I hired this company to level out a slopping area in my side yard with fill dirt (the area between two houses), level my AC unit raise all my sprinklers up and put new sod. After looking at it we determined I needed a french drain....which they installed. They were supposed to put two rain catchers (I only got one). They did not get anywhere near leveling out the area in question, not even close to enough dirt and the yard is more unlevel that when they started!! In fact it is dangerous for me to try and haul my trash around there to the bins. This was the whole reason I hired them in the first place. I had three bids all for the same job.....all in the same price range. When I called him and told him how this was Not what I wanted or expected, he came back with an additional quote of $1500.00 to finish the job I had already given his $2165.00 to do!

Desired Outcome

Repair I want what I paid him for....I want this done right! Or give me my money back! I spent Mega dollars watering new sod last year and that is more than I can afford to do this year! I need my yard fixed

$2,165 was for 100' of drainage from 3 side gutters and 2 catch drains, buried out to a pop-up at the sidewalk, plus 4yds of top soil and 450sqft of new St. Augustine sod installed for foundation protection. A more-than fair price! The Customer wanted their side yard perfectly level, which would require encroachment on the neighbor's yard, negating an engineered "V" grading between the houses for drainage, and the reason for the small retaining wall quote of $1,500. The Customer did not understand that we couldn't go onto her neighbor's yard and add soil, erasing the engineered "V" grading between homes.

I was very clear with *** that I had prior authorization and full approval from my neighbors to level our side yard. In the very beginning of this business journey, this is what he assured me he could do! This could have also been easily verified by him had there been a question. The comments regarding encroachment Never came up until the work was done and he knew I was not happy. The comments regarding an engineered V is a ploy to get out of doing the work they were hired to do. There was not or has there ever been an engineered V nor a discussion about an engineered V...this is my house and I have watched the erosion for the last several years, hence the need to cover that small portion of my foundation and add sod. This was verified to me by their drainage/erosion engineer who came and visited with me prior to the work being done. He convinced me that the French drain would take the erosion out of the equation and that the yard would be able to remain level once the work was completed! He also told me that a catch drain would be placed in the front area of the side yard. That also did not happen.
The work that they did created a steeper slope and a bigger ditch, the French drain has now settled and created a new ditch within the original ditch which makes it hazardous to walk on that side. I was very clear about what I wanted done at the very first meeting with Mike, if there was any question of not being able to do the job the way I wanted it should have been addressed to me then, instead I was assured that he could do the work and for the price he quoted. The second quote of $1500.00 was Not for a retaining wall, that was never mentioned, it was to come back and level my yard....the very thing I hired him to do in the first place. I am asking that the work be completed as promised or a full refund.

What ploy??? EVERY housing development has drainage engineered between houses to prevent flooding. Yards are purposely sloped AWAY FROM THE HOUSE. Our crew completed the job as proposed and estimated, which I continue to contend was a fair price. There was never a plan to completely "level" that side of the house into the neighbor's yard, as depicted in a copy of the exact estimate (enclosed). Only after the job was completed, did the customer complain that they wanted that side of their house totally "level". That is when the $1500 retaining wall was suggested... The Customer didn't want that and said to just level the yard 20ft. into the neighbor's yard (eliminating the neighbors V slope away from their house), and that the neighbors didn't give a "darn" because they were renting the house, and would be moving out soon. We offered a viable solution to level the Customer's one side of the yard. We would never encroach onto a neighbor's yard unless those neighbors were fully aware and agreed to relinquish us of all responsibility for future flooding issues. Even then, we would strongly advise against that. The Customer never obtained any formal agreement from the neighbor, nor do I believe that any owner of any house would agree to adding a flood risk beside their house, essentially filling-in the engineered slope. I challenge any Landscaper to legitimately "level" that side of that Customer's house without encroaching on the neighbor's yard and without at least a retaining wall (and likely additional drainage).
