Texas Segway Reviews (1)

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my dispute.
Please enter your reason(s) for rejecting the business response below.
First of all, [redacted] was not "forced to give equipment away to make the sale."  In the first place, he was certainly not authorized to do so by me (he deducted that cost from my proceeds), but beyond that: it makes no sense.  He was selling this item on commission, so he could have simply regrettably informed me that he was unable to sell it and cancel the contract and return my item to me.  His claim that he felt that he had to GIVE AWAY equipment AT COST TO HIM to make the sale is absurd!  He was under no obligation to sell it.  He is lying.  He is lying, but I cannot prove it--yet--because he has withheld information and continues to refuse to provide full disclosure.  Also, we had a contract, and he has repeatedly insisted that he was DOING ME "A FAVOR."  When one believes one is doing someone a favor, naturally one accepts less legal responsibility for one's actions, making the normal ethical guidelines easier to shirk.  He has done me NO favors.Secondly, he never "apologized."  Not only did he not apologize, but his response was the polar opposite: inexplicably, he took offense and told me I was "being an ae!" for merely pointing out the original written terms of our agreement.  When I called him, he shouted at me and hung up on me immediately, literally seconds into the call, and later he continued to verbally abuse me and said he didn't "[redacted] care!" if I thought he was being unprofessional because he was sick of me.  Sick of me!  All I had done was to politely remind him of our agreement (see e-mail) and only later did I begin to ask for details regarding the sale.  He shouted at me viciously that he "didn't give a [redacted]!" that I considered full disclosure on a commission sale routine: "I don't give a [redacted] what you think!!!" he screamed at me when I made that comment.  Keep in mind this was the FIRST time I spoke to him on the phone, after he hung up on me, months and months after waiting on this sale.  The only other communication we had had were the e-mails he submitted.  It's not like we had been arguing or hassling with each other for any length of time.  He went ballistic on me and acted like that immediately.  That behavior is not behavior the Revdex.com, or any decent person, condones.  He didn't even know my name and later accused me of perpetrating a fraud (only in retaliation to my claim against him: "Lawyer up if you please, the fraud is all you") because the name he put on the initial agreement was an amalgam he copied from my e-mails.Thirdly, why on Earth would the purchaser wish to remain anonymous?  Another lie.  In a previous e-mail [redacted] had no qualms in giving me the name of a potential buyer: "[redacted]."  We are supposed to believe that he contacted the buyer, explained the situation, and learned that "the purchaser does not wish to be identified" ??  Who buys a Segway anonymously?  The lies are stupid and clumsy and an insult to my intelligence.  He is telling you that he refuses to be transparent because the buyer
wishes anonymity.  He told ME that he wouldn't give me information on
the sale because I had been such "an ae" and that otherwise he
might have.  He is giving two different answers, both of which ignore
the fact that I am entitled to the information so that I can know that
he didn't just sell what he wanted to sell, when he wanted to sell it,
for as much money as he wanted, much of which he nonetheless admits to.  What is not
clear is exactly when, or for how much.  I could care less to whom the
unit was sold, except that that person may one day be called as a
witness.Fourthly, should I resort to legal representation and file a civil action complaint against Texas Segway under the Texas Deceptive Trade Practices Act, asking for treble punitive damages and all associated attorney's fees and court costs, rest assured that the discovery process will involve, first and foremost, a subpoena for the bill of sale.  When he is deposed, he will be forced to answer questions under oath that are basic and reasonable, the very same questions he is currently telling me are none of my business.  They are ABSOLUTELY my business.  This is a business deal gone bad, and I don't even have all the facts.  [redacted] admits to that: he goes as far as to claim that I am not entitled to all the facts!  Ludicrous.  Given his egregious behavior as I have previously outlined, I am perfectly justified in doubting that the transaction occurred as he has represented it (or rather, refused to disclose it fully) to me.  The only way I can know that he honored the terms of our contract is to independently verify the sale, and that gives me the absolute right to "demand information on the buyer."  At the very least, I am entitled to information on the SALE.Finally, please note how many of the Revdex.com's Standards for Trust this person obviously has violated: Be Transparent, Abide by All Written Agreements, Be Responsive, Embody Integrity.  He is lying, and hiding something and thinks nothing of viciously attacking and insulting someone whose name he apparently doesn't even know, for NO REASON AT ALL, and he calls himself a businessman and respectfully awaits your advice.
Regards,
[redacted]
