the first time I went to this lot I put $1,000 down payment on a vehicle that I never took possession of never received was told that the vehicle need a battery needless to say two months later they had my deposit and still no vehicle I paid over $200 to add it to my insurance and pay two months of insurance on it with nothing I end up getting my deposit back finally with the promise that when another vehicle became available that I would get a free warranty on it due to the inconvenience. I was contacted by the salesman said another vehicle was available when in and put a $1,500 deposit add a vehicle to my insurance check the vehicle for one day drove it that night the vehicle was extremely small took the vehicle back the next day and was told that there was nothing that they could do that I was stuck with the vehicle for at least 6 months I couldn't change out the vehicle and I couldn't get a deposit back so I left the vehicle at their yard and their possession and was just told that it was pretty much my problem.now dealing with this company I'm out of well over $2,000 the first time the thousand dollars I did get back the $1,500 I put down this time I can't get back and I spent the insurance money and two months insurance the first time and now I'm paying insurance on a car that they have in their possession and they're pretty much telling me that it's my problem and that if I don't make a payment that they're going to put it as a repo which they have the vehicle in their possession. I entered into an auto purchase agreement in August of 2019 with the owner of the business named *** Several clerical errors were made after the contract was signed with the owner. I had been left with one expectation of the terms of my contract based on the statements of the owner. Yet after being required to restructure the contract multiple times due to clerical errors made by the business, I have been subject to a repossession of my vehicle after payment which I was under the impression was my first one due was made on December 4th. Between August 24th and December 4th I have made multiple requests to speak with the owner Alex in order to resolve the discrepancies that existed with my vehicle account. Yet I was never afforded that accommodation and have been subject to a compromising situation that could have been resolved with a single phone call to the owner. After speaking with two different managers of the business I was told by one of them that they do not bother the owner with issues like this even though the situation originated with him. I had not received any correspondence or notices indicating my account was delinquent other than a phone call one day before my vehicle was repossessed. I requested during that phone call that I be contacted so I will be aware of the status of my account yet I never received that contact and my vehicle was retrieved in public inconveniencing my responsibilities I had for the day. I have all of my payment receipts with none of the indicating any correct or delinquency information regarding my account. My vehicle was repossessed without my account being 30 days past due. I was just informed that I had a late payment due bye November 15th only as of yesterday December 10th.

This review is concerning the finance manager, Kenneth ***, and not the dealership itself. The first word that comes to mind is crook. This man had my car repossessed after only 1 missed payment and the payment wasn't even 30 days late. When we contacted him to get the car back, he refused to release it to us unless we paid the car off entirely, $9000. After multiple phone calls, curse words, apologies and practically begging him to give me my car back, the end result was him laughing and saying he was doing this just because he can. He said he wanted to take my car and sell it to someone who makes the payments on time. Granted, I understand that I'm fully in the wrong for getting behind on my payment but I don't think I deserve to be treated this way. It was noted in my account that he was the only person to handle my account so it would seem to me that there was an ulterior motive from the start. Losing my car has had a serious impact on my life and he did this "just because he can." What kind of person does that?

Purchased the car on 10-18-19
Had to take it to the mechanic 10-24-19
Have not had a car ever since.
Tried to reach manager 10-27, 10-28, 10-29
Manager's names *** and ***
Not available or busy on the other line with someone
Car is a lemon

Here is the letter that I wrote to *** the owner of the dealership semi:

***, I wont be able to make it to work, without that car. That being said, the 1200$ that you're asking for is not possible all at once upfront. Moving forward I need to meet with you to sign the necessary paperwork on me returning the car to you due to detrimental mechanical failure. I accept the 1200$ I've already invested in the vehicle as a loss, so would appreciate the binding paperwork containing both our signatures stating as such, leaving no repossession or any debt on my part henceforth. Please respond promptly so we can meet and get this squared away. Assuming you being the owner of this company who in-house financed me the mustang, would not be able to work with me on completing the repair as promised; considering the parts are already available, and you verbally made apparent on your personal mechanic not charging you labor for said-repairs, the confusion on your staff informing me that it would be approved by the bank for repairs until I paid the DDP of 1200$ beforehand has led me to take no other alternative but refuse the vehicle as unsafe and not roadworthy. The very same Deferred Down Payment which was instated after your salesman *** had already drawn up the contract with the simple 1200$ dwn pmt originally agreed upon and signed, only to have ***, intercept via cellphone, informing the salesman to rewrite the contract, stating clearly he would like an additional 1200$ DDP. I appreciate your time and business, and look forward to your cooperation in either assistance by your original reassuring word, or by producing my requested document allowing us to part ways debt free. Thank you.

