I am rejecting this response because: Our company gave notice prior to days over the phone and were not informed about the required time limit instead we were told that we needed to speak with our territory rep before we could cancelHaving NEVER received a copy of our
contract from our rep and never being given a chance to READ the contract because it wasn't made available to us at the time of signing we were never aware of these un heard of clausesWe have in writing that our rate was agreed to be $a month with no fuel charges or feesThe section about rate increases would not apply to usIn their response waste connections states they have tried to negotiate with us about priceThis is exactly what lead to us signing this bogus contract in the first place waste connections offered us an agreed price of $a month no additional fees and then didn't live up to their end of the bargain

Dear ***, We set up service agreements for this customer to have a permanent roll off dumpster at of their businesses for large debris removal. Something most apartment complexes use. They were set up on a month term which is pretty standard. I gave them a discounted
rate because of the duration of the term. I explained that if they sold property it would void the agreement no matter how much time was left on it. It was never discussed that they could cancel at anytime like they proclaim in this complaint. They did sell one of these three properties and we quickly canceled the service and removed the container. When the customer called to remove the dumpster Erik Smallwood the current rep explaining the remaining time on the contract. The fee for canceling the contract early is clearly outlined on the back page of their service agreement. There is nothing in the paperwork of the contract explaining they could cancel at anytime nor was there ever a verbal discussion about this. However, the problem was with the difficult attitudes of the lady that answered the phone as well as the
manager of the Chickasha locationThe district manager in Colorado was extremely helpfulIn the future if a road is difficult maybe they should consider mailing the customer a letter explaining instead of showing up intermittently

Our Customer signed a contract dated
3/14/14 for the services described
in the complaint. In the document signedit is very clear about theterms to cancel the agreement and rate adjustments during the term of the agreement.Our term
was for 36 months with renewal
term of 36 months unless either party shall give written notice via certified
mail at least 90 days prior to the ending of any term. Notice was given on 12/28/16 by
certified mail but was outside the parameters set to terminate the agreement (77 days).The contract also covers rateincreases, due to CPI, disposal increases, fuel, materials or operational
costs. There is no placein the agreement that states theprice is "fixed" for the lengthof the agreement.We have also tried to
negotiate a rate with the customer that both parties
could be comfortable with without any cooperation with the customer. Therefore wehave no other choice but to enforce our valid
agreement.
