Thalia Homes Reviews (%countItem)

2 sliding glass doors installed improperly.Thalia (formally Eco Friendly Homes) was notified 2 days after closing (8/2/17) and have still not fixed.
The hurricane impact resistant sliding glass doors are missing pieces, have a bent frame, and rub against the outside stucco. The doors have not been functional since moving in to the home July 31st, 2017. Eco Friendly/Thalia was first notified 8/2/2017 via Robert H., the GC/VP of Construction. The door issues was on track to be solved in Dec 2017 but Robert was fired and the installers were never paid. Eco then hired several other GCs and used a separate company (84 Lumber) to fix our doors. Since they weren't familiar with the door system, they made the door worse. Additionally, the trim work was never fixed after the failed attempt to correct the door. As of April 2020, all attempts to contact Eco/Thalia/Phoenix have failed as all websites and phone numbers have been deactivated. The person I believe is responsible is:

Miguel Angel Agular D.
Contractor Lic #:

Desired Outcome

My wife and I want the functioning hurricane impact resistant sliding glass doors that we paid for. Due to multiple unqualified vendors handling rhe doors and the fact that the current doors are no longer made, new doors and a complete re-install is required per the Custom Window Services representative that evaluated our door.

Thalia Home,LLC has not paid subcontractors & suppliers and we are receiving liens on our home being built at ***

Thalia Homes,LLC d/b/a Eco-Friendly Homes,LLC(Lic.# CBCXXXXXXX) has stopped work and has not paid subcontractors & suppliers and we are receivering liens on our home.
Thalia Homes,LLC & Greenergy Const. Co., LLC(Lic.# CBCXXXXXX) who we have had a contract with since 1/4/2019. Permit #SFRXXXXX in Hillsborough County dated 4/18/2019. The Contractor Miguel A. A. is not paying subcontractors, material suppliers, and now subcontractors have stopped doing further work to bring the house to completion of phase 2. We wired payments in Draw 1 and we wire paid an advance payment on Draw 2 on 10/2/2019, but we still have not received lien waivers from most subcontractors on phase one or phase 2. Only Cast-Crete and American Building Supply have provided lien waivers upon our own request from them. The contractor has not yet provided any lien waivers to us or a list of subcontractor and suppliers he has working for him. The contractor has been asked several time to provide a reason for such a slow progress of the construction of our home.
We now know why, they are not having any progress on the const. of our home due to lack of payments to other subs. At this time he owes over $85K+ to other subs & suppliers that we had to search up to know of who was not being paid.
We had paid $203K to Thalia Homes but we don't know why he is not paying his bills, we feel he is using our monies on other projects.
We were also told they had a contract on our pool const., & they requested 50% which we wired the $24,375.00 to them on 6/5/2019. The house block walls went up, second story and roof went up, but pool was never was installed. There never truly had a pool contract or permit in effect. They lied that they had a pool contract. The floor level was built to 12.33 foot above sea level due to FEMA and Hillsborough County code requirements. Now the only way the pool can be dug and constructed is going through the house with equipment to dig the pool and haul the dirt out because of the high elevation of the pool lanai level.
We went with Thalia Homes because they built solar homes as Eco-Friendly Homes in the Waterset Community in Apollo Beach. Two weeks ago the owner *** A. *** put the solar panel installation on our home on hold with the SolarCity solar company . It is in the contract Draw phase 2 that solar rough in should have been completed during phase 2 draw as all other electrical rough in should have been completed. If SolarCity had installed the Tesla Solar panels on our roof by Dec. 31, 2019 so we would be able to get the 30% tax credit that the IRS offered. They have not responded to Tesla's request for information for engineering and electrical dry-in installation either. Phase 2 has not been completed and James M. a previous worker was requesting a draw on phase 3. If they do not act on this soon we will also be dropped from the custom home solar program altogether.
We have been working with this contractor since June 2018, took till Jan. 2019 to get a contract with them, took them until 4/18/2019 to get building permit, started footers in May 2019; didn't have slab work done until end of Aug. 2019; at that point we were promised a closing date of Dec. 23, 2019 so we would have the 30% tax credit.