In fact he demanded that I pay the DDP in full before he would even assist me with the repairs after the fact of getting me to release the car into his possession beforehand assuring me that he would use his personal mechanic to repair the detrimental mechanical failure. I sent this letter to him in request of getting myself remove that free from the vehicle since he already has possession of it and not a single payment has been made on it within a 1 and 1 month time of purchasing it. No harm no foul as one would think. But Alas no response from him, not to mention the vehicle's history shows clearly that it has no major accidents on its report whatsoever yet the 2 mechanics you inspected it in for me and showed me clearly the massive body damage but it impaled on its right side causing it to lean slightly to the right they both informed and also that this vehicle was very pretty on the outside with a loud massive gaping it air and take OO to make the engine sound loud and forthcoming for anyone they would want a sport car however the repairs that were needed on it where time in a scrutinizing way to where it would easily fail the driver whoever bought it and cause them to have to take it in to get repaired with the oses warranty leaving them helpless even though half of the major repairs were not even on the buyers guide that was signed by the contract *** and I both agreed upon originally

Complaint: ***

I am rejecting this response because:
The original contract stated my 1200$ would be sufficient. After signing said contract *** the previous owner of the Mustang and a Salesman or co-owner of the company Texas auto save LLC did infiltrate Buy cell phone the salesman *** who then instructed him to put the phone to my ear and give me further instruction semicolon stating as such, that I am too accept the condition of a deferred down payment and that the contract will be re-written and drawn up with an additional $1,200 deferred down payment. I admit to this. My only complaint is that it was unkosher and highly unorthodox to implicate an applicant with a new contract stating as such after one has already been agreed upon and signed. Leading into my main condition which is that I had to use money to pay for repairs on send as his vehicle rather than pay the $400 down payment the insurance I had canceled because it was taken under a mechanic's lien at *** Automotive. Only to be taken to Texas Premier Auto on Bandera for an attempt at a full repair with a payment plan. When Texas Premier Auto was unable to complete the payment plan stating that I was not eligible after the fact. I then contacted *** reaching out to him and imploring him to help me. He then stated that he would use his own personal mechanic to complete the labor on the vehicle which would be of no conditional cost to me and the parts would be covered as well as soon as they were in. Two days hence after that I then called *** and his secretary did entrust me with that the parts were in fact available and that I would not be given the vehicle back nor would it be repaired until I paid the full amount of the Deferred down payment which win against the verbal contracts that we agreed upon when surrendering the vehicle at Texas Premier Auto. Upon learning this I then sent a physical letter with a request for documentation to be sent to me showing that I Surrender the vehicle within a three-month. If not less than a month and a half, stating that I would have no repossession charges against me or my credit accepting that I have a total loss of $1,200 in down payment along with an additional nearly $600 on repairs of personal attempt at reconstituting the vehicle into a safe driving automobile. And is because of this that I reject this rebuttal. If you have any further questions please contact me at my new number which is ***. Thank you sincerely, ***
Regards

On May 6th I put a down payment down on a 2004 Chevy Silverado for 500$ and traded my car in for $3000. There was a problem with the differential and they said it’d be fixed and I could pick the truck up tomorrow. May 7th comes around and I go to pick the truck up and it’s not fixed. After going back and forth with the owner we decided to cancel the deal and I’d get my car and down payment back as if nothing had happened. I got in my car and drove away. I waited a couple weeks to get my down payment back and decided to call the owner and see what was up with that. They’re trying to tell me it was refunded on May 17th but I don’t have it. I sent them statements from my bank and they’re ignoring me now.

Miss *** purchased her car on February 2nd and signed an AS IS form. Pursuant to the contract Miss *** signed there were 3 deferred down payment amounts due. These amounts were not paid as agreed. The first deferment of $500 on February 16th, the second of $500 was due on March 2nd , the final down payment deferment was due on March 16th. Miss *** only paid $400 on February 27th. The required full coverage insurance was cancelled by the insurance company due to lack of payment. Texas Auto Save LLC recovered the vehicle on March 16th for Non payment and lack of full coverage Insurance. Even though Miss *** purchased her vehicle AS IS, we repaired her vehicle with Eller automotive and spent $1116. I believe Miss *** filed this complaint because we picked up her vehicle for lack of payment.

Please find the attached forms;
