I contacted Acocella in January 2016. I was told that they would help us with getting us a loan modification. I was told that the process would take sometime and would cost us $800.00 the 1st 4 months and $400.00 each month until the end of the process. There was miscommunication throughout the process, sometimes not getting any contact for weeks, each time I did speak to someone it was a different person so trying to keep everything straight was difficult. In May we were told that we should file bankruptcy. They would appeal the decision for our modification but we should be prepared. In August our mortgage company denied everything and filed foreclosure. We were devastated to say the least. We were told that they did everything that they could, something I dont believe. We had to file bankruptcy in September to save our home. Acocella did not help us with anything. I paid them $4800.00, had to file bankruptcy and find an attorney to help with this process, which takes on more legal fees. Acocella made promises that were never kept. We are over 50 in age and will never get out of this mess.

Review: I was in the process of a divorce from an abusive husband. My 3 granddaughters and I have lived in the home for over 7 years. The bank was not willing to work with me and I was on the verge of losing our home. Acocella assured me they could help. After $3,600.00 I was no closer to safeing the home than before. They claimed they spoke to the President of the Bank and had sent several letters which I found out was not true. When I questioned them about promised results within their stated time-frame they were quick to say they could not do anything for me. That the President of the Bank was unwilling to cooperate. They asked that I send back all the paper work that I had from them including the contract. Because I had never in 25 years dealt with such things (my husband controlled all) I was very naive and did so. I am asking, more pleading, that I be refunded all my money back. Please so I can continue to keep our home which was only saved by filing a chapter 13. Please need the money as soon as possible...Desired Settlement: Refund of the money I sent. I even told them I was on SSI and 2 of my granddaughters also receive SSI (1 is Autistic) I am in desperate need of the money... Please

Please note that we have reached a verbal agreement with the client. Upon following up on this matter the client's phone is not accepting calls. During our conversation the client acknowledged the misunderstanding and said our agreement was fair.

Review: I was contacted by Acocella Law Group concerning our mortgage. We, as so many others, are behind in our mortgage due to an unexpected and sudden hardship. Acocella vowed to get us an amicable solution through modification with our lender. Acocella guaranteed results saying they had great success with our particular lender and have provided their services to many others in our situation. We are now out approximately $7000 after months of payments and their assurances that the process was progressing accordingly. It all ended abruptly when they said that there was no solution for us due to the bank's guidelines and that there was nothing more that they could do. They knew are situation when they took are case, nothing changed and if they had success with so many other modifications as was claimed then they knew the guidelines and if we qualified or not. We are seeking our money back, it would be nice to get it all returned but we would be satisfied with at least most of it. As a final note, it is a travesty that there are so many unscrupulous lawyers and modification "experts" that want to take advantage of someone who are asking their help, believe me Acocella is just one of many. It is to the point where I do not trust anyone. and that is just sad. Thank You, [redacted]n [redacted]Desired Settlement: All or most of our money back

Review: I hired the Acocella Law Group in July to help me get a modification. I was in contact with them evvery step of the way. When I was asked to send some proof of income and bank statements to aid in the process , I did. I was also in contact with my bank. My bank kept telling me they did not receive any modification paperwork,, but when I called Joseph D[redacted] about it, I was always told the same thing: the paperwork was submitted and that the mortgage companies lie. After 4 months , at a total of 3200 dollars, I received a modification offer. It was still a bit steep so I contacted Acocella to find out what to do. I was told I should just take the offer because its the best I will probably get. They made it seem like this was a result of their work. I had further questions so I called the mortgage company and found out they had NEVER received any modification paperwork in all that time! I called Joseph D[redacted] and he said it wasnt true, so he made a call to the mortgage company and included me in it. They told him straight out that they had never received anything. We hung up, and he said he would look into it. I later received a call and though he still didnt take responsibility , he offered me three more months free for them to help me out. I did not take that deal because I no longer trusted them. I had to hire another attorney to try and get my money back. They only offered me 800 dollars. That is outrageous! They did nothing for me. I was even willing to let them keep 800 of my money just on the off chance that they actually put together paperwork. They still would not settle this. My mortgage company did finally get a package from them, but that was AFTER all this went down. This is ridiculous and I am going to call [redacted] and [redacted] to try and get this out there so everyone can see that this is not a good company to deal with! If I cant get satisfaction that way then I wil be going to court. I will not let them get away with this. I will be spreading this all over the internet too! IF you make a mistake or drop the ball take responsibility and refund the money you took!

