I am rejecting this response because:
When I signed my lease I was told I was paying a $deposit, not fees, a depositNow that it looks like there's nothing I can do about it all I can say is The Avenue San Marcos needs to learn how to properly train their employees on what they're telling residents that they are signing for.
As for the assisting in helping me find someone to lease my room, I found someone on my ownThe manager's suggestion to "put an ad on ***" was something I had already been doing and having no luck on as most of the people that responded were flaky when it came down to actually doing the paperwork and taking over the roomThe Avenue did not assist me in finding someoneBy luck, a friend of mine's boyfriend was looking for a place to stay at that time and went through with the sublease process
I did just find out today that the $charge was finally taken off my account todayOnly after getting in touch with someone from The *** management company and talking with her about itShe told me that the request to reverse the charge was never put inThe property manager assured me on March that it would be taken care of by the end of that weekBut that didn't happen as she did not do her job of submitting a reverse request even after I showed her proof that I was not responsible for that chargeSo I do not feel badly about any review I have given to The Avenue San Marcos as I, and many others feel the same wayThe Avenue San Marcos management doesn't pride themselves on helping their residentsAll they care about is what they can get away with and their bottom lineThis was the most horrible renting experience I've ever had.

To Whom It May Concern:
Attached you will find a copy of the lease contract between The Ave at San Marcos and *** ***Page has a section on security depositsIn that section it states Mr*** was responsible for a $security deposit At the time he signed his lease
contract with us Mr*** was responsible for a total of $in feesThese fees consisted of a $application fee, $activity fee, and $redecorating fee I have researched his file and there is no documentation supporting Mr***’s claim of paying a deposit. And while I was not the manager when Mr*** signed with us, I did inquire about this matter with our Regional Manager. He was the Regional when Mr*** signedHe stated that deposits were not required during last leasing season but fees, usually totally $305, were required from many residents. Whether a resident was responsible for these fees depends on when they signed with us and if we were running any type of signing special at that timeMr*** did receive $from The Avenue on 6/17/in either the form of a gift card or cashI am unable to verify which form he received as we utilized both at that timeI have attached the form he signed for this $150. He received this due to the leasing special that was being offered at the time
As for the electric charge, it was charged to his account in errorMr*** was informed of this both verbally and by emailThere is a process required to reverse charges and I apologize that it is taking longer than he is comfortable withI encouraged him to keep our email correspondence so he would have that documentation
It is upsetting that Mr*** finds us “shady”Recently we assisted him by allowing him to sublease his unitWe even greatly helped him by providing tips and ideas on advertising and encouraging him to keep tryingThe end result was he found a person to take over his lease and alleviated himself of that financial constraintWe strive to provide the best experience possible throughout our resident's entire leasing experience
Mr*** has been in communication with our corporate office and, as of today, has received a response from them on this matter Should he have any documentation to support his claim about the $being a deposit then I would encourage him to produce that so we can revisit this matter for him If anyone has any questions please feel free to contact me

***, Per our lease agreement, all utilities must remain in a residents name during the lease contract termIf utilities are shut off or removed from a residents name then The City of San Marocs notifies The Avenue as we now will receive a utility bill in The Avenue's nameThe lease
contract reflects "utility shut off" as a violation therefore the first offense is $per resident and $each month utilities remain "turned off"The reason for this practice, residents are solely liable for the cost of utilities. The Avenue has added an Utility Cap option which allows residents to select the utilities to remain in The Avenues name as The Avenue will then bill the resident a $premium, per month, which avoids the above scenarioAll roommates must agree to select this optionThe $monthly premium will cover $of electricity and $of water; if an apartment is to exceed these cost then The Avenue will bill that apartment the addition costHowever, if an apartment usage is less the $50, unfortunately the remaining cost does not roll over to the next month. The option to select the $Utility Cap or set up utilities with The City of San Marocs, directly, is up to the residents at the time of signing the lease contractThe Avenue does not promote one option as better than the other, we simply provide the options and describe each options perks or cons then we allow the resident(s) to choose from these options.Thank you, *** ***

I am rejecting this response because: This is fraudulent business practice.  One person is REQUIRED to get the electricity in their name, but ALL tenants are responsible??  I believe this is merely a way for you to extort $ out of college students and their families!  I made a mistake in shutting it off 7 days early, but that should not be any of your business!  In 'the real world" if you turn your electricity off, you simply don't have electricity!  Nobody was living there at the time, and I see that you were in fact able to split the electricity for those 6 or 7 days between the three girls, which proves that the only reason you require ONE RENTER to get the electricity in their name is so you can RIP people off!  The only thing I am willing to pay you for, is my portion of the electricity that was used for those 6-7 days when nobody was even there! I am also going to contact THE CITY OF SAN MARCOS because I feel they are "in on this scam as well"!

successfully completed the application process. The application process consist of a background check and credit check on each application. The application itself does not bound one to a contract, that would be the lease contract itself. Once the application process has been completed then a lease contract is needed in order for one to choose The Avenue at San Marcos as thier home. Signing a lease contract will guarantee an individual the type of floor plan requested, dates requested and rates of that floor plan during the time of signing. By signing a lease contract The Avenue at San Marcos will hold that particular space for the individual as we have mutually agreed to one another. If an individual, at any time, decides they cannot or are unable to uphold their end of the contract then The Avenue at San Marcos' contract does offer a release clause. Paragraph 30 of the lease contract:"As stated in your lease, you may not sublet or re-assign your apartment without your Landlord's prior written approval, which such approval is in Landlord’s sole discretion.  Sublet and assignment fees are $200 per sublet and $300 per assignment.  The prospective tenant must fill out and submit an application and an application fee of $30 to Landlord. "Per the lease agreement, anyone has the right to find someone else who is willing to take over their own lease contract at any time. The release or reassignment fee is $300.00 in order for someone to take over a lease contract. All lease holders have this right. The Avenue at San Marcos is excited to offer excellent living opportunities for anyone who has successfully completed our application process and completed a lease contract.
