the complaintant has made several misleading statements he saw and received a clean Carfax at the time of purchase all vehicles sold ten years and older are exempt from milage disclosure and we have his signature on paperwork showing this according to Carfax all vehicle history reporting companies pull data from the same place so any errors will be across the boardI have spoken at length with Carfax about the timing of information, because it was all good when I bought it and sold it and now it shows a problembecause of the rampant inconsistent reporting to Carfax it is by definition an almost situationmeaning that it almost does what they say it does since we pulled Carfax on both his trade and the truck he bought on my phone through Autoniq a service that combines vehicle history reports as well as market reports via nada and other sources and studied them together simultaneously, it is a percent statement that the buyer did not see, nor receive the Carfax I am looking at the most current Carfax available on his trade in that shows it to be a owner truckhe led me to believe he was the 2nd owner so I am unsure of what he means by me misrepresentation of the same vehicle he traded in telling me he bought it from the original owner not only did he personally inspect and test drive the truck he purchased, he had it checked out by mechanics who were related to him prior to buying the truckthe truck was not demonstrating any problems during that timeexcept for an ac switch, and the tachometer was not readingboth common issues with those trucks he claimed to have done a bunch of work on his trade in and was going to bring the receipts back to mehe stopped by to tell me he was having problems locating the papersat that time he said that he had installed a performance chip to make it go fast and get better mileagean act in and of itself will actually void a factory warranty on a brand new truckthe chips/programmers increase fuel pressures and boost from the turbo that often causes engine failure I have copies of both the as is and the title application showing his acknowledgement of the exempt status of the mileage and the no warranty on the truck I understand that he is attempting to extort money from my companythis slanderous path of action has not been limited to just the BBC, he is also threatening a lawsuit against Texas Autowerx in my file I also have a signed arbitration agreement that he signed wich he agreed to by signature as well I understand that he has blown the headgaskets out on the truck he bought due to the performance upgrades he made it is unfortunate that he tore up the truck he boughtit is very unfortunate that he misplaced the Carfax we gave him I have spoken to him and did not curse him or even raise my voice in addition to all the above information the diesel trucks are in such demand that they bring the same money regardless of miles if you look it up on nada there is only like difference from 140,miles to 240,miles it is all predicated on the condition of the truckof which the truck was in very good condition prior to the buyer installing performance tunes if I can be of any assistance, by all means please let me know sincerely Terry Staton 254-744-
