In response to the consumers complaint, the dealership cannot accept responsibility nor the liability for charges the customer incurred for rental cars in excess of the agreed days while the car was in the shop The customers car was repossessed by their loan company, which of course is not in the dealerships control Therefore, we do not agree that the customer’s outstanding invoice should or will be paid by the dealership Regards, [redacted] Chief Operating Officer The Autobarn Dealer Group [redacted] Evanston, IL [redacted] @theautobarn.com

I have attached a copy of the response for Ms*** The Autobarn City Mazda and MsGarcia-Jimenez, did enter into a contract to sell/purchase a vehicle and with that the customer requested the 1.9% financing through Mazda Capital Services that was being
offered at the time of her purchase. Unfortunately, MsGarcia-Jimenez was not approved by Mazda Capital and there were conversations between her and my finance department regarding her optionsReturn the vehicle and return both parties to whole statusWork with a different lender at different terms She was initially upset she hadn’t been approved, but she did agree to think about her options and get back to my finance dept. Shortly thereafter she retained an attorney, who contacted me and I agreed to absorb the cost difference in the rate from the new bank for the sake of customer goodwill I personally sat with MsGarcia-Jimenez and resigned her, at which point MsGarcia-Jimenez asked me several leading legal questions, which I explained she should seek the correct legal answer by consulting her already retained attorney In closingalthough it did take some time to obtain an approval for her financing, the dealership in good faith and at its sole expense kept MsGarcia-Jimenez loan exactly the same as both parties agreed day one. The dealership will not be compensating either the customer or her attorney for any additional fees or invoices. We of course wish her loan was as easy to approve as most, it was not. We do feel we provided the proper vehicle and ultimately the contract the customer requested. I am rejecting this response because: It does not address the bait and switch and the manipulation of numbers to confuse us during the sale. The seller did not allow us to pay cash for the vehicle and insisted that we finance the vehicle and wait a two or three weeks and pay it off if we wanted the carThe used car was advertised one price in various places on the internet and then padded the price of the vehicle all during the same week. The dealer installed an "add on" that to this day still does not work and wiring was manipulated by a "gypsy connector" to hotwire the moonroofThe car was advertised with new tiresOne tire on the rear was and still on the vehicle is OLDER than the car. Three different tires are on the car. As far as a free detailingI did make an appointment for the free detailing I was promised a few days later after we bought the carI waited for hours and they only washed the car and said they could not do it

as a measure of goodwill, I will offer a one time goodwill check to the customer in the amount of $which can be either mailed to the customer or they may choose to pick up at the dealership with hours pre notice to me personally or if the customer would prefer, I will offer a $in store credit that can be used for service or parts purchases. I will issue a letter of credit within hours of acceptance to this option. I do not agree with the customers classification of the vehicle or the service they received, however if a goodwill offer on our part will help this matter, I am happy to assist. *** ***

THE DEALERSHIP WILL BE HAPPY TO AHVE THE CUSTOMERS CAR DETAILED FOR THEM.  I WILL HAVE A NOTE PUT IN SERVICE THAT THE CUSTOMER IS ENTITLED TO 1 DETAIL FOR FREE IN THE NEXT 90 DAYS TO USE AT THE CUSTOMERS LEISURE.  CAR PRICES DO GO UP AND DOWN BASED ON MARKET SUPPLY IF THE CUSTOMER IS WONDERING WHETHER OR NOT A PRICE CHANGES OVER TIME, THE ANSWER IS IT COULD.  I'M NOT PREPARED DISCOUNT OR REFUND BASED ON PRICE SWINGS IN THE MARKET, BUT MY OFFER OF A FREE DETAIL WILL STAND FOR 90 DAYS FROM TODAY.[redacted] GM
