I purchased a transmission, they refused to pay the additional costs to make it work, even when I purchased the warranty.
I purchased a transmission for a Ford Explorer. They told me I should buy the parts and labor warranty so I would not be out additional cost if there was a problem. They shipped the first transmission to my mechanic, it was no good, it couldn't even be installed. They shipped out a replacement that was installed, I paid the shop for the work and picked up my vehicle. 3 miles later the transmission was failing. I took it back to the mechanic and they said there were parts failing inside the transmission. I called the salesman at Your Ford / Texas Auto Recyclers (Brian) and he said he would talk to the shop and get it sorted out. They told the shop to complete the work on the transmission to ensure that it would work. Two days later the shop let me know that the transmission would not be repairable.

Your Ford / Texas Auto Recyclers shipped out a 3rd transmission and the shop installed it... after 1 day it was giving error codes and I had to take it back to the shop to have a sensor changed out. After all this I paid an additional $521 to my Mechanic for the all the additional work beyond just installing the new transmission. Your Ford / Texas Auto Recyclers said they will only pay $300 for the warranty repairs. The Salesman, Brian, and the General Manager, Tony, just say that it is their policy to only pay a certain amount, and they won't pay more. This whole process took over a month, and I've still not gotten the original $50 core charge refund check yet either.

Desired Outcome

I want Your Ford / Texas Auto Recyclers to pay the full $521 in additional cost that I incurred to get their transmission to work.

Mr. bought the transmission from us 9/21. He purchased the silver plus warranty from us that includes parts and labor warranty for one year. The warranty terms, which are at the bottom of all of his invoices he has received from us, states labor claims are paid out based on Mitchell R&I time. 99% of all salvage yards use Mitchell R&I time when paying out for labor. It tops out at $50/hour for labor. His labor invoice from Bill's Half Price shows his labor per hour was $85.00. We paid out six hours of labor at $50/hour.

Mr. has also acknowledged, before he sent in this complaint, he did receive his core refund check. The company he works for, Zilla Wraps, paid for the transmission originally. Since they paid us by check for the transmission, we have to issue the refund check to the same person who paid us. Mr. doesn't like that which is why he is saying he has never received the check. We told him we could work something out with that but we had to have the original check back which he has failed to mail back or bring in.

We have done everything on our end to make this right in agreeance with our terms and conditions of purchase.

I have never received anything in writing, invoice or otherwise, stating the warranty policy, and certainly not before I purchased the transmission. Also, I did mail back their original check, on the same day they TOLD me they would put my check in the mail. I mailed their check weeks ago.

And the original check was written to MARK ***, that's not even my name, so I couldn't do anything with it, regardless of the situation. So, I received a check written to the wrong name... so NO, I have not received my refund yet. And it's been over a month.

I was told that they were putting my correct check, for the full amount, in the mail 2 weeks ago. Doing everything on your end would entail sending out a CORRECT check on the day I told you it was wrong. It seems like you have still not mailed out a check you told me would be sent 2 weeks ago.

We said we would reissue the check once we received the first one back. We still have not received the check back yet.

We went ahead and placed a stop payment on it and reissued the check and included the $300 labor refund for a total of $354.13. The check will go out tomorrow morning via USPS, tracking number is XXXXXXXXXXXXXXXXXXXXXX.
