Review: I joined AFC Fitness two weeks ago on January 03, 2014. At the [redacted] location. The sales rep was [redacted] I received an email for 30 day free trial. Once I went to the gym it was a total different situation but they offered me to join with paying $1.00 registration fee and paying $56.00 monthly or pay month to month at a higher rate. I elected to pay month to month. [redacted] then told me that I would have to pay the $1.00 that day and pay the $56.00 by January 15th, I asked why so soon. Normally your monthly fee does not start until the next month. I also explained that I would not be able to pay until January 17th. Needless to say they took their membership fees out of my bank account on 17th of January, but the next day I get a letter saying I owe $20.00 fee because the money was not available on 15th of January???? I called the number on the letter which is to their [redacted] office. Left a message on their voice mail and two hours later received a call from [redacted] She was rude, talked down to me and basically scalded me for being a new member who could not pay her monthly fees. She then told me I had a option to pay on the Jan15th or the Feb 1st of each month. I told her that was never explained to me that I could pay the Feb 1st nor did [redacted] offer that option to me. After going back and forth and getting no where, I asked for a supervisor or CEO or Director. She told me there was no one she was the head person in charge. I asked how do I cancel my membership since I have not been a member for a full 30 days. She told me to call the location that signed me up, which was the [redacted] office. I called spoke to [redacted] asked him how would I cancel my membership and he told me I could not and that I was stuck being a member for one year. I want to know what my rights are legally. When I asked [redacted] who was in charge at the [redacted] office he told me he did not know. This is illegal and something must be done.Desired Settlement: I want my membership to be cancelled. And I never want to do business with them ever again. I plan to go to the media about how these gyms neglect to be honest about what the consumers rights are, especially fees that are involved. And I also plan to file a complaint with the [redacted] office.

Thank you for the opportunity to respond to ID [redacted] I have reviewed the complaint in conjunction with the membership agreement signed by Ms [redacted]The membership agreement signed on 1/2/14 was for an initial term of 12 months at regular dues with the 1st payment due date of 1/15/14. The contract further states, "I hereby authorize [redacted] dba "The Aquatic and Fitness Center" to initiate debit entries to my credit card account or my bank account named below." It further states if AFC does not receive and is unable to collect monthly dues, the account will be subject to an administrative charge.As I understand from your statement, you were offered a month to month contract but chose the annual contract. With regard to cancellation, upon completion of the initial 12 month term at regular dues, the member is eligible to cancel with 60 days notice either in person with a club manager or via certified mail. For cancellation with a disability or relocation, please refer to your contract.We apologize for any misunderstanding and have extended a professional courtesy by waiving the administrative fee, which would reduce your current balance to $56.00. Once the account is updated, you will continue to bill monthly on the 15th of each month. If you would prefer the option of billing on the 1st, we can prorate the month and change the billing period. If this works for you, please let me know prior to 2/10 before the February file is prepared and submitted. We appreciate your business and we are looking forward to working with you to achieve your health and fitness goals.

Review: I contacted AFC in response to an advertisement for a free month of membership.

It was not free; I had to pay them $177.23 as an initiation fee to get the free month. Within two weeks of joining, I was dunned for $65.00 (one month’s fee) plus a $20.00 late fee. There has never been a free month.

I discussed my problem with AFC’s receivables clerk today. She told if I’m not satisfied I should cancel my membership and good riddance to me. As such, I am being told to disappear, but they will not refund my money.

They also tell me that if I cancel my membership (which I have been told to do as above) they will ruin my credit.

This is the first notice received from the Revdex.com. Mr. Littman received a complaint directly from Mr [redacted] and responded via e-mail on June 13th at 3:33pm. The response is as follows:Dear Edward, I am writing this clear up any misunderstandings we may have regarding your membership at AFC in Jenkintown,PA. You joined the fitness center on March 19th 2013 for a term of One Year. See the attached signed agreement. You also initialed the back of the agreement and the about your membership form explaining all obligations from both partied during your membership term. Your contract clearly states your first billing would be one month later, April 15 2013. On April 15th we billed the card on account and it declined. As per your agreement you were charged a $20 late fee. When you called in response to our collections letter [redacted] removed the late fee as it seemed you were confused as to when your billing started. You mentioned that you heard about a free month on the radio, and The Manager in Jenkintown offered you that courtesy although you are actually contractually obligated to pay it. We waived your payment for May as offered and you will be placed back on billing for June 15th as obligated. Your account is currently overdue for $65 for April’s payment. I apologize for any confusion on your end but we have done everything we can and more to make you happy and it has not seemed to satisfy you. I received your messages regarding the Revdex.com and attorney general, etc. Sir we have done nothing wrong and have only tried to make this work. We would appreciate you paying your past due balance of $65 for April and we can move on and you can enjoy the fitness center. We would like to all move on and I am sure you do as well. Review: [redacted]The response if not acceptable for the following reasons: The free month membership was advertised on WPHT, a highly respected Philadelphia based radio station. If respondent is not legally obligated to honor this offer by contract, he is obligated by his advertising. This offer was not at the discretion of the unit manager. Fraudulent advertising is a serious issue, and actionable through the Pennsylvania Attorney General’s Office Consumer Fraud Division. I have been in correspondence with this office.On 19th March 2013 I was charged a membership initiation fee and the proration of the membership fee for the remainder of March totaling $177.23. To date, I have received almost no benefit from this sum of money. I have only visited the facility once which can be verified by the electronic check-in at the local facility. I did not return because I felt utterly had, and believed if I returned I would be ejected.As stated in respondent’s letter, I did speak with a woman named “[redacted]” in Accounts Receivable. She was unhelpful and hostile. She told me to, “Cancel my membership and good riddance”. I feel an apology is required.To date, the only written correspondence I have received from respondent are two dunning letters, and a copy of respondent’s letter attached to this complaint delivered in hard copy. To date, there has been therefore no known attempt, communicated in a good, timely manner of respondent’s effort to rectify these issues. Further action is required.
