an estimate and is wholly dependent on when the town completes its review of building plans and issues a permit for a specific projectDuring the holidays and continuing through today, the town of Hempstead is extremely backed up in there review and issuance of plans and Calendar cannot start a project until the town actually issues a permit which was not actually issued until JuneThe agreement states work should begin ** days after issuance of permitWork began in July. Calendar agrees there were numerous phone calls between the company and the ***The purpose of these phone calls where to provide consistent communication to advise the status of the project as detailed in our first response.Regarding the existing awning, it required significant work to bring up to code as detailed in our first response which Calendar performed at materials cost.Calendar agrees no customer of ours should settle for substandard workWhen we were alerted of *** *** dissatisfaction with one wall, Calendar demoed and replaced the wall in question to the *** satisfaction free of charge as is standard practice for Calendar Sunrooms.Regarding *** ***’s diagnosis, as this is the first we have heard of this, Calendar offers its prayers for a best possible outcome; however, we do not see why this is relevant to work performed.Here at Calendar Sunrooms, we strive to leave all of our customers satisfied; however, in some cases due to many circumstances beyond the company’s control that need to be managed through consistent communication “*** *** *** *** ***” as well as individual personalities this is not possible in 100% of cases.In conclusion, Calendar will restate its position that all work agreed to be performed has been completedCalendar considers the matter closed, but will continue to honor its year guarantee of all materials used in the construction of the *** room

*** *** *** *** contracted with Calendar Sunrooms on 10/**/to construct an Insulated screen room at which time they gave us a depositCalendar surveyed the job and began work on the building plans to be submitted to the town of North Hempstead in order to approve a building permit to
construct the roomThe contract states that if the town requires anything additional, that is between the home owner and the town.After reviewing the approved plans for changes and additional requirements from the town work began in JulyThe town required three separate inspections to conform to town building codeFirst a footings inspection for the two cement footings to support the existing roofFootings where approved, concrete was poured and the inspector required Calendar wait an additional week for footings to setNext a framing inspection was set up and the town was now requiring additional work on existing awning necessitating Calendar to sister up continuous 2xheader beam on the front of awningCalendar completed that work at cost of just materials and inspector came back a week later and approved the framingThe third inspection was for insulating the existing roof which added an additional week to the projectAfter all initial town inspections where complete Calendar was cleared to build room.The existing awning was largely responsible for delays in constructing the room as it was not built by Calendar and required considerable modifications to bring up to codeAll of the delays and additional work where communicated in a timely fashion to the *** with almost all conversations occurring between *** *** and Calendar who fully understood why completion had been delayed due to town requirements for a CO(We are compelled to note that communication with *** *** where frequent and sometimes contentious including one 3am phone call to Calendars project manager which was described as rambling and incoherent). Calendar installed the walls and sliding glass door; however, due to the uneven construction of the existing awning the far wall was set approxone inch lower than the rest of the roomUpon receiving a rather heated complaint from the *** regarding the imperfection, Calendar came back, demoed the wall in question and replaced rebuilt to the *** satisfaction free of charge. Regarding *** *** falling this was in no way related to the crew who simply needed access to an electrical outlet to run their toolsContrary to *** *** complaint that Calendar never contacted her regarding the fall, we were actually on the phone with *** *** as he was at the hospital where we voiced our sincere concern for *** *** wellbeing.After yet more delays due to the town inspector’s scheduling conflicts and sitting on paperwork, the CO was issued for the *** project in fulfillment of Calendars contractual liabilities.After nearly a year after the project was completed, *** *** contacted Calendar requesting a refund which due to the above described events is wholly unwarranted.In conclusion, the *** required considerable time and resources due to a confluence of variables beyond the company’s control; however, all work agreed to be performed has been completedCalendar considers the matter closed, but will continue to honor its year guarantee of all materials used in the construction of the *** room
