In response to your letter about complaint ID ***, here is my stanceWe abide by the Texas Real Estate Commision ( TREC ) standards of practice With that being said, TREC SOP #and #C (ii) - states that an "Inspector is not required to determine
the presence or absence of pests, termites, or other wood-destroying insects of organisms(iii) Determine the presence, absence, or risk of asbestos, lead-based paint, mold, mildew, corrosive or contaminated drywall "Chinese Drywall" or any other environmental hazard, mycotoxin, pollutant, fungal presence or activity, or poison. As stated in the complaint - time has no bearing on the price, it is based off of square footage, therefore the complaint is null and void. As far as the door being locked - again that is for safety purposes - voiding the complaint. The client would not listen to the explanations given and repeatedly cut down and defamed the company If she was that unhappy with the inspections - why did she hire us three times - in turn saving here from thousands of dollars wasted on two other homes that were not up to par. An immediate response was delivered to her, and as she stated, she did not see the email until laterSeveral correspondences have been made to her to resolve and help with the issue from offering to return the inspection fee to purchasing her home back at closing cost. I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  The owner sent me very confusing emails in response to my complaint with the Revdex.com not with my initial complaint when given to him. What he fails to understand from my complaint is while I choose his company 3 times that does not negate my disappointment with the one job completed that was done unsupervised. I won’t continue to go back and forth on various opinions and obvious misses with my inspection but for him to state this without telling you that he has threatened me with court and made me feel very uncomfortable is quite alarming. There is zero consistency in how this has been handled. Yes I was hung up on then emailed a link to the company that he got his certification through. After reading the website through and through myself nor my family attorney (just for clarity situation has not been filed with a court) could see how me putting my information on that site would resolve this issue. Then he sent me a paper to provide a refund but it has stipulations that I don’t agree to. He basically wants me to erase this poor inspection as if it never occurred. Included in both the refund requirement and his letter of defamation which I have attached he request removal of my Revdex.com complaint stating that I have caused harm to his buisness. I want a refund without the removal of my complaint which still stands as my experience. After his hostile behavior over the phone and the demeanor to which he wrote his last email I did not feel it was the best thing for me to continue to go back and forth with him. I felt things were escalating and thought he would Perdue his legal route he stated in defamation letter. The owner can refund my amount paid but I am not going to remove my complaint. As far as the home buy back, the owner states he did everything up to code and that he didn’t miss anything. If that’s true the home buy back doesn’t apply here it would have to be according to the website him accepting fault of missing something on the report. If he isn’t willing to admit that to me I don’t feel it necessary to waste my time seeking it. Now if he or a representative other than himself would like to contact me to discuss that is fine but according to what he is providing me that is what it states.
