In response to the complaint from [redacted] , I would like to share my version of our conversation and my actions that were not represented accurately in his complaint[redacted] did purchase the vehicle in question last December from me.I had indicated that the transmission had been replaced and repaired recently in the vehicleI never posted that this was "NEW" car in any fashion or that it had "BRAND NEW" tranmission in the sense that it was repaired from "BRAND NEW parts"--its an older vehicle and repairs to these often come from other vehicles that work for those repairs In our discussions about the repaired transmission prior to the sale, there was never a discussion or an exclamation by me to the transmission repair-nor did he ask me any specific details about the repair The car was repaired and in good working condition at the time of the sale and I had no reason to think that repairs completed by [redacted] would be inadequate in any way The repair came with a 6mos gaurantee[redacted] contacted me late in May and indicated he had some issues with the tranmission and asked me to send him the info/receipt from Wayne's about the repair I did this via email to the email address that he sent me--which was sent to him on May 27th, to [redacted] I will forward that copy of that transmission receipt that shows the date in which I previously sent him that info.After that, I did not hear anything back from [redacted] until I was forwarded this complaint from your department.I am not intested in paying [redacted] anyting based on the following reasonsThe car was sold AS-ISThe car was not described as "NEW" in any wayThere was NO INTENT to mislead or and hide any information about the transaction that we were entering intoThe car did not have any issues for over mos when he apparently did have issuesI have no way to know to the extant of how the car was driven or maintained to know whether or not the usuage of the vehicle contributed to the repairs that he indicated were needed to fix his vehicleI feel very badly that [redacted] did not feel that the car met his expectations and I am disappointed in the way the car turned out for him Unfortantely, cars are machines that require upkeep and repairs from time to time and when we sell and older car for a very inexpensive and good price, we have to sell these cars "AS-IS" because it is impossible to know what each car might need down the road--especially over mos laterThere was never any attemt made to mislead [redacted] His frustrations come from unmet expectations and I agree that he has a right to be frustrated I'm sorry that he had a bad experience with this vehicleBut to the issue of me trying to mislead him, that was never the caseThe car was sold "AS-IS" and disclosed properly and fairly.Again, I will forward you the previously sent email of the repairs made through [redacted] Respectfully, [redacted] ***The Auto Scout

*** did advertise the vehicle as having a band new transmission aThe headline on the craigslist posting did advertise the car as having a brand new transmissionbHe advertised on the window of the car that it had a brand new transmission - I have a photo taken on the day I first stopped by so I could get his number and call himCHe did state that he had a new transmission installed The discussions revolving around the transmission were he said he had a new one put in, He did tell me where he had the work done, I wanted to because many time the shops will still honor warranty work even if the car changes hands.I do agree that that the car is usedI understand that the risks in purchasing a used car Outside of this issue I do not believe that *** is liable for repairs I have made to the car outside this claim.The main reason I purchased this car was because the transmission was advertised as brand new Knowing it was a used car and based on the age and miles there risk that the transmission might need to be fixed, replaced, or rebuilt, mitigates some of the risks in purchasing the car This is not so much of there being no warranty on the car itself but that he misrepresented what work he had done on the vehicle If he had not advertised the vehicle as having a brand new transmission I would have never entered this claim Regards,
