There was no sewer leak, but a sink drain line that was leakingEarlier this year we paid a 3rd party plumbing company to replace the entire drain line and that repair failedWe coordinated with that company to warranty their repair but due to rain delays, and their scheduling issues the problem was not rectified within a week and we made the decision to hire another company to repair the line, which took a few more daysThe line has been repaired and no further issuesWe follow all safety guidelines and the area was marked off with florescent barrier tape and conesYes it did have an unpleasant smell, but there was never a safety hazardHaving a water drain line break was not in our control and we diligently resolved it in a timely manner and this alone doesn't negate the agreed upon contract to reserve the apartment with a non-refundable deposit feeLike most apartments in the State of Texas we use the same application and procedures from the Texas Apartment Association which sets fair practice standardsWe have a large demand for our apartments as we continue our rehab and once an applicant applies for a apartment, we guarantee the apartment will be ready for move in, on time, and in excellent conditionSince we take the unit off the market and turn other people away while our staff makes that unit a priority, per the Texas Apartment Association guideline we require a $non-refundable application fee and a $deposit fee that is refundable if we are unable to approve the resident for move inThat applicant signed this application which clearly states thisTexas Apartment Association Application "The application deposit is not a security deposit, but it will be credited toward the required security deposit when the Lease Contract has been signed by all parties; OR it will be refunded under paragraph if you are not approved; OR it will be retained by us as liquidated damages if you fail to sign or attempt to withdraw under paragraph or 7, if you fail to answer any question, or if you give informationIf You Withdraw Before ApprovalYou and any co-applicants may not withdraw your application or the application depositIf, before signing the Lease Contract, you or any co-applicant withdraws an application or notifies us that you’ve changed your mind about renting the dwelling unit, we’ll be entitled to retain all application deposits as liquidated damages, and the parties will then have no further obligation to each other."
