Poor workmanship, multiple mistakes, poor competency in construction resulting in delays and need for multiple repairs.1. Construction project has been going on for a year now (contract signed 10/1/13), still not finished, builder does not adhere to timeline. During the project there have been multiple delays -sometimes 2-3 weeks where project stalled and nobody showed up. Last example is the plumber - we were promised for 9/15 and as of 9/29 we still have not seen the plumber to install fixtures.2. Concerns about builder's competency; since installation of the metal roof we had 5 major leaks, he stated on 9/26/14 that he repaired the last one, on 9/29 roof is leaking again, destroying painted ceiling. He refuses to use a roofer, his carpenter did the job who admitted that he had never installed this large and shallow sloped metal roof before.3. Another competency issue: initial foundation had to be redone as it was not appropriate to hold the superior walls, he had to hire a new company to redo foundation. He has added extra $5200 to the grading budget that he wants the homeowners to pay.4. He has very poor communication and documentation, his financial statements are unpredictable and contradicting.5. He under-estimated every single item in the allowances and now wants the homeowners to pay the extra cost, yet he failed to notify us of price increase or change of orders.6. He mislead homeowners and [redacted] about an engineered grading plan . The plan was not submitted to Orange Co. and did not exist until 9/25/14.7. As of 10/4/14 THD owes homeowners $18,000 in credit that has not been paid.Desired Settlement1. Pay the credit he owes us.2. Correct the mistakes - esoecially the recurrent roof leak - we demand that it needs to be done by a certified roofer.3. According to his timeline the job should have been finished by 9/11/14. Construction project has been going on for a year now (contract signed 10/1/13), The contract was signed on 10/1/13. The initial start of work was delayed due to the homeowners loan not closing until late December. still not finished, builder does not adhere to timeline. No timelines were put in place in our contract. We had more rain and snow then normal which would have an affect on any job. During the project there have been multiple delays -sometimes 2-3 weeks where project stalled and nobody showed up. We can show documentation that the homeowner held up the job while making the layout decisions with the electrician. The electrician worked with them weekly to help the homeowner come in at their budget. The electrician has been out twice in the last 3 weeks as the homeowners were to furnish the electrical fixtures. As of Friday October 17 the homeowners were still missing electrical fixtures. This is just one example of the electrical hold ups on this job. Another hold up was their front door. The door was supposed to arrive in 13 weeks but it took 23 weeks to come in. During that time we finished all the siding that we possibly could without the door. The door held up the completion of the siding and the exterior painting. Last example is the plumber - we were promised for 9/15 and as of 9/29 we still have not seen the plumber to install fixturesa. We schedule the job as it is ready for the work to be done. The ceramic shower and floor was not completed. The homeowner insisted that the plumber could come in and begin working in other areas of the home while waiting on the ceramic to be finished. As we explained to the homeowner, the plumber could finish in 3 days. A plumber gets paid by the fixtures that he installs. Therefore he couldn't come in an install a sink or 2 while waiting on the ceramic crew to finish. (It would be worthly to note that the homeowner's ceramic selection was still not completed.) The plumber has been onsite since October 3 but he still isn't finished because homeowner is missing faucets and plumbing fixtures. 2. Concerns about builder's competency; since installation of the metal roof we had 5 major leaks, he stated on 9/26/14 that he repaired the last one, on 9/29 roof is leaking again, destroying painted ceiling. He refuses to use a roofer, his carpenter did the job who admitted that he had never installed this large and shallow sloped metal roof before. The homeowner is correct we had 2 roof leaks due to the roofing boots that had not be installed on the roof, no harm was done. The other 3 issues were primarily around the chimney. Our guy that installed the metal roof has done several roofs in the past with no problems. This is a unique roof as it has a 1/12 pitch master rib metal roof with a chimney through it. Although we make no excuses sometimes we need time to work things out on site. We had the metal roof supply company and another roofer meet onsite last week and have come up with solutions to fix all issues. The roof will have a long roof life. We have not in the past or future expected the homeowner to consume any of the cost of the roof repairs. 