I have been in contact with member via email and will be sending him the record of account as he requestedThe member is stating that he sent a letter that was not acted onWe received a cancellation letter on 9-25-for his monthly membership and cancelled the account on 9-27-There was no further billing on the accountI let the member know that if the cancellation receipt date was earlier than 9-25-that a refund for every month billed beyond the date his certified receipt states will be refunded to the card on fileThe membership time offered was not in place of a monetary refundThis offer is a courtesy for the member due to the member not realizing his membership was still active during Again, I sincerely apologize for any inconvenience caused to the member

*** *** is a personal training client at Texas Health & Racquet ClubWhen she started her agreement (attached) she requested to pay her auto draft bill by cash or check each monthWe let her know we required that a card be on file as a back up for the auto
draft but that she could come in days prior to each draft date and pay in cash or checkAs long as the payment was made days prior to the draft we would then be able to stop the card on file from automatically drafting
On June 9, 2014, *** came in to make a payment for her bill that would be drafting on June 15thBecause the payment was not made days prior to the draft the automatic payment was unable to be stopped in time and the card on file was charged on June 15, in the amount of $The additional payment was refunded on June 20thYou will see these transactions in the attachment. This is the only over charge in our records
It is not our policy to allow cash payments for our auto draft services but we tried accommodate and offer flexibility for Ms***She was also given the opportunity to put a bank account on file for auto draft convenience but she declined
I spoke with Ms***'s mother, Ms***, on June 24th and explained the situationI let her know that if she had bank records indicating that she had been charged more than what we discussed to send me the record so that I may immediately rectify I emailed her a copy of the agreement and transaction history as I have posted hereShe said she understood and would get back to me with any further questions

I am rejecting this response because:The business has refused to provide copies of contracts that authorized charges, and they not acknowledge my refund request Their offer for complementary months of membership is not valid compensation The business is now miles, one direction, from my home Accepting that offer is not equivalent to a refund, because of the distance and time it would take me to enjoy their offer My request for a cash refund is still valid The total refund amount requested is still $

I am rejecting this response because:At this time, the business has not fully complied with my three specific requests.  They have confirmed that my membership was cancelled.  However, they have yet to provide the following:-The contract or contracts that authorized recurring charges-A refund of $544.92I have been contact with the business via email, and they have yet to provide the requested materials.

Mr. [redacted] became a member of Texas Health & Racquet Club in July of 2011. He paid in full for a year membership. In October of 2012 he renewed his membership on a monthly draft that came out on the 15th of each month. September of 2014 Mr. [redacted] called and requested cancellation...

information for the account. He expressed that he wanted a refund for the last year because he didn't realize his membership was active. I let him know a refund would not be possible but that with a 30 day notice the membership could be cancelled. Mr. [redacted] sent in his cancellation letter on 9-25-2014. The billing was discontinued and the membership has been cancelled. I will be contacting Mr. [redacted] to personally settle any other concerns he may have.
