When we lived in the neighborhood of Terrace View in ***, we were fined an unjust amount of money for an occurrence where the POA Board sent someone on our property to mow without giving us notice that we were out of compliance.

I had multiple correspondences with *** of *** after the Board sent someone on our property to bush hog two times in April of 2019, after the lot had been cleared months prior of tall grass, as requested in a letter dated 11/28/18; our former lawyer confirms this in his correspondence to the Terrace View lawyer on 1/25/19. Ms. would not acknowledge that we were, in fact, in compliance as requested back in November, which would have required another letter to be sent to us with a new “mow by” date to bring the lot into compliance, as per policies of the Terrace View POA Covenants.

In May, we were sent an invoice for $1100 for this occurrence and spoke to *** as well as the Board directly about this multiple times because it was fraudulent and abhorrent, considering what grass was actually cut on the two occurrences that someone trespassed on our property to mow (we did call the *** Sheriff’s Department on the second occasion and had a deputy come to assist). Neither would admit that they had not followed proper protocol, per Terrace View covenants/policies, and continued to enforce we owed the money. We setup a meeting with the Board and their lawyer but had to let them know we could not make it due to a family emergency; we reached out to the lawyer immediately to reschedule and got no response. We never heard anything else about the charge after June 2019 and thought they may have dropped it.

Our house was for sale and put under contract in the fall, set to close in mid-December. We received a lien notice in mid-November 2019, saying the Board would place a lien on our house if we did not pay the $1100. We paid under protest, since we were not going sacrifice in the sale of our home. I let *** know they payment was on the way as soon as I signed for the notice. However, upon closing on our house, I was informed the POA had placed a $377 lien on our house. I emailed the agent for Terrace View, ***, and was given no clear answer or justification why this lien was placed, as we would have had a $0 balance on our account at this time; all she would say is that they had released the lein. Our closing was delayed a few days because of this unjustifiable and unlawful act.

I bring these to the attention of the Revdex.com because I think the POA Board should be reprimanded and held responsible for their improper treatment of homeowners and their disregard for following proper protocols and covenants they are supposed abide by. Charging us $1100 for sending someone (another Terrace View property owner, which is clearly a conflict of interest) onto our property to mow unjustifiably and without giving us notice is illegal and plain out wrong. I take this action in hopes that they do not treat anyone else the way they treated us.

The *** were charged for not maintaining their property per the community guidelines. *** court ruled that Terrace View POA had the right to intervene and mow their grass if they did not properly maintain it. The Board authorized their property to be mowed on several occasions and they were subsequently charged for that maintenance. Thank You***VP Board of Terrace View POA

I have reviewed the response offer made by the business in reference to complaint ID, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

*** did not rule that the POA had the right to mow our grass; this is a false statement. We do not argue the fact that the Board authorized another community member to come mow on our lot, however they did not follow due process outlined in the "community guidelines" in giving a notice of non-compliance along with 10 days to mow ourselves before authorizing someone else to do so. The fact still remains that they fraudulently charged use 1) for mowing a lot that was never touched and 2) an abhorrent amount considering the amount of grass cut.
