I am rejecting this response because:I am filing with Anoka County Conciliation court October 20th to resolve the matter. Waiting over one month for a response is unacceptable, especially when in a previous email, the Asphalt Company admitted they would be at the house to replace the driveway

See attached pictures.  Exterior  Floating slabs not completely resting on a frost footed foundation are subject to freeze thaw cycles in MN.  As such, conditions caused by the seasonal movements, including uplift pressures from frost heave can not be warranted. The slight movement...

over the winter caused a hairline crack in an inconspicuous place where the only issue is, the crack is visible.  The crack in the customer's concrete apron is at an inside corner, where no significant separation has or will occur. We certainly apologize for the concern Mr [redacted] has suffered. Our records indicate that Mr [redacted] emailed us on May 20, 2017 asking about an estimate. We responded by email requesting a physical address to determine his location to ensure he was inside our service area and so that we could find...

it.  No response was given to the request for the address.  Phone records also indicate no call to or from Mr [redacted].  We have no record anywhere that an appointment was made by email or phone.  If by some chance an appointment was made and somehow got misplaced or skipped over, there is no record of that here.We have been held up on previous appts and subsequently been late on occasion for the next appt  and always call the customer to tell them we are running late and see how they wish to handle it.  If the appt for a driveway estimate is important enough to Mr [redacted] that, if missed, warrants an immediate complaint to the Revdex.com, then one would certainly think we should have been given a chance to address it at that time by receiving a call or email from him informing us that we missed it. I am rejecting this response because: I don't feel the weather did this.  We had the mildest winter we've had in years.  I don't think that an apron that was 5 months old should have that size of a crack in it.  I have friends that had an apron done the exact same month I did and they do not have a crack this size.  I truely don't think that Jim (the owner of Asphalt Company) would accept this kind of workmanship if it was done on his driveway.  If he isn't going to replace or pay me that portion of the apron that would be something he would have to live with.  I just disagree with these business practices.

Let me be clear, my business currently only accepts cash or check. I don't have enough customers requesting to pay by credit card to make it cost effective. Ms. [redacted] is, in fact, the first customer this year to ask to pay by credit...

card. If I accepted credit cards, I would need to increase a customer's invoice to cover the three percent per transaction charge, not mention the monthly fee to maintain an account. In this case, it would at least an additional $21.00.
During the initial conversation when I informed Ms. [redacted] that I did not accept credit cards, I also told her she could pay me when she had the money.
If I was upset, it was because she kept insisting she could only pay by credit card and then she threatened not to pay me at all. Cue my own threat to take her to conciliation court.
If she felt I was pressuring her for payment, it was not my intention. I send monthly invoices to all my customers if I haven't received payment and I do not charge interest. Again, I would like to reiterate, that I told her she could pay me when she had the money.
I will not reimburse her the $30.00 her credit card company charged for taking a cash advance.

He lied. He never told me up front that he did not take credit cards, if he had I would never have gone with him. he called me and told me I had to pay right then because it had been 2 months since he did the service. I never once told him I would not pay him, he did a service for us and it was always my intent to pay him for the work he did. I am pretty sure he is paying a fee for taking checks also.
I said what I needed to say about the way he runs his business and the way he treated me. I do not care to take this any further. It is all she said he said after this. I hope that this can stay on his Revdex.com record.
