reviewed, pursuant to her Purchase and Sale Agreement which  stated that she would “not net less than $33,000”. She felt that Evergreen Home Loans was in breach of contract, as she had netted less than the stated amount.We discussed her complaint at length and it was explained that the Purchase and Sale Agreement is a contract between the buyer and seller and that it did not include Evergreen Home Loans, nor are we bound by the contract.We further explained that lenders represent buyers. We do not determine, quote or disclose seller fees and cannot by law be part of that determination.Once this was understood by Ms. [redacted] she thanked me for my time and said that she understood that Evergreen Home Loans was not responsible.Please let us know if further documentation is needed.Sincerely,M. that Mr. W[redacted] did correctly identify that adverse credit items such as collections and charge-offs do need to be addressed per VA credit underwriting guidelines (VA Lenders Handbook, Chapter 4; available at http://benefits.va.gov/warms/pam26_7.asp); however, best practice would be to have allowed an approved VA underwriter to determine the acceptability of any outstanding derogatory credit, including unpaid charge-offs.  We are unclear on whether you decided that you did not want to proceed with Mr. W[redacted] or if he made that decision, but we want to sincerely apologize that you did not have the opportunity to have your loan properly reviewed.  That is not in line with Evergreen Home Loans protocol and appropriate steps are being taken immediately to address this issue.Also, we want to apologize that you felt that you were treated in a derogatory fashion.  That is never how we want Evergreen Home Loans represented and through our investigation did determine that it was never Mr. W[redacted] intent.  Until he heard from you again on October 13th, he had thought your original conversations had ended cordially and professionally, as evidenced by him including you on his email list for future communications.  As we advised, you have been removed from the email list and should not receive further communications.  We, along with Mr. W[redacted], want to apologize.  We want you to know that we all feel we missed an opportunity with you and Mrs. [redacted].  You are valued, even now, and we appreciate the opportunity you have allowed us to look at your case and find ways to ensure that these types of situations do not occur again at Evergreen Home Loans.Further, we have conducted a thorough review regarding the requested credit reports and asked [redacted] (the vendor we use to pull credit reports) to conduct an independent review .  Our findings show that Mr. W[redacted] requested a Tri-Merge credit report, from [redacted], on 5/4/2015, at 5:20 pm.  A Tri-Merge report is a credit report merged from each of the three major credit bureaus ([redacted]) and is required on all loans.  All tri-merge reports will reflect as two lines on your credit report.  If you look at the highlighted portion of the excerpt the letters [redacted] stand for [redacted] and [redacted] and the ** stands for [redacted], representing the three major credit bureaus.  In your complaint with the Revdex.com you state the following:  “The companies are: [redacted] Evergreen Home Loans”.  Below I have provided a snapshot taken from the credit report we received as a result of our single request.  [redacted] has advised that the two inquiries from [redacted] and [redacted] were pulled on the same day, but before our request and were not requested by Evergreen Home Loans.  Their information is reflected on the credit report we requested, which confirms that that request was made prior to ours.  [redacted] was also able to see that those reports were requested by [redacted] , the credit provider for [redacted].  Mr. W[redacted] could not request reports through [redacted], as they are not an Evergreen Home Loans vendor,  nor on behalf of the [redacted] as we are not affiliated with and therefore do not have access to their computer systems.  They were requested by a Credit Union.  If you did not contact a credit union before talking to Mr. W[redacted] you will want to refer to the document I have attached, provided by [redacted] or you can contact [redacted] directly at:  https://www.[redacted].com/consumer-assistance.html.{Please see attachment for the image and table that were included here}And finally, [redacted] was also able to provide information on how our request for credit might have adversely affected your credit score.  We were advised that there is a 45 day window for inquiries, when applying for a mortgage.  It is called “45 Day De-Duplication Window” and when auto, student loan and mortgage related inquiries occur within any 45-day period, they are treated as a single inquiry for scoring.  That 45 day window would have started when the Credit Union requested your credit earlier in the day on 5/4/15.  Our request should therefore not have affected your credit score.  We hope that this information assures you that there was never an intention of threat or retaliation.  Again, please let me extend our apologies for the miscommunications that lead us down this path.  Your concerns were heard and we will use the information gathered here to get it right the next time.  If you have any additional questions please do not hesitate to contact us at [redacted]@evergreenhomeloans.com.We want to thank you again for bringing your concerns to our attention and want to wish you well in your new home.Marilyn C[redacted]Consumer Resolution Specialist