Response:

There appears to be some confusion with the work done for this client. We were in regular contact with her over the first few months getting all the information necessary to made a submission to her lender. As we were completing this process her lender offered her a Streamline Modification. This type of modification is not based on the homeowners specific income and hardship, but rather other factors including house value. It is possible to make a submission and try to get a better result while moving forward with the streamline trial modification. This is what happened and it appears that we did not explain this to the client completely. AS she indicated we made a submission and as a gesture of good faith suspended billing while she was making her streamline trial payments. We have discussed all of this and the client now understands what happened and we were able to successfully work out a resolution.

Review: I hired acocella law firm to help me modify my mortgage. They claim to be attorny's, but there nothing but regular people telling you they can modify your loan. I signed up with them and agreed to pay a certain amount to get my loan modified. I set up a automatic payment plan through my debit card. They took a payment of $824 to get the account rolling and to start the modification process. After one month of being there customer I had a change of life happen to me. My wife told me that she wants a divorce and that we should sell the house. I called the law firm to tell them that I wanted to cancel. They tried to talk me out of canceling and they said to wait a week to think about it. I called two days before my next payment was due to cancel, they said that they would not move foward with my account and that no other payments would be taken from me. Well two days later the deducted $824 from my debit card. Now I paid them a total of $1648 for nothing. I called them up and they give me a story that the money was used to cover fees and paperwork. Its all bull, This is just another one of those modification scams that I got sucked into.Desired Settlement: I want a refund of $1648. They did nothing for me.

Review: I met with Joseph D[redacted] AKA [redacted] in May of 2015 with an attempt to settle my second mortgage in which he guaranteed me he will settle. He advised me and my fiance he will have a settlement offer from our mortgage bank late august and the offer will be anywhere between 7%-25% for a fee of two payments of $750.00 for two months due on the first of each month starting June * 2015 and on July * 2015. after receiving the first payment of $750 on june * Joe D[redacted] called us on June ** asking for the second payment of $750 which we denied and told him we are going to make the second payment on July *. He kept in contact with us the hold time while we were making the payments up until the last payment. In early August we contacted Joseph D[redacted] to find out how our settlement was going only to find out he can't settle our loan and he can no longer help us settle our loan despite him telling us initially when we hired him for his service and also advising us that he have settle second mortgage loans with our lender many times before and after asking him for a refund he told me no he cannot refund me back none of my money and not even partial and then went on to saying that I did not make any mortgage payments for the last several months so it shouldn't matter if we got a refund or not. This company needs to be investigated they're predatorial practices and Joe D[redacted] looked me in the eye at his conference table in his office and guaranteed us a settlement and in the end he said he did not this is awfully WRONG BEWARE PUBLIC this company is not right I am hoping for a refundDesired Settlement: I am looking for a full refund after being mislead

Response:

We strongly disagree with [redacted] accusation that we guaranteed him that we would be able to settle his second mortgage. The retainer he signed with the firm clearly outlines that we cannot guarantee a specific or positive result. To make sure that there is no misunderstanding about the service we are being hired to provide, all new clients must complete a compliance call prior to us being engaged. In this call we confirm key aspects of the service with the client to assure that there is no misunderstanding. This call is recorded with the client’s permission. [redacted] Completed this call on June *, 2015. In this call he clearly confirms his understanding that we cannot guarantee a positive result. We have reached out to [redacted] and are hopeful that we can resolve his complaint amicably.