3. Another competency issue: initial foundation had to be redone as it was not appropriate to hold the superior walls, he had to hire a new company to redo foundation. He has added extra $5200 to the grading budget that he wants the homeowners to pay. The homeowner is correct. The initial grader we used misread his instrument and the slope was incorrect. As we understand, these things can happen in the field. We dismissed this contractor and brought in a new contractor. It took less than a half day to fix and get the job back on schedule. THD hasn't asked the homeowner to pay for any extra cost toward correcting the mistake. The overage the customer is referring is actually for the retaining wall and dirt that needed to be hauled into the job site. We had an allowance of $5500.00 for clearing and grading in the contract. The homeowner only wants to hear about credits. 4. He has very poor communication and documentation, We are actually very proud of our communication skills and the documents we use at THD. We answer every email and questions from all of our customers. We have been especially diligent in doing so with the [redacted]'s. financial statements are unpredictable and contradicting. Our financial records are keep with [redacted] by an onsite bookkeeper who is in the office five days a weeks to answer customers questions.5. He under-estimated every single item in the allowances and now wants the homeowners to pay the extra cost, yet he failed to notify us of price increase or change of orders. There were 31 allowances on their contract. One third of the allowances came in under budget and we are applying credits back to them. Another one third of the allowances came in slightly over budget. This is in part due to the homeowners selections off various items. The last third went over budget due to job site changes. When the contract was signed with the [redacted], the original contract price was over $900,000.00. The house only went down 200 square feet. They had some very nice items picked out for the house. We explained the changes that had to be made to get within the budget that the homeowner desired. That was the main reason for all of the allowances to help the homeowner stay within budget. We had addendums signed on items that the homeowners chose that were going to come in above their allowance. The grading was the only allowance that came in higher that was not due to a selection of the homeowner but as a necessity. This was explained to the homeowners.6. He mislead homeowners and Orange Co. inspection about an engineered grading plan . The plan was not submitted to Orange Co. and did not exist until 9/25/14. As per Orange County an engineered grading plan is not required on residential work. Per our contract page 4, #11, the homeowner is to have his lot surveyed and approved by the building and zoning officials of the municipality in which the improvements are located. We have no problem in assisting the homeowner in doing this. When we did have the survey done, it revealed a stream buffer on the back with an 80 foot setback that you cannot encroach upon. This is why the retaining wall became a necessity. We had no way of knowing it was an 80 foot stream buffer and not a 40 foot water runoff. This is the primary reason why the grading allowance went over. 7. As of 10/4/14 THD owes homeowners $18,000 in credit that has not been paid. $10,000 of the $18,000 was the deposit made on the home. That comes off the entire price of the house Under page 1, line 2A of our contract. We would only draw $358,000.00 from the bank if they want the $10,000. To date they actually owe THD Construction $8526.40 above their allowance. At the moment we are in litigation with the [redacted]. The home could be completed within two weeks if the homeowners let us do our job. NOTE:I have been in business for 18 years this past September. I have never been turned into the Revdex.com, nor have I ever been to court with a customer. I have built over 600 new homes and done over 10,000 remodels and additions. I think the problem lies in the fact that the [redacted] wanted a $900,000 house for $368,000. My contract is very clear about what is included and not included. My contract is very clear page two items 4 and 5 regarding THD Construction Allowances and Purchase Allowances for Buyer. I have and will continue to work with the [redacted] to finish their home. The home is very beautiful and unique. They are a very intelligent couple in which Mrs. [redacted] is a doctor and Mr. [redacted] is an artist; That is why I have been flabbergasted that they do not understand the contract they signed. I appreciate your concern in keeping my good name clear of any negligent comments.Sincerely,[redacted]Consumer Response The response from the builder is quite unsatisfactory and contain factual errors and statements that are simply not true.Since last communication we actually had to terminate the builder due to continuus roof leaks. We had the roof inspected by a roofing company and it needs major repairs if not complete replacement. This builder is incompetent and we will seek legal resolution.
