On 7/28/I went to Lexus of Concord had a meeting with *** ,*** ,***The meeting started off with me asking *** why didnt tell the truth to Lexus Corporate about the car***s reply was his mechanic *** *** told him that he found problems with car but didn't put it in the computer because they told him it was going to do a buy back and don't fix it and this was after talking to Lexus Corporate*** explained to me that's why he told the Corporate is was nothing wrong with the car and for me to come and pick up the carThe lady from Lexus Corporate name Kathy was very disrespectful and told me she talk *** and there's nothing else she could do and for me to go and pick up the car and if not Lexus was going to start charging me storage fees and she was closing my caseWhen asked her to put me on a conference call with me and *** and she never called me back and stop answering my phones callsOn 8/02/I went to Concord Lexus talked to *** he said it would be best if I comes tomorrow and go on a road test with the mechanic so I leftOn 8/03/I went to Concord Lexus at 7:00am and *** told me that Lexus corporate had hold and also red flagged my car so anywhere I take to the would not work on my carThere was a customer there by the name of *** that witnessed the whole conversation and said he couldn't believe how I was being treated and he would never recommend no one to this Lexus againI left and called corporate and they did not and if I don't pick up my car today I will be charged $dollars for storage*** called me minutes later and told if I don't pick up the car I would be charged storage $dollars a day even though the car still not fixedWhen arrived to concord Lexus I had words with *** the service manager I told him stop lying and tell the truth*** yelled at me and told me his lying nothing's wrong car and get out even though his mechanic *** told them it isI was told now I'm banned from Lexus of Concord because of ***The Manager *** told me to bring it back when it start acting upWhen I left and got on freeway it start pulling to right and you hear the motor revving but car isn't moving I went straight to Oakland Lexus and the mechanic went the back and told me to come in weeksThis is all because *** and *** liedEven the salesman said it was lemon by how many I brought inHe tried to sell me another vehicle but Lexus didn't want to take no lose

This is in response to Mr*** complaint. Mr*** came to our dealership on Oct 8, to look at our Kia Optima we had advertised on our website. Mind you this was a 36-mile trip and there are a lot of dealerships between there and here. However, he came to us because of
the price of my advertised vehicle at $14,980.00. He states he was told the car was brand new. That is a accusation on his part. I submit his very own finance certificate he brought with him showing the car and mileage of 8192. We are not a Kia Dealer so we are not licensed to sell new Kia’s and he was not told it was new by any employee here. Kia’s factory warranty covers the vehicle He states that we deceived him. That is a claim also because his question was did we know if it was in an accident. The two employees that he spoke to stated that they were unaware of it being in an accident. He thought the bumper was a different color. He did not purchase the car that Saturday, he returned on Tuesday the 11th of October to purchase the car. Mr*** sent a demand letter to our dealership on November I immediately called him and stated I was surprised of the letter and that he never reached out to talk to me. This was the only time he contacted me. In the demand letter, he stated that a Kia Dealer told him the exhaust had been changed to aftermarket and that the bumper had been changed. I told him to bring the vehicle in and I will check it out and take care of him. He did bring it by on a Sunday and I put him in a rental car after viewing his complaint. I told him at the time of his purchase I was on vacation when he bought the car and if he ever asked me about the car I would have explained to him the following. When I purchased this vehicle it had bumper damage that looked to me to be consistent with backing into a utility pole. I scanned the vehicle to get a Carfax history on the vehicle which I have enclosed. The Carfax states no accident. I am the main appraiser and purchaser for the dealership with over years’ experience. I checked the vehicle for any structural damage that would diminish the value of the vehicle and there was none. The parts that were replaced were a bumper cover and a rear bumper impact bar. These parts are bolted on and are removable parts. The tailpipe was bent and the body shop said they could straighten it I told them no and to replace it so they did with the original aftermarket exhaust. This is part of Mr*** complaint. That is the only part Kia couldn’t warranty because it is not their part. As requested by Mr*** in his demand letter I replaced the exhaust with factory and had the body shop do a better job on the painting of the rear bumper. I maintain that Mr*** was not knowingly deceived by my employees or myself. All his original demands were completed. Mr*** bought this vehicle for its significant value and he paid $14,for the car and not $16,as he statedAttached is a copy of his purchase and sales along with a NADA book out sheet for the vehicle that he purchased. This sheet is necessary for the bank and was sent to them at the time of Mr*** loan application which shows a NADA retail value for $18,475.00. I believe the price of $14,is a significant reduction compared to the true value of the vehicle. I maintain if Mr*** was not satisfied with what appeared to him as a mismatched bumper he had the opportunity to not purchase the vehicle. I also believe the only reason he decided to purchase the vehicle after that time was because he knew it was a great value. If Mr*** is not happy with his car I will gladly offer him a full trade in value of his original 14,towards another used vehicle of his choice on our lot. Sincerely, *** ***

This is completely falseI have not received any sort of payment, no did they call me to see if I would accept this amountI will accept the sum of $1,and will drop the complaint and stop the seven on your side investigation
