Don's Garage, LLC423 State Route 48Fulton, NY 13069###-###-####July 14, 2015Revdex.com100 Bryant Woods SouthAmherst NY 14228Dear [redacted],This letter is in response to your letter dated July 8,2015 for [redacted], Don's was called via the 911 Center on 5/26/15 to provide service to...
the NYS Troopers. Their request was to tow a motor home from Sterling Stage due to a drug seizure.Don's towed this 87 Winnebago to the impound yard in Oswego, NY. After the police had finished their investigation we were contacted to tow from Oswego impound to Don's yard (6/10/15).When [redacted] called to take her personal things (6/11/15 @ 9:24am) she was informed that if she made a $200.00 payment in good faith against the bill, we would stop storage and re-hook the motor home from the storage yard and take up front for her to gain entry to the doors. I took into consideration the fact that this is a 1987 Winnebago, in poor condition, and also the fact that the owner ([redacted]) stated often she had no funds to pay for the towing and storage services; that she would pay $200.00 towards the bill in good faith. [redacted] came to the office with a credit card stating she only had $100.00 towards the bill. Stoting the obvious, this was $100.00 less than agreed upon. [redacted] was told multiple [redacted]es the business hours (Monday through Friday, 8am to 5pm). She comes to the office and calls after our hours. The phone is answered after these hours for emergency towing and rood service situations, not everyday business. The office is not manned after 5pm. Don's received a lefter from the [redacted]. After speaking to the NYS Investigator, it was understood that this firm was taking this on in a free legal aid situation. After receiving this letter we understood that the matter was to be taken up with them and not [redacted] directly. In this letter, they state that the motor home should be given back to [redacted] at no charge. We attempted to reach this firm and did leave messages. We, to date, have never received a call. In the statement/letter filed by [redacted] it states that Dan's wanted to be "relieved of all responsibility", This in an inaccurate statement. [redacted] contacted this legal firm somewhere around June 17,2015. She, at that time, had only paid the $100.00. [redacted] did come to the office, after hours, and put a check in the window on two occasions. As the matter was not resolved, and we do not accept checks for services under these circumstances, she did not add sales tax to her checks. [redacted] had her "friend" [redacted] call on a Sunday. When I returned a call to this man, he stated he was a "relative" to her. He was informed that [redacted]'s initial payment was in good faith towards the final bill. After much difficulty, it was agreed that [redacted] would pay 2 days storage and the towing. She was then again informed we do not accept checks for payment. [redacted] came to the office and paid via credit which included the initial $100.00 that was taken in good faith. The day [redacted] came to take the motor home away I charged the battery and aired the tires at no fee to [redacted].I would like to state for the record that this complaint was made after [redacted] had received her motor home. She paid for services on July 2, 2015 and this complaint was made July 7, 2015.
