In response to Mr*** complaint there are factors that he is not includingI was the driver on scene the day of the accident and at no time did I have any contact with Mr*** to let him know that there would be a charge for our servicesThe police officer on the scene did ask me if there would be a charge to retrieve his personal effects and I advised him there would be a chargeThe side of the highway is at no time a leisurely place to beWith cars zipping by, our main concern as tow truck drivers is to clear the highway and open the lanes of traffic without be injured by passing motoristI rolled the car back to its wheels, loaded it on the tow truck and transported it back to our storage facility When Mr*** contacted me via a phone call he wanted to get his personal belongings out but didn't think he should have to pay anythingI advised him that if he had comprehensive insurance they would cover the expense of the tow, recovery and storageHe said he did not have full coverage insuranceOur company policy is to collect on the initial tow and recovery charges before any personal effects (except prescription medication or paperwork) are removed from the vehicleThis is also in line with Missouri State Statute Section 304.156: "states the amount of the accrued towing, storage and administrative costs are the responsibility of the owner, storage and administrative costs will continue to accrue as a legal liability of the owner until abandoned property is redeemedThe towing company claims a possessory lien for all such charges." Even though Mr*** cursed me on the phone and made accusations of lying to him I still went out of my way to help himI offered to reduce the initial fee from $to $so he could retrieve his personal effectsAt that point he told me he would pay the full amount and get his car out so he could part it outSince then I have not heard back from him In closing I'd like to say that I would rather see him get his personal effects and me be able to junk the car for salvage so it's not taking up space on our lotHowever we need to collect on services renderedMr*** has to understand that we as a business cannot afford to offer services at no charge to consumers and expect to stay in businessI offered a reduced amount to settle this matter and he chose not to except it Regards, Terry's Towing 3147-645-