The contract to construct a single-family home was signed on 1/4/2019 Page ll Section G. Completion of construction states home to be completed within a time frame of 2 years. See attached Exhibit 1. The buyer elected to use their own Designer/Engineer to draw the building plans. Errors on the plans have caused significant delays in the building process. See attached Exhibit 6. To this date the buyers still owes the designer a final payment. I have attached a letter sent to buyers on 1/7/20 listing changes due to print errors, which have caused a significant delay in production. At contract signing the buyers where to pay a 15% advance permit submission. This was never paid to seller. Construction of home proceeded regardless of default by buyer. See attached Exhibit 2,3,4 & 5. This payment as of 3/6/20 is still outstanding.
The letter also states that until the additional costs are paid work will be stopped on the house. The most significant delay was due to incorrect finish floor elevation not noted on foundation plan by designer. The foundation had to be re-estimated and a change order had to be passed on to buyer. This charge is still outstanding.
The original pool contractor selected for this pool had defaulted on several other pools. Therefore, we cancelled his contract to build this pool. We contracted with another pool contractor and set up a meeting with him and the buyer.
The buyer informed me after they met that he had 2 previous complaints on Revdex.com and did not want him to construct their pool. This stopped any further construction of the pool.
Delayed payments to trades where due to hold payment of initial permit submission fee of 15% and payment of change orders due to print errors.
Trades as of 3/6/20 have been paid and lien releases furnished to the buyers. The buyers have since taken us off the permit and listed permit in their names. Therefor we can no longer schedule work on the home.
Thank You

(The consumer indicated he/she DID NOT accept the response from the business.)
We paid the required $5,000.00 Deposit as stated on the contract.
We paid Phase 1 payment and paid phase 2 payment in advance. See attached documents from BB&T our Bank Company.
We also were told that they had a pool contract and they requested $24,375.00 which is haft payment for the pool addendum. They did not have a pool contract nor was it permitted with the county. They did not provide any confirmation that "Woody's Pool and Steel" they said they had a contract with nor was it permitted. Also Woody Faircloth d/b/a "Woody's Pool & Steel" is not a licensed Pool Contractor.
We have requested lien waivers many times but Miguel A. the owner of Thalia Homes,LLC d/b/a Eco-Friendly Homes,LLC and Greenergy Construction the Contractor who drew the permit SFRXXXXX for our home at *** XXXXX has not provided us any lien waivers. WE HAVE NOT GOTTEN ANY LIEN WAIVERS FROM MIGUEL A. AS HE STATED IN HIS REPLY TO YOU!
We started receiving liens against our home, and subcontractors stopped coming to continue working due to not getting paid!
We have sent the letter that the Hillsborough County Building Dept. required us to send to fire Thalia Homes,LLC to Miguel A. We filled out the "Charge Contractor Form" and now the permit is under *** & *** the home owners.
Please read the copy of the certified letter we sent to Miguel A. and on email.

Re: Construction Contract Permit Termination

From: Home Owners *** & ***
Of *** FL., XXXXX

This correspondence is sent in accordance with Hillsborough County of Florida Development Services "Change of Contractor Form".
Over the last three months, it has become clear that the construction project under Hillsborough County permit number SFRXXXXX has not been timely and substantially completed; free of defects as per draw schedule (Exhibit "A" signed and dated by us on 4/10/19). The permit states the Contractor is Thalia Homes, LLC, but the License #CBCXXXXXX on the permit application is Greenergy Construction Company, LLC.
Because we are the bono fide owners of *** XXXXX we are required to notify you that today February 17, 2020 we are removing Greenergy Construction Company, LLC from the permit and taking over the permit due to Thalia Homes, LLC d/b/a Eco-Friendly Homes, LLC's lack of completing substantial performance under the contract in conformance with plans and specifications for construction of our home and for the lack of payments to subcontractors and suppliers which has resulted in multiple liens being filed against our home.
You cancelled the Tesla Solar contract on our home without informing us and have committed we paid half of the deposit for the pool, despite never having a pool contract in place for the property. You have committed numerous material breaches of the contract. You have been overpaid for the first and second draws, yet work has not been substantially done through draw two.
You have refused to pay bills or send documentation and work on the house even though you have been paid through draw two.
We require all copies of construction related materials and documents related to 937 Birdie Way, Apollo Beach from both of your Companies. We can be reached at (XXX) XXX-XXXX or at our current residence at 935 Birdie Way Apollo Beach, Fl., XXXXX.

Reference to Case# XXXXXXXX This clearly states that the elevation needed to be 12' to meet FEMA regulations in Hillsborough County. They now have claimed when they bid to build the house they didn't know it had to be that elevation. See James M. last email dated 11/13/2019.
